Rules for the Management of Veterinary Dispensary by the Municipal Council

Where a veterinary dispensary is under the management of a Council, the Council shall have full control over all financial and administrative matters concerning such dispensary :

Provided that-

(I) the supervision and control of professional or technical work shall vest in the Director of Veterinary Services, except in the case of a dispensary handed over to a private practitioner under Rule 13; and

(II) the Council shall not levy any fee for the treatment and operation of animals at such dispensary without the previous sanction of the State Government.

The Deputy Director of Veterinary Services, the Assistant Director of Veterinary Services or the District Livestock Officer may inspect the dispensary and the Veterinary Assistant Surgeon and other technical staff employed there in shall be bound to carry' out his instructions in any professional or technical matters. The Deputy Director of Veterinary Services, the Assistant Director of Veterinary Services or the District Livestock Officer may also scrutinize the expenditure and accounts of the dispensary and call the attention of the Council to any irregularity or other circumstances deserving notice. They will forward a report of their inspection to the Director of Veterinary Services and send copies thereof to the Council and the Collector.
The Council shall be bound to consider any communication from the Director of Veterinary Services and to afford him full information as to the conduct of the staff and other matters affecting the welfare of sick animals and management of the dispensary.
In all professional matters the decision of the Deputy Director of Veterinary' Services shall be final subject to the control of the Director of Veterinary Services and the State Government.
No Council shall open or close a veterinary' dispensary without the approval of the State Government. In the case of a dispensary which is already working, the Director of Veterinary Services may with the approval of the State Government withdraw the departmental staff employed for the management of the dispensary it he considers that the management of the dispensary has deteriorated and is not commensurate with the outlay incurred from public funds for such management.
(1) The Council shall in the last week of April in each year submit to the Director of Veterinary' Services through the Collector of the district a report on the working of all veterinary dispensaries under its management during the twelve months ending on the preceding 31st of March and the Director of Veterinary Services will incorporate in the report to be submitted by him to the State Government on the 1st of July every year in respect of all the State and local fund veterinary dispensaries.

(2) The Council shall submit to the Director of Veterinary Services the following reports and returns :-

(a) Monthly returns from the veterinary dispensary showing:-

(i) the details and class of animals treated at the dispensary;

(ii) the number of animals treated by Veterinary Assistant Surgeon on lour;

(iii) a statement showing the number the quantity of sera received and used;

(iv) a statement showing number of cattle, sheep, goats, etc., inspected and slaughtered in slaughter-houses.

(b) Reports of outbreaks of cattle diseases submitted by Veterinary Assistant Surgeon.

(d) District Livestock Officer's and Assistant Director of Veterinary Services report in the inspection of veterinary dispensaries in their division.

(e) Inoculation statement showing the result of inoculation and vaccination.

(f) Indents for medicines, etc.

(g) Indents for forms.

(h) Reports on cattle fairs and shows.

(3) The Council shall also from time to time submit such other reports, returns and information as the Director of Veterinary Services may prescribe by general or special order.

The Council may appoint the menial staff of the dispensary. The question of their appointment, leave, transfer, punishment and promotion shall rest with the Council subject to such rules, if any, as may be framed by the State Government under the Madhya Pradesh Municipalities Act, 1961. If any Government Veterinary Officer or other technical staff are appointed by it, they will be treated as on deputation under the Fundamental Rules and will continue to enjoy the same privileges as regards their remuneration, leave, pension, etc. which they are entitled to in Government service. Their confidential reports will go through the President of the Council but they will be under the disciplinary control of the Director of Veterinary Services and may be transferred or removed by him. They may also be transferred by the Council within its jurisdiction with the concurrence of the Deputy Director of Veterinary Services, but the Council shall report till such transfers to the Director of Veterinary Services.
If the dispensary derives its support partly from contribution or donation made on special conditions or earmarked for special purposes, the Council will be bound to give due consideration to those conditions or purposes.
The veterinary dispensary building shall be constructed in accordance with the standard plan, either departmentally or by Public Works Department and their cost borne by the Council. The Council shall be responsible that the dispensary buildings either constructed according to the standard plan or rented buildings are kept in a reasonable State of repairs.
Collectors and Sub-Divisional Officer, Tahsildars and any member of the Council by which the dispensary is maintained, may inspect the dispensary and record their remarks in the visitors' book.
In the event of any difference of opinion between the departmental inspecting officers and the municipal authorities on any point regarding the working of the Veterinary Assistant Surgeon and other technical staff of dispensary the matter should be referred to the Director of Veterinary Services.
All orders for foreign medicines, instruments, etc., required for use at dispensaries managed by a Council shall be placed with firms approved by the Director of Veterinary Services. Indent for such supplies shall be submitted to the Deputy Director of Veterinary Services for check and counter-signature. Before countersigning an indent the Deputy Director of Veterinary Services shall satisfy himself that the Council will purchase the drugs and other requisites only from the approved firms.
The Council may associate private practitioners with the dispensary on conditions to be approved by the Director of Veterinary Services or the State Government and also hand it over to such practitioners on terms to be settled by the Director of Veterinary Services or the State Government, provided that they possess suitable qualifications in veterinary medicine and are capable of dealing with post-mortem work. These terms w ill ordinarily be as follows :-

(a) The transference will be in the first instance for a period not exceeding five years which, however, may be terminated at tiny lime by six months' notice being given by either party.

(b) The practitioner will be allowed the use of the building, furniture and medicines in stock and will be liable for their upkeep, including all ordinary repairs to buildings. He will be charged such rent as may be settled by the Council.

(c) He will be required to maintain at his own cost such staff as may be necessary for working the dispensary, e.g., compounders, water-men cooks, etc.

(d) He will be entitled to charge such fees as he thinks fit for the treatment of animals at the dispensary.

(e) He will be liable, if so required, to treat Government and municipal animals free of charge and to carry out post-mortem work, and for his duty, if performed to the satisfaction of the district authorities, he will be given an allowance by Government.

(f) He will be required to inspect the slaughter-houses, if any within the municipal limits.

(g) He will be required to maintain and keep up to date the registers of stock, equipment and animals treated that may be prescribed by the Council and submit such reports and returns as may be prescribed by the Director of Veterinary Services.

The Veterinary Officer in charge of the transferred dispensary shall be guided in technical and professional matters by the orders of the Director of Veterinary Services.
