The M.P. State Administrative Tribunal (Financial and Administrative Powers) Rules, 1986

[Notification No. F. C-9-11-86-3-I, dated 6-9-1986]. - In exercise of the powers conferred by Section 36 read with Section 12 of the Administrative Tribunals Act, 1985 (No. 13 of 1985), the State Government hereby makes the following rules, namely-
- Short title and commencement.- (1) These rules may be called The Madhya Pradesh State Administrative Tribunal (Financial and Administrative Powers) Rules, 1986.
(2) They shall come into force from the date of establishment of the Madhya Pradesh State Administrative Tribunal, under sub-section (2) of Section 4 of the Act.
- Definitions.- In these rules, unless the context otherwise requires,-
(a) "Act" means the Administrative Tribunals Act, 1985 (No. 13 of 1985);
(b) "Chairman" means the Chairman of the Tribunal;
(c) "State Government" means the Government of Madhya Pradesh;
(d) "Tribunal" means the Madhya Pradesh State Administrative Tribunal.
- Sittings of a Bench at a place other than the place where it ordinarily sits.- If at any time Chairman of the Tribunal is satisfied that circumstances exist which render it necessary to have sittings of a bench of the Tribunal at any place falling within its territorial jurisdiction, other than the place at which it ordinarily sits, he may direct it to hold sittings of the bench at such place.
- Powers of Chairman.- The Chairman shall have the same financial and administrative powers as are conferred on a Head of Department of the State Government as contained in the Book of Financial Powers, 1983, Volume I, Fundamental Rules and Supplementary Rules made thereunder, the Madhya Pradesh Civil Services (Leave) Rules, 1977, the Madhya Pradesh Civil Services (Pension) Rules, 1976, the Madhya Pradesh Civil Services (Conduct) Rules, 1965, the Madhya Pradesh Civil Services (Classification Control and Appeal) Rules, 1966 and Madhya Pradesh General Provident Fund Rules :
Provided that the exercise of these powers shall be subject to such instructions as are issued from time to time by the State Government.
