In exercise of the powers conferred by Section 19 read with sub-sections (3) and (4) of Section 6 and Section 7 of the M.P. Tendu Patta (Vyapar Viniyaman) Adhiniyam, 1964 (No. 29 of 1964), the State Government hereby makes the following rules, the same having been previously published as required by sub-section (1) of Section 19 of the said Act, namely:-
- (1) These rules may be called the Madhya Pradesh Tendu Patta Mantrana Samiti Tatha Mulya Prakashan Niyam, 1964.
(2) They shall come into force at once.
- In these rules, unless the context otherwise requires,-
(a) "Act" means the Madhya Pradesh Tendu Patta (Vyapar Viniyaman) Adhiniyam, 1964;
(b) "Chairman" means a member of the Committee appointed as such by the notification constituting the Committee under Section 6;
(c) "Convener" means a member of the Committee appointed as such by the notification constituting the Committee under Section 6.
- The Advisory Committee constituted under Section 6 shall hold its meeting at the headquarters of the Revenue Commissioner of the Division for which it is constituted.
- Every meeting of the Committee shall be presided over by the Chairman and in Iris absence by the Convener.
- The Convener of the Committee shall notify the date, time and place of meeting, not less than seven days in advance to each member of the Committee by registered post acknowledgment due.
- Four members of the Committee shall constitute the quorum.
- The proceedings of the meeting shall be prepared in Hindi written in Devanagari script so as to clearly bring out the Committee's recommendations regarding the fair and reasonable price at which tendu leaves may be purchased from growers other than the State Government and also its advice on such other matters as may be referred to it by the Government.
- The proceedings shall be approved by the person presiding at the meeting and his approval shall be taken as final proof of the authenticity of the Committee's recommendations.
- The Committee's advice shall be conveyed to State Government through the proceedings of the meeting, which shall be sent so as to reach the Secretary to the Government, Forest Department, by the 15th of December, or such earlier date as the Government may fix for a particular year. The State Government may, however, in a special case allow a Committee further time in accordance with the proviso to Section 7. The request for further time on behalf of a Committee should be made well in advance by the Convener on behalf of and with the approval of the Committee.
- Prices fixed under Section 7 shall he published in both Hindi and English in the Official Gazetteand also in such news papers having circular in the revenue division concerned as the State Government may deem appropriate.
- (1) The non-official members of the Committee other than those who are members of the Madhya Pradesh Legislative Assembly shall be entitled to draw travelling and daily allowances as for a first grade officer of the State Government.
(2) The travelling allowances bills shall be presented to the Convener who will countersign them after scrutiny and disburse the allowances.
