In exercise of the powers conferred by Section 353 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State Government hereby makes the following rules to regulate the remuneration and allowances payable to Presidents, Vice-Presidents and Councillors of the Municipal Councils and Nagar Panchayats in Chhattisgarh, namely :-

  1. Short title.- These rules may be called the Chhattisgarh Municipalities (Remuneration and Allowances to Councillors) Rules, 1995.
  2. Definitions.- In these rules, unless the context otherwise requires :-

(i) "Council" means Municipal Council or Nagar Panchayat, as the case may be;

(ii) "Councillor" means Municipal Councillor as shown in Section 19 of the Chhattisgarh Municipalities Act, 1961;

(iii) "President" means President of Municipal Council or Nagar Panchayat as the case may be;

(iv) "Vice-President" means the Vice-President of the Municipal Council oi Nagar Panchayat, as the case may be;

(v) The words and expressions used in these rules but not defined, shall have the same meaning as have been assigned to them in the Chhattisgarh Municipalities Act, 1961.

  1. Remuneration and daily allowance for meetings.- The remuneration and daily allowance for meetings payable to the President, Vice-President and Councillor of every Municipality and Nagar Panchayat shall be at the following rales :-

(1) In case of Municipal Councils :-

[(a) President - Rs. 1000.00 remuneration and Rs. 400.00 as entertainment allowance per month.

(b) Vice-President - Rs. 750.00 remuneration and Rs. 150.00 as entertainment allowance.

(c) Councilors - Rs. 500.00 remuneration per month. Above this the prior sanction of the State Government shall be necessary.]

(d) For participating in the meetings of the Council and its Committees, the President, Vice-President, Councillors and the members nominated by the President in the Wards Committee for participating in the meeting of the concerned Wards Committee, a daily allowance at the rate Rs. 130/- per meeting not exceeding Rupees two hundred fifty per month, shall be entitled to receive :

Provided that for participating in more than one meeting in a day, shall not be eligible to gel more than one allowance.

(2) In case of Nagar Panchayat :-

[(a) President - Rs. 1750.00 remuneration and Rs. 250.00 as entertainment allowance per month.

(b) Vice-President - Rs. 500.00 remuneration and Rs. 100.00 as entertainment allowance.

(c) Councillors - Rs. 400.00 remuneration per month. Above this the prior sanction of the State Government shall be necessary.]

(d) For participating in the meetings of the Council and its Committees, the President, Vice-President, Councillors and the members nominated by the President in the Wards Committee for participating in the meeting of the concerned Wards Committee, a daily allowance at the rate Rs. 80/- per meeting not exceeding Rupees two hundred forty per month, shall be entitled to receive :

Provided that for participating in more than one meeting in a day, shall not be eligible to get more than one allowance.

  1. Travelling and Daily Allowance for journey outside the Council area.- For the journey performed outside the Council area with the permission of the Council, eligibility of mode of journey and daily allowance shall be as under. All other points relating to journey shall be regulated by the Chhattisgarh Travelling Allowance rales enforced to the Government Servants :-
(1) Eligibility of mode of journey First class, second class air conditioned, sleeper coach or chair car of Railway and highest class of bus.
(2) Daily allowance (i) For the Rajbhogi cities of the State (Bhopal, Indore, Raipur, Gwalior, Jabalpur) and the cities outside the State Rs. 45/-
(ii) For other cities Rs. 30/- :

Provided that prior permission of the State Government shall be necessary for the journey outside State.

  1. If any doubt or difficulty arises in the interpretation of these rules, the same shall be referred to the State Government and decision of the State Government thereon shall be final.
  2. Repeal.- The Chhattisgarh Municipalities (Remuneration and Allowances to Councillors) Rules, 1979 are hereby repealed.
