An Act to lay down syllabi and to prescribe text books according to such syllabi for language subjects for examinations conducted by the Board of Secondary Education.

Be it enacted by the Madhya Pradesh Legislature in the Twenty-fifth year of the Republic of India as follows :

  1. Short title, extent and commencement.- (1) This Act may be called the Madhya Pradesh Madhyamik Shiksha Mandal (Pathya Vivaranon Tatha Pathya Pustakon Ka Vihit Kiya Jana) Adhiniyam, 1974.

(2) It extends to the whole of Madhya Pradesh.

(3) It shall be deemed to have come into force on the 20th April, 1959.

  1. Definitions.- In this Act, unless the context otherwise requires :-

(a) "Act of 1973" means the Madhya Pradesh Middle School Tatha Madhyamik Shiksha (Pathya Pustakon Sambandhi Vyavastha) Adhiniyam, 1973 (No. 13 of 1973);

(b) "language subject" means English, Hindi, Marathi, Urdu, Gujarati, Telugu, Tamil, Sindhi, Punjabi, Sanskrit, Bengali, Kannad, Malayalam, Persian, Arabic or French;

(c) "Prospectus" means the prospectus by the Board till the commencement of the Act of 1973 or any examination conducted by the Board;

(d) "relevant year" means the year of examination for which syllabi is contained in the prospectus;

(e) "syllabi" means a document or a part thereof containing the courses of instructions in language subjects for each standard of secondary education;

(f) expressions used in this Act but not defined shall have the meanings respectively assigned to them in the Act of 1973.

  1. Prescription of syllabi for language subjects and text books therefor. It is hereby enacted that the syllabi for language subjects and text books therefor shall be as specified in the prospectus for the relevant year and it shall and shall always be deemed that the syllabi and text books were in force from the date of commencement of this Act and accordingly on the commencement of the Act of 1973, the syllabi and text books in force in language subjects immediately before such commencement shall be, deemed to be laid down and continued under Sections 3 and 4 of the Act of 1973, notwithstanding any judgement, decree or order of any Court or anything contained in any other law for the time being in force to the contrary.
  2. Removal of doubt.- For removal of doubt it is hereby declared that all examinations conducted by the Board on the basis of the syllabi and text books laid down or prescribed under Section 3 and certificates or diplomas granted on the basis of the result of such examinations shall be and shall always be deemed to be validly conducted and granted as if Section 3 were in force at all material times when such examinations were conducted and certificates and diplomas were granted and the validity of such examinations or certificates and diplomas shall not be called in question in any Court of law merely on the ground that no syllabi was laid down or text books were prescribed for such examinations.

Notifications

[Notification No. 49-1-73-B2-XX, dated 12-12-1973.] -Whereas an emergency has arisen, which in the opinion of the State Government requires that immediate action should be taken;

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 9 of the Madhya Pradesh Madhyamik Shiksha Adhiniyam, 1965 (No. 23 of 1965), the State Government hereby direct that-

(a) (i) the courses for the Higher Secondary School Certificate Examination, 1974 shall be courses prescribed for Class XI by the Madhya Pradesh Board of Secondary Education in the prospectus for the said examination (Publication No. 70);

(ii) where no courses have been separately laid down for Class XI, the courses for the said examination shall be the courses, which are, by special order, prescribed by Government; and

(b) in the case of subjects in which practical examinations are prescribed, passing in theory and practical separately shall not be compulsory.

Now, therefore, in exercise of the powers conferred by sub-section (4) of Section 9 of the Madhya Pradesh Madhyamik Shiksha Adhiniyam, 1965 (No. 23 of 1965), the State Government hereby direct that-

(a) the courses for the Higher Secondary School Certificate Examination of 1976 shall be the courses which may be prescribed by the State Government for the said examination by an order issued in this behalf separately;

(b) the courses prescribed under clause (a) shall be applicable to the regular students, private students, the ex-students of one year course of 1975 and the ex-students of the preceding year.
