In exercise of the powers conferred by sub-section (1) of Section 95 read with Section 117 of the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), the State Government hereby makes the following rules, the same having been previously published as required by sub-section (3) of Section 95 of the said Act, namely :-

  1. Short title.- These rules may be called the Madhya Pradesh Janapada Panchayat Members (Travelling and Other Allowances) Rules, 1995.
  2. Definitions.- In these rules, unless the context otherwise requires,-

(a) "Act" means the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994);

(b) "Member" means a member of Janapada Panchayat, other than the member referred to in clause (iii) of sub-section (1) of Section 22 of the Act;

(c) "Panchayat" means the Janapada Panchayat;

(d) "Place of meeting" means a place fixed for the meeting of the Panchayat or a place to which journey is required" to be performed by President, Vice-President and any member under general or special order of Government;

(e) the expression "Place of residence" means in case of the President, Vice-President and the member of the Janapada Panchayat, the place intimated to the Chief Executive Officer, where the member usually resides; if such place is within the Janapada Panchayat area and if his actual place of residence situated outside the Janapada Panchayat area, then the specified nearest place within the Panchayat area;

(f) "President and Vice-President" means the President and Vice-President of Janapada Panchayat.

  1. Travelling and daily allowance admissible on tour.- (1) Subject to the provisions of these rules, the President, Vice-President and the members of the Panchayat shall be entitled to travel in higher class of bus of Vail as specified in column (4) of the following table and to draw daily allowance at the rate as specified in column (3) of the said table :-

(2) The President, Vice-President or any member who is getting any fixed honoraria shall not be entitled to draw daily allowance.

(3) The Total daily allowance payable in a month to the different categories as specified in column (2) of the following table shall not exceed the amount as specified in column (3) of the said table: -

(4) The members of Madhya Pradesh Legislative Assembly who arc ex officio member of the Panchayat by virtue of the provision of the Act shall not be entitled to draw any allowances under these rules.

(5) The President, Vice-President or any member whose place of residence is at a distance of more than eight kilometres from the place of meeting, subject to the provision of these rules, shall be entitled to draw,-

(i) Travelling allowance for the journey performed by him for attending a meeting of the Panchayat and back to his place of residence at the following rates,-

(a) by railway, one return actual fare of the Class in which he performs the journey;

(b) by road in a Public bus (stage carriage) one return actual fare;

(ii) Daily allowance for the day of meeting at the rate mentioned in sub-rule (1);

(iii) the travelling allowance under clause (1) of sub-rule (5) shall be calculated by the shortest route and cheapest mode of journey.

(6) The travelling allowance payable in a month to the different categories of members specified in column (2) of the following table, shall be limited to the maximum number of journeys undertaken as specified against each in column (3) of the said table :-

  1. Tour outside jurisdiction.- (1) If the President, Vice-President or any member undertakes any tour outside the jurisdiction of the Panchayat concerned in connection with any meeting, he shall be entitled to draw daily allowance and travelling allowances at the rate specified in sub-rule (1) of Rule 3, subject to the provisions of sub-rule (2).

(2) No such tour shall be undertaken unless authorised by general or specific order of the District Collector:

Provided that no tour shall be undertaken outside the District unless, the State Government specifically permits for it in advance.

  1. Tour by own vehicle.- Tour by own vehicle shall not be permitted.
  2. Tour by Panchayat vehicle.- (1) When a vehicle is provided to President, Vice-President and any member of Panchayat, the monthly ceiling on consumption of petrol/diesel and the ceiling of maintenance of such vehicle shall be governed by the instructions issued by the Panchayat and Rural Development Department from time to time.

(2) No Panchayat vehicle shall be taken outside the jurisdiction of the concerned Panchayat without the written permission of Divisional Commissioner.

  1. Bill.- (1) A bill for the travelling and daily allowance shall be claimed in the form appended to these rules duly countersigned by the officer mentioned in column 3 of the following table :-

(2) The travelling allowance bill shall be accompanied by motor service tickets and/or PNR number/the number of Railway tickets as the case may be.

  1. Other allowances and facilities.- The President and Vice-President shall be paid other allowances mentioned against each in the column 3 of the following table :-

  1. Claim for allowances.- (1) A claim for allowance under these rules, shall be preferred within one year of its becoming due.

(2) A claim for travelling, daily allowance and other allowances shall be deemed to have become due on the last day of the month to which it relates.

(3) If claim is preferred after one year, the reasons for the delay for submission of the same shall be stated by the claimant in his bill, to the satisfaction of the countersigning authority.

  1. Fund.- The expenditure on various items mentioned in these rules will primarily be out of the funds of the Panchayat concerned.
  2. Removal of difficulties.- If any doubt or difficulty arises about the interpretation of these rules, the matter shall be referred lo the State Government whose decision shall be final.
  3. Repeal.- All previous rules on the subject, shall stand repealed from the date of final publication of these rules, in the "Madhya Pradesh Gazette".
