No. 4130-L.S.G. - In exercise of the powers conferred by Section 33 of the Bengal Vaccination Act, 1880, the Governor of Bihar is pleased to make the following Rules:-1. These Rules may be called "The Bihar Vaccination Rules, 1944".2. In these Rules unless there is something repugnant in the subject or context:-

(a) "the Act" means the Bengal Vaccination Act, 1880;

(b) "Superintendent of Vaccination" means an officer who by virtue of an appointment under Section 25 of the Act or in accordance with the provision of any law for the time being in force performs the functions of a Superintendent of Vaccination; and

(c) "Local authority" means the Commissioners of any municipality or the committee of any notified area constituted under Section 389 of the Bihar and Orissa Municipal Act, 1922, or any District Board, Local Board, Union Board, Union Committee or other authority for the time being exercising power under the Act within its jurisdiction.

Rules Under Clause (a) of Section 33.

Qualification of Public Vaccinators.

3. (1) No person shall be appointed as public vaccinator or authorised to act as a public vaccinator-

(a) for any area where the licensed system of vaccination is in force unless, after oral and practical examination he has been granted by the Superintendent of Vaccination under Rule 19 a license which should be valid for the year in which it is issued and shall be renewable every year; or

(b) for any other area unless he has been granted after such examination by such Superintendent a certificate of competency in the form specified in sub-rule (2).

(2) Such certificate shall be in the following form:-"I hereby certify that I have examined..........as contemplated by Rules 3(1) and (4) of the Bihar Vaccination Rules, 1944, and that I find him qualified for the office of public vaccinator.

4. Every candidate for the office of public vaccinator shall be-required to satisfy the Superintendent of Vaccination that he has been engaged in vaccination work in the capacity of an apprentice or an assistant for a period of at least six months and possesses the following qualifications:-

(a) Knowledge of reading and writing as required by the Middle Vernacular Examination or Middle English Examination;

(b) Knowledge of the phenomena of the vaccine disease;

(d) Knowledge of the methods of collecting and storing lymph;

(e) ability to recognize a satisfactory vesicle and cicatrix;

(f) General knowledge of the disease of small-pox and how it is differentiated from chicken-pox;

(g) Knowledge of the provisions of the Act in so far as they relate to the duties of a public vaccinator; and

(h) Knowledge of the registers, returns, forms and certificates required to be maintained under the Act and the Rules framed thereunder.

Fees

5. The fees for any primary (original) vaccination or re-vaccination operation performed shall be payable according to the following scales :-

(a) At a public vaccination station, free of charge.

(b) At a private residence or at any place other than a public vaccination station if the vaccinator attends at the request of an adult person or of the parent or guardian of child-four annas for each successful primary operation and anna one only for each re-vaccination (secondary), whether successful or not, taken sometime after successful primary vaccination as a further protection :

Provided that the total amount payable for any number of operations performed in one family (including domestic servants) at the same time shall not exceed eight annas:Provided further that the fee payable under clause (b) may be reduced or remitted by a local authority with the approval of the Director of health Services.No fee shall be charged for the repetition of vaccination operations done in cases where the primary operation was unsuccessful.

Rules Under Clause (c) of Section 33

Vaccination of females in special cases.

6. The Superintendent of Vaccination may, if necessary, appoint female vaccinators for the benefit of females as are, by the custom of the country, unable to attend at public vaccination stations and may, with the approval of the local authority concerned, fix the remuneration of such vaccination.7. If the Superintendent of Vaccination considers that any female is according to the custom of the country unable to attend at the vaccine depot and is too poor to pay any part of the vaccination fee prescribed by clause (b) of Rule 5, the local authority on the recommendations of the Superintendent of Vaccination may direct the fee to be remitted in full.

Supply of vaccine lymph.

8. No vaccine lymph other than that obtained from the Bihar Vaccine Institute at Namkum (Ranchi) shall be used in any vaccine operation without the previous permission of the Director of Health Services, Bihar.

9. A public vaccinator shall (i) maintain a register of children requiring vaccination in the following form (Schedule XXXI-No. 11H)in which the names of all newly-born and other unprotected children shall be entered, village by village or mahalla by mahalla; (ii) keep the said register up-to-date by obtaining relevant extracts from the birth registers, maintained at the police-stations; and (iii) note in the remarks column of the register mentioned in clause (i) all deaths of unvaccinated children against their names.10. A public vaccinator shall maintain a register of vaccination in the following form (Schedule XXXI-No. 1H) in which vaccination operations performed and the results obtained shall be recorded village by village or mahalla by mahalla.11. The annual return to be submitted by the Superintendent of Vaccination under Section 32 of the Act shall be in the following form :-

12. A public vaccinator shall submit a monthly return of vaccination to the Sub-Inspector of vaccination, who after consolidating the returns received from the vaccinators, will submit the returns of his circle to the Superintendent of Vaccination and the Superintendent of Vaccination will forward the consolidated returns of the whole area placed under him to the Director of Health Services, Bihar, in the following Form No. 7 of Schedule XXXI.13. Every superintendent of Vaccination shall submit to the Director of Public Health, Bihar a weekly statement showing the incidence of small-pox in the following form and send a copy of the same to the Assistant Director of Public Health of the area concerned:-

14. The inspecting officers shall submit monthly diaries to the Superintendent of Vaccination in the Form (Schedule XXXI-No. 17).15. A printed receipt for each amount received as fees for performing vaccination or re-vaccination as charged under Rule 5(b) of the Bihar Vaccination Rules, 1944, shall be granted by every public vaccinator in the form (Schedule XXXI-No. 10H).16. 18. Annual indent for vaccination forms and registers, etc., shall be submitted in Form No. 151 of Schedule LIII or in any Form prescribed by the Provincial Government.19. Annual licenses to public vaccinators in areas where the licensed system of vaccination is in force shall be issued in the form (Schedule XXXI-No. 8H) which shall be signed by the Superintendent of Vaccination of the area concerned and countersigned by the Chairman of the district board concerned.A list of villages comprising the circle of the public vaccinator to whom the license has been issued shall be given in the form. The first counterfoil shall be kept in the office of the Superintendent of Vaccination and the second counterfoil shall be sent to the Assistant Director of Public Health of the area concerned.20. A certificate to show that he has been appointed to work as an apprentice to a licensed public vaccinator shall be granted to every apprentice vaccinator in the form (Schedule XXXI-No. 9H) under the signature of the Superintendent of Vaccination. 23. The inspecting staff and the public vaccinators shall produce all registers and relevant papers and render all necessary help to the Superintendent of Vaccination and the Assistant Director of Public Health at their inspections.
