The M.P. Game Rules, 1962

In exercise of the powers conferred by Section 13 of the Madhya Pradesh Game Act (XV of 1935), the State Government hereby makes the following rules, the rules having been previously published as required by sub-section (1) of the said section, and a copy of the same having been laid on the table of the Madhya Pradesh Legislative Assembly on the 4th April, 1961, as required by sub-section (3) of the said section, namely :-
- These rules may be called the Madhya Pradesh Game Rules, 1962.
- In these rules, unless the context otherwise requires :-
(a) 'Act' means the Madhya Pradesh Game Act, 1935 (XV of 1935);
(b) 'Game' means and includes any bird or animal to which the Act applies;
(c) 'Licence' means a licence granted under Section 4 of the Act, and includes a temporary licence.
Part A
General Rules
- Licence shall be granted or renewed by the Collector subject to the provision of the Act, and these rules.
- (a) A person desiring a licence shall submit to the Collector an application containing the following particulars :-
(1) Name, father's surname, if any, and description.
(2) Place of residence, with police station, tahsil and district.
(3) Occupation.
(4) Kind of licence applied for and the amount of fee credited into the treasury or sub-treasury.
(5) Details of any licence held by him under the Indian Arms Act, 1878.
(6) A copy of the relevant sanad or notification, if exemption from the Indian Arms Act, 1878, is claimed.
(7) Details of endorsement made by a Magistrate under Rule 7 on any previous licence held by the applicant.
(8) A description of the nets, traps or other instruments for capturing game, if any, which he desires to use.
(b) Such application shall be accompanied by a treasury challan in support of the payment of the fee into the treasury or sub-treasury;
(c) In applying for renewal of a licence, the holder shall state if any change has occurred in these particulars.
- (1) Licence shall be of the kinds specified below and the fees for grant or renewal shall be as shown against each :-
(i) Licence for big and small game-
(a) If the licensee holds, a licence under the Indian Arms Act, 1878, or is exempt from its operation under a sanad or notification-Rs. 20.
(b) For others-Rs. 10.
(ii) Licence for small game-
(a) If the licensee holds a licence under the Indian Arms Act, 1878, or is exempt from its operation under a sanad or notification-Rs. 10.
(b) For others-Rs. 5.
(iii) Temporary licence for big and small game for any period not exceeding 30 days-Rs. 10.
(iv) Temporary licence for small game for any period not exceeding thirty days-Rs. 5 :
Provided that, in the case of J.C.O. and N.C.O.'s and Indian other ranks serving in regimental units except Territorial and Auxiliary Force Units in the Madhya Pradesh who are members of a shooting club recognized by the regimental authorities, the fee payable shall be as follows :
Annual or temporary licence for big and small game-Rs.4.
Annual or temporary licence for small game-Rs.2.
(2) A person applying for the grant or renewal of a licence shall credit the amount of licence fee into the treasury of the District to the Head "XXI-Administration of Justice-General Fees, Fines and Forfeiture-Receipts of Executive Officer-other items".
- The killing or capturing of any game by means of dogs is prohibited :
Provided that a holder of a licence may use dogs to flush or retrieve small game or wounded big game :
Provided further that this prohibition shall not extend to the following animal, viz. :-
Indian Hare or 'Khargosh' (Scientific name-Lepus ruficandatus).
- On conviction of a holder of a licence for an offence under the Act, the convicting Magistrate shall endorse on his licence the nature of the offence and the punishment awarded and shall send a copy of the endorsement to the Collector who granted the licence.
- Any police officer or person authorised under Section 12 of the Act, seizing property under the said section shall report the seizure to the Magistrate having jurisdiction.
- Any property confiscated under Section 6 or seized under Section 12 of the Act may on the order of the Magistrate concerned-
(a) be sold and the proceeds of the sale forfeited to the State Government; or
(b) be destroyed.
- A licensee shall not possess any maimed or injured game alive.
Explanation. - The clipping of the wing feathers of a bird is not an injury under this rule.
- A licensee shall not set any net, trap or other instrument for the purpose of capturing near water or a salt-lick, or near a path leading to water or a salt-lick.
- A licensee shall not engage or employ more than two non-licensees to assist him with his nets or other instruments.
- A licensee shall not use any kind of nets, traps or other instruments other than those specified in the licence.
- A licensee shall produce his licence on demand by way of the officers specified below :-
(1) All officers of the Police Department not below the rank of Sub-Inspector.
(2) All officers of the Forest Department not below the rank of Forester.
(3) All officers of the Revenue Department not below the rank of Naib Tahsildar.
Part B
Capturing Licences
- A licence of either of the kinds enumerated in Rule 5 (i) (b) and Rule 5 (ii) (b) shall be termed a "Capturing Licence" and shall be in Form I. It shall be valid only for the district named therein.
- Capturing licences may be granted to Mang, Garddis and Pardhis without the payment of any fee. Such licences shall be in Form II entitled 'Free Capturing Licence' and shall be valid only in the areas specified therein.
- The Collector may limit the number of the licences to be granted under Rule 15 or 16.
Part C
General Licences
- A licence of any of the kinds specified in Rule 5 (i) (a), 5 (iii) or 5 (iv) shall be termed a 'General Licence' and shall be in Form III.
- (1) Any person who possesses a certificate of exemption under the Indian Arms Act, 1878, shall for the purposes of these rules, be deemed to possess a licence under the Indian Arms Act, 1878.
(2) Any person whom a general licence is granted but who does not possess a licence under the Indian Arms Act, 1878, shall unless the licence issued is for capturing big games obtain a licence under the Indian Arms Act, 1878, within a period of 21 days from the date of the issue of a licence under these rules. If he fails to do so, his licence shall stand cancelled on the expiry, of the 30th day from the date on which the general licence is issued.
- A licence shall become void on the death of the licensee or on his ceasing to hold a valid licence under the Indian Arms Act, 1878, or on the withdrawal of grant of his exemption from a licence.
- No holder of a licence shall shoot at,-
(1) any big game other than carnivora,
(2) any small game other than ducks, geese and snipe,
from a fixed position near water or a salt-lick, or near a path leading to water or a salt-lick :
Provided that the prohibition shall not apply to the shooting of game in the course of an organised beat.
- (1) No person shall shoot any animal to which the Act applies other than carnivora, from a motor vehicle; or from within 100 yards of a motor vehicle which has brought him to the vicinity of the animal.
(2) No person shall, between sunset and sunrise, shoot at carnivora to which the Act applies from a motor vehicle or from within 100 yards of a motor vehicle which has brought him to the vicinity of the animal.
- The Central Provinces Game Rules, 1935, the Madhya Bharat Game Rules, 1954, and all other rules corresponding thereto in force in any region of the State of Madhya Pradesh immediately before the commencement of these rules are hereby repealed :
Provided that anything done or any action taken under any of the rules so repealed shall, unless such thing or action is inconsistent with any of the provisions of these rules, be deemed to have been done or taken under the corresponding provisions of these rules,

This licence is granted under the Madhya Pradesh Game Act, 1935 and rules thereunder, and subject to the following conditions :-
(1) The shooting at, killing or capturing of any game in forest, declared to be reserved or protected forest under the Indian Forest Act, 1927; except in accordance with a permit or exemption under the shooting rules framed under that Act, is prohibited and is a breach of this licence.
(2) The shooting at, killing or capturing of any game during the close season, as declared by notification under the Wild Birds and Animals Protection Act, 1912, is prohibited, and is a breach of the licence.
(3) The licensee shall report the escape of a wounded dangerous animal to the nearest forest or police officer and failure to make such a report is a breach of this licence.
