Rules Regarding Delegation of Powers by Council1

  1. Definitions.- In these rules, "Section"means a section of the Madhya Pradesh Municipalities Act, 1961.
  2. Delegation of powers, duties and executive functions.- Without prejudice to any powers that may have been conferred on the Chief Municipal Officer by or under Section 92, every Council may, with the previous sanction of the State Government in the case of Class I Municipalities and of the Commissioner in the case of other Municipalities, by resolution, delegate-

(a) to the President, the power to be exercised by the Council under Section 68; and

(b) to the Chief Municipal Officer, all or any of the powers, or duties or executive functions which may be exercised, or performed by or on behalf of the Council under Sections 17, 165, 197, 228, 243 and 295 (3);

in respect of all or particular classes of cases arising under these sections and for the whole or any part of the municipality, and may, by resolution withdraw the powers so delegated.

  1. Rules to be general.- These rules shall be general for all Municipalities.
