Rules for the Government Tibbi College, Patna

General

  1. The general management of the college shall vest in the Governing Body described in Rule 2, subject to the control of Government, and to these Rules.-
  2. (1) The Governing Body shall consist of not less than seven and not more than eleven persons appointed by Government including a President nominated by Government who shall hold office for one year ox until fresh members are appointed.

(2) The Governing Body may appoint a Secretary.

  1. (1) The duties and powers of the Governing Body shall include-

(a) General supervision over the welfare and discipline of the students;

(b) the award of such scholarships or free studentships as may be sanctioned by Government;

(c) control over the expenditure of such sums of money may as be allotted by Government or from other sources for the maintenance of the college subject to such conditions as may be imposed; the preparation of an annual budget, and the examination and passing of the accounts of the school;

(d) the initiation and consideration of projects for the extension, improvement and repair of the College buildings and property;

(e) the determination subject to the provisions of Rule 5 of the general scheme of studies, the curriculum, equipment and external examinations of the College;

(f) advising Government with regard to appointments, punishment and leave of the teaching staff;

(g) selling or disposing of worn out or obsolete tools, furniture, apparatus and other articles up to a limit of Rs. 100 for each article, the sale being public and the proceeds being deposited in the treasury;

(h) deciding appeals made by students against orders of punishment passed by the Principal, where the punishment inflicted is other than punishments nos. 1-5 provided in Rule 19;

(i) the appointment, dismissal or punishment of the clerical and other subordinate staff and the menial servants;

(j) the consideration of such matters as may be referred to it by Government;

(k) the exercise of such additional functions as may be assigned by Government.

(2) The Governing Body may authorize the President to exercise such of their powers as they may consider necessary for speedy disposal of matters relating to the administration of the College.

(3) The Governing Body may ordinarily delegate the powers required for the ordinary administration of the college to the Principal whose orders passed in the exercise of the powers so delegated to him shall be final.

(4) In order to enable Government to exercise their general powers of revision and control the Governing Body shall maintain a record of its proceedings and shall report them to Government after each meeting.

(5) All correspondence between the Governing Body and Government shall be addressed to the Secretary to Government in the Health Department by its President, or if the Governing Body so resolves by its Secretary:

Provided that if the Secretary is the Principal, correspondence shall be addressed by the President.

  1. The duty and power of selecting students for admission to the College shall be exercised by a selection committee consisting of three members of the Governing Body to be nominated by Government every year. One of these members shall be the Principal.
  2. The duty and power of fixing the courses of studies and generally of advising the Governing Body on matters relating to the curriculum, equipment, external examination and other similar administrative matters requiring expert advice shall be performed by the Advisory Committee constituted by Government in their Resolution No. 968-L.S.-G., dated the 26th January, 1927.
  3. (1) The term of office of a member of the Advisory Committee referred to in Rule 5 shall continue until his resignation or untill his removal by Government or until the committee is re-constituted by Government.

(2) The Advisory Committee shall ordinarily meet once a year before the beginning of the college session, but may for urgent reasons meet on other occasions on the requisition of the Governing Body.

(3) The Advisory Committee shall maintain a record of its proceedings and shall forward a copy of them after each meeting to the Governing Body and to Government.

(4) The Advisory Committee may correspond with Government direct. Such correspondence shall be signed either by all the members or, if the committee so resolves, by one of its members, and shall be addressed to the Secretary to Government in the Health Department.

  1. (i) The Secretary of the Governing Body shall submit indents for forms and draw contingent charges with the countersignature of the President.

(ii) The Principal shall, unless for reason to be specially recorded the Governing Body otherwise resolves, be empowered-

(a) to spend the grants which are provided in the sanctioned budget of the college for contingencies and for supplies and service on the purposes for which they have been sanctioned and subject to such conditions, if any, as may have been imposed, provided that no re-appropriation may be made from one unit to another without the sanction of the Government;

(b) to countersign bill for scholarships;

(c) to draw his own pay and that of the officers of the teaching staff and of the clerical and menial establishment; and

(d) to draw from treasury and keep for emergent expenditure a permanent advance not exceeding Rs. 20; and

(e) to draw contingent charges after the bills is countersigned by the President of the Governing Body;

Admission

  1. Not more than 40 students shall be admitted in the first year class every year.
  2. Admissions shall be made by the selection committee described in Rule 4.
  3. (1) Candidates for admission to the college shall submit their applications in writing to the Principal in form A appended to these Rules in time to reach him by the 30th June in each year.

(2) No candidate shall be admitted, unless-

(i) he is not less than 16 years of age at the beginning of the session at which he applies for admission; and

(ii) he is a native of, or domiciled in, Bihar and;

(iii) he has passed either-

(a) the Matriculation examination or its equivalent from any recognised University with Urdu as the vernacular subject; or

(b) the Maulavi examination of the Madrasa Board; and

(iv) he produces a certificate of good character from the head of the institution in which he has last studied; and

(v) he passes the test examination prescribed in Rule 12.

(3) A candidate who claims to be domiciled in Bihar under clause (ii) of sub-rule (2) of this Rule shall produce a domicile certificate granted in accordance with the rules of Government in force for the grant of such certificate.

  1. The Principal shall lay all the applications of candidates qualified under clauses (i) to (iv) of sub-rule (2) of Rule 10 without delay before the Selection Committee described in Rule 4.
  2. The Selection Committee shall hold a test examination of such candidates in the following subjects, namely :-

Arabic and Urdu

  1. The Selection Committee shall then admit such candidates as appear to them to be the most suitable.

Fees.

  1. (1) The annual fees specified in the statement below shall be payable by the persons and at the times specified

(2) If any candidate selected under Rule 13 fails to pay the admission fee in accordance with sub-rule (1) of this Rule the Principal may remove his name from the list of candidates admitted under Rule 13.

(3) If any student fails to pay the tuition fee in accordance with sub-rule (1) of this Rule the Principal may impose on him a daily fine of one anna, and if the fee plus the daily fine, if any, imposed has not been paid in full by the end of the month in which it was due, may strike his name off the rolls:

Provided that the Principal may, for reasons to be recorded order the reentry of the student's name on the rolls either on payment of an additional fee of Rs. 5 or, for special reasons to be recorded, without such additional fee, on subsequent payment of the fees due under this Rule.

(4) No fees shall be refunded after they have been credited into the College accounts.

Discipline

  1. No students shall address any external authority, such as the President of the Governing Body or any member of the said Body or of the Advisory Committee except through the Principal. An infringement of this Rule shall be treated as a breach of discipline.
  2. Students are required to be orderly and quiet at all times in the College.
  3. Every student who does not reside with his parent shall be required to reside with a guardian approved by the Principal.
  4. For the maintenance of discipline, the punishments set forth in the Rules immediately below may be inflicted.
  5. The ordinary punishments shall be (1) verbal reprimand, (2) written reprimand in the order book, (3) extra duty, (4) fine, (5) stoppage of leave, (6) deprivation of studentship, (7) rustication and (8) expulsion.
  6. Expulsion from the College shall only be inflicted for offences of a heinous nature involving disgraceful or dishonourable conduct or persistent and wilful infringement of the College Rules, or for gross insubordination and disrespect to the constituted authorities of the college. A student who cheats or attempts to cheat at an examination shall, on the first occasion on which he is found guilty of such offence, be liable to rustication for one year with or without fine, and shall, if found guilty of the same offence on the second occasion, be expelled from the college. Should it be apparent to the Governing Body, on the report of the Principal that any students have combined to stay away from college or in any other way to defy authority or to defeat discipline the names of the students shall be struck off the rolls and such students shall not be re-admitted to the college, unless they can give such an explanation of their absence as may appear sufficient to the Governing Body, or unless the Governing Body, may, for other sufficient reasons, think proper to re-admit them.
  7. On the expulsion of a student from a college, his name with as much information as may be available for his identification, shall be reported to Government in the Health Department, to enable Government to take such measures as it thinks fit to prevent him from being admitted into any other Government College.

Attendance

  1. The Principal shall, before the commencement of each session, circulate for the information of the students a programme of the lectures of each lecture.
  2. Every student is required to attend punctually at the stated hours for lectures (practical or theoretical) and shall not leave the class or duty without permission.
  3. Every student shall attend seventy-five per cent of the lectures in each subject to entitle him to a certificate of attendance, provided that no certificate of attendance shall be granted to a student unless he has satisfied the authority or authorities responsible for granting the certificate or certificates that his progress has been satisfactory and until he has paid all demands due from him.
  4. Students of the third and fourth year classes are required to be present in the dispensary for clinical duties and instruction, according to the duly assigned to each of them.

Leave and Absence

  1. Students shall not absent themselves without leave.
  2. The students shall be granted the following holidays

(i) the long summer vacation;

(ii) the Muharram holidays;

(iii) the Christmas and the New year's Day holidays; and

(iv) such other holidays as may be approved by the Governing Body:

Provided that the total number of holidays shall not exceed 165 days exclusive of the Durbar Day and the King Emperor's Birthday.

Note.-The regular vacation leave shall be notified in the College order on each occasion.

  1. The Principal may grant casual leave to students up to a maximum of ten days at a time which may be extended to fifteen days in exceptional cases.
  2. In the following cases no leave, except on medical certificate, shall be allowed-

(a) in extension of regular vacation leave;

(b) when a student is undergoing any punishment;

(c) when there is any matter pending in connection with which the student has been directed to appear before his Professor or the Principal;

(d) when the leave is for absence from any periodical examination.

No departure from this Rule shall be permitted except with the written sanction of the Principal and then only under the most urgent circumstances.

  1. A student absenting himself for more than fifteen days with out the previous sanction of the Principal shall be liable to expulsion.
  2. (1) No student, who has not attended at least seventy-five per cent of all lectures and demonstrations in all subjects including dispensary and pharmacy classes for a diploma examination, shall on any account be certified as having completed, his course of instruction or shall receive promotion or shall be permitted to appear at such examination:

Provided that in special cases it shall be within the competence of the Governing Body to condone for sufficient and satisfactory reasons shortages in the required attendance.

(2) Students will be required to work in the out-door dispensary during the vacations in batches as arranged by the Principal and any student absenting himself from that work without the permission of the Principal will not, until specially permitted by the Governing Body, be eligible to sit at the next diploma Examination.

  1. All medical certificates in support of absence from classes or dispensary duty shall be signed either by a medical officer in Government employ or by a competent Hakim to the satisfaction of the Principal. They shall be forwarded to the Principal within three days of the date on which the student states that he was ill.

Courses of Study, Session and Curricula

  1. The course of study shall extend over a period of four years.
  2. The session shall commence in the month of July and terminate in the month of June every year.
  3. The curricula and syllabus of the College are given in the Appendix.

Examinations

  1. (a) Examinations shall be of two kinds, namely, Internal and External.

(b) Internal examinations shall be conducted by the College staff and shall consist of-

(i) Half-yearly Examinations in December;

(ii) Annual Examinations at the end of the 1st and 3rd year classes.

(c) External examinations shall be conducted by such outside examiners, members of College staff and members of the Advisory Committee as may be selected by the Advisory Committee appointed for this purpose and shall consist of-

(i) Preliminary examination at the end of 2nd year class;

(ii) Final diploma examination at the end of 4th year class.

(d) Fees for the External examinations shall be Rs. 3 for the preliminary and Rs. 5 for the final diploma examinations.

(e) The full marks assigned in each subject shall be 200 (100 for written and 100 for practical examinations and for each part of the examination) as amended in Government Order No. 9080-L.S.-G., dated 7th August, 1950. The standard for passing shall be 33 per cent.

  1. No promotion shall be given to a higher class unless a student secures at least the pass mark as described in clause (e) of Rule 36:

Provided that-

(i) In the event a student failing to appear at any annual examination owing to his illness or for other reasons considered satisfactory by the Principal promotion may be given on the results of his half-yearly examination.

(ii) Students failing in one subject only in the annual examinations or in the preliminary examinations may be promoted to the next higher class subject to the condition that he will be reverted to the class from which he has been promoted if he fails to pass in that subject at a supplementary examination to be held within three months of his promotion.

  1. A student who fails to pass the annual preliminary or the final Diploma examination in more than one subject may be permitted to continue his studies in the same class during the next session.
  2. For students who fail in one subject in the final diploma examination there will be a supplementary examination in October.
  3. (1) A certificate shall be granted to the students passing the preliminary examination in Form B appended to these Rules.

(2) A certificate shall be granted to students passing the final examination in Form C appended to these rules.

Studentships

  1. Free studentship may be allotted by the Governing Body to deserving students up to a maximum of 5 per cent of the number of students on the roll.
  2. Studentships shall be liable to forfeiture on the recommendation of the Principal for misconduct, unsatisfactory progress or irregular attendance.
