Uttaranchal Amendments of the Allahabad High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976

- In exercise of the powers conferred by Clause (2) of Article 229 of the Constitution of India and all other powers enabling in that behalf, the Hon'ble Chief Justice, has been pleased to make the following Amendments in Allahabad High Court and Staff (Conditions of Service and Conduct) Rules, 1976, applicable to Uttaranchal under Section 30 of the U.P. Reorganisation Act, 2000 :
Amendments
Substitute the following for the existing Clauses (a) to (c) of Rule 8 :
"(a) | Telephone Operators | (i) | By direct recruitment through competitive examination conducted by the appointing authority or in any manner so directed by the Chief Justice. |
(ii) | By selection from amongst the persons who apply for such appointments. | ||
(b) | Lower Division Assistants | (i) | By direct recruitment through competitive examination conducted by the appointing authority or in any manner so directed by the Chief Justice. |
(ii) | By promotion from class IV employees. | ||
(iii) | By selection from amongst the persons who apply for such appointment or as may be deemed fit and expedient by the Chief Justice. | ||
(iv) | By promotion from amongst the telephone operators who have completed 3 years to the maximum extent of 20% at the discretion of the Chief Justice: | ||
Provided : | |||
(a) | That nothing in this rule shall be construed as affecting the promotion of Routine Grade Assistants and typists appointed before the coming into force of this rule. | ||
(b) | That all available vacancies may, in the discretion of the Chief Justice, be filled from any of the above sources. | ||
(c) | Upper Division from Assistants | (i) | By promotion from amongst Lower Division Assistants having three years experience as L.D.A. on the basis of seniority-cum-suitability. |
(ii) | By direct recruitment through competitive examination. Notwithstanding anything contained in Clauses (i) and (ii) above, any U.D.A. may also be appointed by the Chief Justice as he deems fit and expedient." |
The following Rules be deleted :
"Rule 9 (i) | : | Deleted |

Substitute Rule 9 (ii) as under:
"Rule 9 | (ii) Lower Division Assistants | Must possess a Bachelor's degree of a University established by law in India or qualification recognized as equivalent thereto.
Preference will be given to those having sufficient knowledge of typing in English and Hindi as well as of operation of Computers." |
Substitute the existing Clauses (a) to (e) of Rule 16 as under:
"(a) | Section Officer, General Office | By promotion from amongst Upper Division Assistants. |
(b) | Bench Secretaries, Grade I | By promotion from Bench Secretaries Grade II. |
(c) | Stamp Reporter | By transfer of one of the Section Officers of General Office or Bench Secretary, Grade I. |
(d) | Private Secretaries | By promotion from amongst Personal Assistants. |
(e) | Asstt. P.P.S. to C.J. | Deleted. |
Explanation. - Persons selected for the post of Private Secretary and Private Secretary to Senior Judge will maintain his seniority on the post of Private Secretary and shall be liable to be transferred back to the post of Private Secretary."
Substitute the following Clauses (a) to (e) of Rule 20 :
The source of recruitment to the various class I posts in the establishment shall be as follows :
"(a) | Principal Private Secretary to Hon'ble the Chief Justice | By promotion of Private Secretary having three years experience as such. | |
(b) | Deputy Registrar | (i) | By promotion from amongst Section Officers of General Office who have three years experience as Section Officer and Bench Secretaries as Section Officer and Bench Secretaries, Grade I and Private Secretaries: |
Provided : | |||
(1) | That the appointment shall be so regulated that out of the existing posts of Deputy Registrars 50% of the posts shall be filled from amongst the Section Officers, 25% form amongst Bench Secretaries, Grade I and 25% from amongst the Private Secretaries. In case of a fraction of a post, the matter as to whom it should go shall vest in the discretion the Chief Justice. | ||
(2) | Notwithstanding anything contained in proviso (1) above, any Deputy Registrar may also be appointed by the Chief Justice as he deems fit and expedient." | ||
(c) | Joint Registrar | By deputation of an officer of Higher Judicial Service or by promotion from amongst the Deputy Registrars and P.P.S.
Notwithstanding anything contained hereinabove, any Joint Registrar may also be appointed by the Chief Justice as he deems fit and expedient. Notwithstanding anything contained hereinbefore, the incumbent to the post of Joint Registrar must be a Law Graduate of a recognized University. |

(d) | Additional Registrar | By deputation of an officer of Higher Judicial Service. | |
(e) | Registrar | By deputation of an officer from amongst the members of Higher Judicial Service." |
The following will be substituted in Clauses I and II of Rule 22 :
"22. Method of selection for the post of Principal Private Secretary to Chief Justice and Deputy Registrar.-
- Whenever it is required to make selection or promotion to the post of Principal Private Secretary to the Chief Justice, Principal Private Secretary/Head Private Secretary, Private Secretary in the same pay scale as Principal Private Secretary and Joint Principal Private Secretary, the Registrar shall prepare a list of candidates eligible for promotion under these Rules. The list shall be drawn according to the inter seseniority of the candidates on the post from which the promotion is made.
- Whenever it is required to make selection or promotion to the post of Deputy Registrar, the Registrar shall prepare three separate lists one each of-
(a) | Section Officers | 50% |
(b) | Principal Private Secretary to C.J., Head Private Secretary, Private Secretary in the same pay scale as Principal Private Secretary and Private Secretaries. | 25% |
(c) | Bench Secretaries, Grade I. | 25% |
who are eligible for promotion under these Rules. |
The following will be substituted in the existing Rule 25 of the High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976 :
"25. Age. - A candidate for direct recruitment must have attained the age of 18 years in case of class IV and Lower Division Assistant posts and 21 years in case of other posts, and has not crossed the age of 35 years on the 1st day of July of the year when the recruitment is undertaken.
The maximum age limit as indicated above shall, in the case of candidates of the Scheduled Caste, Scheduled Tribes, dependents of Freedom Fighters and Backward classes, be relaxed by five years :
Provided that the Uttaranchal State Government Servants shall be eligible for direct recruitment to the post of Personal Assistant upto the age of 45 years :
Provided further that in case of members of the High Court staff, a relaxation by five years may, in suitable cases, be made by five years may, in suitable cases, be made by the Chief Justice
Provided also that no candidate shall, by virtue of relaxation age under this rule, have more than three opportunities to appear at the competitive examination or selection."
Note : These amendments will come into force with immediate effect.

In exercise of the powers conferred by clause (2) of Article 229 of the Constitution of India and all other powers enabling in that behalf, the Hon'ble Chief Justice, has been pleased to make the following amendments in Allahabad High Court Officers and Staff (Conditions of Services and Conduct) Rules, 1976, applicable to Uttaranchal under Section 30 of the U.P. Reorganization Act, 2000 :
Amendments
The word "and" be added after the word "thereto" in sub-clause (vi), paragraph (i) of Rule 9 in Chapter IV. Clause (I-a) be added after paragraph (i) of sub-clause (vi) of Rule 9 in Chapter IV as under :
"(i-a) The candidate must possess the DOEACC 'A' level or equivalent post-graduate diploma from UGC approved University/Government Polytechnic."
Para 1 of sub-clause (vii) of Rule 9 in Chapter IX the word "and" be added after the word "thereto".
After paragraph (i) of sub-clause (vii) of Rule 9 in Chapter IV a new paragraph (1-a) be added as follows :
"(1-a). The candidate must possess DOEACC B' level or MCA/B.E. (CS/IT)/B.Tech (CS/IT) from UGC approved University/AICTE.".
This notification shall come into force with immediate effect.

In exercise of the powers conferred by clause (2) of Article 229 of the Constitution of India and all other powers enabling in that behalf, the court has been pleased to make the following amendments in Allahabad High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976, applicable to Uttaranchal under Section 30 of the U.P. Reorganisation Act, 2000.
Amendments
The following amendment be substituted in the rules of the High Court Officers and Staff (Conditions of Service and Conduct) Rules, 1976, applicable to Uttaranchal.
The following Rule be added in Chapter IV, Rule 8 after sub-clause (c):
(cc) | Console Operator-cum-Data Entry Assistant | ... | (i) | By direct recruitment through competitive examination conducted by the appointing authority or in any manner so directed by the Chief Justice. |
(ccc) | System Analyst-cum-Programmer | ... | (i) | By direct recruitment through competitive examination conducted by the appointing authority or in any manner so directed by the Chief Justice. |
Rule 9, Clause (b) in Chapter IV is deleted and substituted as under :
(b) | Personal Assistant | ... | Must possess good knowledge of English Shorthand and Typewriting with minimum speed of 40 words per minute in English and 100 words in English Shorthand dictation per minute. Preference will be given to those having good knowledge of Hindi Shorthand and Typewriting with minimum speed of 30 words in Hindi Typewriting per minute and 80 words in Hindi Shorthand dictation per minute and knowledge of Computer operation. |
Sub-clauses VI and VII of Rule 9 in Chapter IV be substituted after sub-clause (v):
"(vi) | Console Operator-cum-Data Entry Assistant | ... | (i) | Must possess a Bachelor's Degree of a University established by law in India or a qualification recognised as equivalent thereto. |
... | (ii) | Must possess a speed of not less than 8000 key Depressions per hour for Data Entry work. | ||
Note 1 : | Qualifications are relaxable at the discretion of the Chief Justice. | |||
Note 2 : | The speed of 8000 key Depressions per hour for Data Entry work is to be judged by conducting a speed test on the EDP Machine(s) by the competent authority. | |||
(vii) | System Analyst-cum-Programmer | ... | 1. | Must possess a Bachelor's Degree in Engg. or M.Sc. Maths or Statistics of a University established by law in India or a qualification recognised as equivalent thereto. |

Rule 20 (b) (i) is deleted and substituted as under:
