  1. Short title.- These rules may be called the Madhya Pradesh Municipalities (Application of Municipal Property and Fund) Rules, 1965.
  2. Definition.- In these rules, "the Act" means the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961).
  3. Expenditure for matters specified in clauses (a), (b) and (c) of sub-section (2) of Section 106 of the Act.- Expenditure by the Council of the Municipal Fund for the matters specified in clauses (a), (b) and (c) of sub-section (2) of Section 106 of the Act shall, save as otherwise provided by or under the Act, be made by a resolution of the Council, supported by two-thirds of the total number of Councillors :

Provided that-

(a) in the case of supply of water and electrical energy, drainage works and setting up of dairies or farms for the supply, distribution and procuring of milk or milk products, the previous sanction of the State Government; and

(b) in the case of other matters of the previous sanction of the Commissioner, shall be obtained :

Provided further that in the case of creating scholarships tenable outside the limits of the Municipality, the Council shall not incur expenditure except on such terms and conditions as may be specified in the bye-laws made by the Council in that behalf under Section 358 of the Act :

Provided also that no such expenditure shall be incurred by the Council unless the expenditure of the same is covered by a current budget grant.

  1. Utilisation of the Municipal fire-brigade.- Under clause (d) of sub-section (2) of Section 106 of the Act, the Municipal fire-brigade may be utilised outside the limits of the Municipal Council by the orders of the Collector, or any other Officer authorised by him in this behalf, or of the President of the Council, on the condition, that the following fees and charges shall be payable by the person or the authority for whose benefit the fire brigade is used, namely :-

(a) fees and hire charges as specified in Schedule I;

(b) depreciation charges, as specified in Schedule II;

(c) wages of the staff, including supervising staff, and also including the element of contributions towards pension, provident fund, leave, salary' etc. according to Schedule III;

(d) such compensation for loss or damage which may occur to the fire brigade or staff while so employed, as may be decided by the Collector of the district.

  1. Rules to be general.- These rules shall be general for all Municipalities.

Fee and Hire Charges

  1. Hire charges shall be-

(a) where the Registered Laden Weight of the Eire Fighting vehicle including tender or Trailer, if integrally attached thereto for the purpose of carrying water or fire lighting chemicals or equipments, do not exceed 4000 kgs............. Rs. 10/- per day.

(b) Where the Registered Laden Weight calculated as above exceeds 4000 Kgs. but does not exceed 10,000 Kgs............ Rs. 20/- a day.

(c) Where the Registered Laden Weight calculated as above exceed 10,000 Kgs.......... Rs. 30/- a day :

Provided that in case of Fire Fighting vehicles which use chemical loam or any other material other than water or sand for suppressing or overcoming fire, the hire charges shall be double of the rates prescribed above.

  1. To the above hire charges shall be added operating costs calculated as below :-

[(a) Actual propulsion charges for the journey from the usual place or garrage of the fire fighting vehicle to the place of operation and for return to the usual place or garrage.]

(b) Operation charges for lire fighting only for the period the vehicle is actively engaged in fire fighting.

(i) for vehicles specified in clause 1 (a) above .......... Rs. 5/- per hour;

(ii) for vehicles specified in clause 1 (b) above .............. Rs. 10/- per hour;

(iii) for vehicles specified in clause 1 (c) above ......... Rs. 15/- per hour;

(c) Cost of Chemicals used. - Actual cost of chemicals, foam materials, etc.. as may have been actually utilised during the Fire Fighting Operations subject to production of accounts by the Municipal Council.

Depreciation Charges

The life of all machinery, equipments, etc., shall be presumed to be as given in the Annexure appended and the depreciation per day shall be arrived at by dividing the actual cost of equipments by the estimated life thereof in years multiplied by 300. For every period of 24 hours or part thereof, counted from the time the Fire Fighting Vehicles, etc. are taken out of garrage for the purposes of fire lighting duty till such time by which they may report to the garrage as early as possible after attending such duty. One day's depreciation charges shall be payable for all machinery, equipment, vehicles sent on such duly.

Wages of the entire staff, but excluding the persons engaged as Drivers or Cleaners on the motor vehicles, for each 24 hours or part thereof for which they have been employed on such duty plus an additional 33 per cent thereof/or leave salary, pension, provident fund contributions, etc.
