Uttaranchal State Haj Committee Rules, 2002

In exercise of the powers under Section 18 of the Haj Committee Act, 1959, the Governor of Uttaranchal State formulate the rules for the Constitution of State Haj Committee as under :

  1. Short title and commencement.- (1) These Rules will be called "Uttaranchal State Haj Committee Rules, 2002".

(2) These rules will come into force from the date of its publication in the Official Gazette of Uttaranchal State.

  1. Constitution.- (1) The State Government will constitute a State Haj Committee (hereinafter called the "Committee") which include the members nominated by State Government and nominated from Muslim Members of the State Legislative Assembly, local Administrative Bodies, Social Workers and other prominent persons who have special knowledge of pilgrimage to Saudi Arabia (Mecca, Madina) Iran and Iraq. Such members be acquainted with all the matters regarding Haj. The members of the Central Haj Committee, if any and who have been nominated from this State will be included in the Committee as ex officiomembers. In accordance with the discretion of the State Government not exceeding two persons other than Muslims may also be nominated in the Committee. The Committee will be headed by Minister of Social Welfare Government of Uttaranchal. The Secretary Social Welfare will hold the charge of the Secretary, State Haj Committee.

(2) The Membership to the State Haj Committee will be Honorary.-All the members of the Committee will be Honorary and they will discharge their functions without having any stipend or honorarium from the Committee. When the member of the Committee is called upon the participate in any meeting of the Committee, he will be entitled to Travelling Allowance from the State Government as per prevailing rules. Non-Government member may draw Travelling Allowance etc. form the funds of the Committee on the prior approved rate as prescribed from time to time by the State Government.

  1. Tenure.- (1) Under sub-rule (2) the tenure of the Committee will be three years which may be extended from time to time by the State Government but in any case it can exceed six month in all.

(2) Notwithstanding anything contained in sub-rule (1) above, if the State Government in of the opinion that object or aim of these rules cannot be fulfilled properly it may dissolve the Committee and constitute another fresh Committee in its place.

  1. Functions.- The State Haj Committee will function as a consultative Committee between the Central Haj Committee Hajis Friends and the Haj Committee formed at district level-

(i) to collect such information as may be useful for the intending pilgrims;

(ii) to Appoint Haji's Friends and sub-committee in the Districts;

(iii) to advice the intending pilgrims in all the matters, so as to help them in facilitating inoculation, Health cheak up and to identify the communicable disease like AIDS or other like disease, to collect money and to coordinate with the local authorities in all relevant and related matters;

(iv) with a view to facilitate the pilgrims with all necessary arrangements and to have liasons with the Railway authorities and to seek their cooperation in this regard;

(v) to forward the complaints received from the pilgrims and to resolve them after keeping liasons with the concerned department;

(vi) to do all the works required necessary and deemed helpful in the trouble free pilgrimage of the Haj Pilgrims;

(vii) to organize the training and seminars for the pilgrim as and when advised by the Central Haj Committee.

  1. Meetings.- (1) The Committee will have its meeting from time to time as when fixed by the Chairman and such meetings shall be held at least twice in a year and one such meeting shall be held prior to commencement of Haj Yatra or Haj Season and other such meeting shall be held after the conclusion of the Haj Yatra and Haj Season. The date of such meeting shall be fixed by the Secretary in consultation with the Chairman. The agenda, place and date of the such meeting shall be determined by the Secretary and notify this at least fifteen day prior the such date.

(2) The quorum of the Committee shall be two-third of its total members. If in any such meeting the quorum is not complete but in the opinion of the members present the work scheduled in the agenda is of important nature then such meeting shall not be cancelled or adjourned.

(3) The head office of the Committee will be at Roorkee.

  1. Funds.- (1) A fund will be raised under the name and style "State Government Haj Fund" and it will include the following ;

(a) amount received from Haj Committee (India);

(b) funds allotted by the State Government; and

(c) any funds received through the non-Government sources such as donation or subscriptions.

Note.-The Committee can also collect donations/subscriptions through non-Government sources to meet out its expenses.

(2) The above funds will be deposited in the approved bank in the name of the Secretary who will also be its drawing officer, but he will not be empowered to spend more than Rs. 500/- without the approval of the Committee. But the Chairman with the approval of the Committee, which may be sought in the next meeting, may approve the expenditure of amount upto Rs. 2,000 in urgent matters.

  1. Change in rules.- Any proposal for amendment in these Rules may be sent to the Government of India for further direction, but such minor changes as do not adversely affect the aim and object of these rules, can be carried out by the State Government without such directions.
  2. Annual report.- The annual report shall be submitted immediately after six months of the end of Haj season and the same should be given to the Government of India in consultation with the State Haj Committee.
