The M.P. Annual Award Rules for The Industrial Units Taking Most Effective Steps for Control of Air and Water Pollution, 1997

Whereas the State Government have decided to institute annual award for one industry under each of the following categories in the State to those who have taken most effective steps for control of air and water pollution in a particular year.
- Highly Polluting Industry.
- General Industry.
- Mines connected with excavation of Minerals.
- Small Industry.
Now, therefore, the State Government hereby publishes the following rules to be followed by such of the industries in the State as may wish to have their case considered for securing one such award under any of the category mentioned above-
- Short title.- These rules will be called The Madhya Pradesh Annual Award Rules for the industrial units taking most effective steps for control of air and water pollution, 1997.
- Definitions.- In these rules the context otherwise requires:-
(a) "Board" means the "Madhya Pradesh Pollution Control Board" a State Board constituted under Section 4 of the Water (Prevention and Control of Pollution) Act, 1974;
(b) "Jury" means the person or persons as the State Government may appoint for considering the claims of the industries and recommend the names of such industries which in their opinion are most suitable for the grant of annual award under each category;
(c) "Highly Polluting Industry" means an industry given in Annexure I and having a capital investment of above Rs. 60 Lakhs on plant and machinery;
(d) "General Industry" means the industries other than categorised highly polluting and having capital investment above Rs. 60 Lakhs on plant and machinery;
(e) "Small Scale Industry" means the industry located in the State and covered under any of the category as mentioned in Annexure-1 of these rules, and having a capital investment of less than Rs. 60.00 Lakhs on plant and machinery;
(f) "Active Mines" means the pits whether open or underground wherefrom minerals are being extracted.
(g) "Form" means a form specified in Annexure-2 of those rules.
- The industries/mines desirous of being considered for the annual award shall submit their claims in the prescribed form alongwith enclosures as may be deemed fit for its eligibility for the annual award to the Board by 30th April of each year stating the position as on 31st March of that year. Only such industries shall be eligible to apply for the award which have letter of consent/renewal for the period in respect of Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
- All claims received on or before the prescribed date by the Board shall be placed before the jury. The jury shall scrutinize and adjudge the claims received and recommend the name or names of the industry/mine to which the award should be given by the State Government. In case the jury has no names to suggest, a recommendation to that effect shall be made. In case the jury recommends more than one name but limited to two then the amount of award shall be distributed equally amongst them.
- The jury shall be free to adopt its own procedure for conduct of business but their recommendation should be made to the State Government not later than 31st May each year.
- The recommendations made by the jury shall be final.
- The State Government may amend the rule or annexure under these rules and such changes, if any made shall be effective from the date the amendment is made.
- The State Government may decide on the awards by 3rd of June.
- The citation as per Annexure 3 shall be given by the State Government on 5th June to the selected industry alongwith the cash award.
