In exercise of the powers conferred by sub-section (1) of Section 24 read with sub-section (6) of Section 14 of the Madhya Pradesh Vidyut Pradaya Upakram (Arjan) Adhiniyam, 1974 (38 of 1974), the State Government hereby makes the following rules, namely :-
- Short title.- These rules may be called the Madhya Pradesh Vidyut Pradaya Upakram (Arjan) Appellate Authority Rules, 1988.
- Authority to decide the appeal.- Any person aggrieved by the claim officer may prefer an appeal to the Board of Revenue.
- Period and manner of appeal.- (1) If the order of the claims officer is passed before the commencement of these rules the appeal may be preferred within a period of three months from the date of commencement of these rules and if the order is passed after the date of commencement of these rules such appeal may be filed within a period of three months from the date of order. However, the appellate authority may, in its discretion, extend if it is satisfied that the delay is caused due to the reasons beyond the control of the appellant.
(2) The appeal shall be submitted in three copies and shall be accompanied with a certified copy of the order appealed against.
