An Act to validate certain actions taken under the Land Acquisition Act 1894 in its application to the the State of Bihar.
Be it enacted by the Legislature of the State of Bihar in the 26th Year of the Republic of India as follows :-
- Short title.- This Act may be called the Land Acquisition (Bihar Validation) Act, 1975.
- Validation of certain actions taken under Act I of 1894.- Notwithstanding anything contained in sub-sections (1) and (2) of Section 17 of the Land Acquisition Act, 1894 (Act I of 1894) as amended in its application to the State of Bihar by the Land Acquisition (Bihar Amendment Act, 1960 (Bihar Act XI of 1961) or any judgment or decree or order of any Court to the contrary, all notifications issued, all actions taken or all things dene in respect of the acquisition of land in the State of Bihar during the period commencing from the 25th May, 1961 and ending with the commencement of this Act shall always be deemed to have been validly issued, taken or done and shall not be called in question merely on the ground of non-compliance or irregular compliance of the provisions of the said section.
- Repeal and saving.- (1) The Land Acquisition (Bihar Validation) Fourth Ordinance, 1975 (Bihar Ordinance No. 178 of 1975) is hereby repealed.
(2) Notwithstanding such repeal anything done or any action taken in exercise of any power conferred by or under the Ordinance shall be deemed to have been done or taken in the exercise of powers conferred by or under this Act as if the Act were in force on the day on which such thing or action was done or taken.
