Notification No. 1913-XX-7, dated 24th October, 1970. - In exercise of the powers conferred by clauses (ee) and (eee) of sub-section (2) of Section 37 of the Madhya Pradesh Ancient Monuments and Archaeological Sites and Remains Act, 1964 (12 of 1964), the State Government hereby makes the following rules, the same having been previously published as required by sub-section (1) of the said section, namely :-

  1. Short title.- These rules may be called The Madhya Pradesh Ancient Monuments and Archaeological Sites and Remains (Declaration and Intimation regarding Antiquities) Rules, 1970.
  2. Definitions.- In these rules, unless the context otherwise requires,-

(a) "The Act" means the Madhya Pradesh Ancient Monuments and Archaeological Sites and Remains Act, 1964 (12 of 1964)

(b) "Form" means a form appended to these rules;

(c) "The Collector" means the Collector of the District, in which the declarer resides, has his place of business or is living for the time being.

  1. Declaration under sub-section (1) of Section 23-A.- The declaration under sub-section (1) of Section 23-A of the Act shall be made to the Collector in Form A.
  2. Intimation under sub-section (2) of Section 23-A.- The intimation under sub-section (2) of Section 23-A of the Act shall be given to the Collector in Form B-

(i) in the case of the intention to sell or transfer or acquire any antiquity, within a period of fifteen days before the date of sale, transfer or acquisition of such antiquity; and

(ii) in the case of the possession, custody or control of the antiquity, within seven days of such possession, custody or control of the antiquity by purchase, gift or otherwise.

  1. Intimation under Section 23-B.- The intimation under Section 23-B of the Act shall be given to the Collector in Form C.
