In exercise of the powers conferred by sub-section (1) of Section 95 read with of Section 117 of the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994), the State Government hereby makes the following rules, the same having been previously published as required by sub-section (3) of Section 95 of the said Act, namely :-

  1. Short title.- These rules may be called the Madhya Pradesh Gram Panchayats (Traveling Allowance and Other Allowances) Rules, 1995.
  2. Definitions.- In these rules, unless the context otherwise requires,-

(a) "Act" means the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994);

(b) "Panch" means a "Panch" of the Gram Panchayat;

(c) "Panchayat" means the Gram Panchayat;

(d) "Place of meeting" means a place fixed for the meeting of the Panchayat or a place to which journey is required to be performed by a "Sarpanch" or "Panch" under general or specific order of the Government;

(e) The expression "place of residence" would mean the place within the Panchayat, where Sarpanch or Panch resides;

(f) "Sarpanch" and "Up-Sarpanch" means Sarpanch and Up-Sarpanch of Gram Panchayat.

  1. Sarpanch and Panch not entitled to draw travelling and daily allowances.- The Sarpanch and Panchs shall not be entitled to draw any travelling and daily allowance :

Provided that whenever they are specifically invited by the Government or any officer authorised by it, to participate in any conference, meeting or training, they shall be entitled to draw such travelling and daily allowance as may be prescribed by the State Government by a specific or general order.

  1. Annual Service Allowance.- An amount equivalent to one per cent of annual allotment from Government for various developmental scheme of Panchayat or Rupees One thousand eight hundred whichever is less, shall be paid to a Sarpanch of concerned Gram Panchayat as Annual Service Allowance. Total annual allotment will be determined and certified by the Panchayat and Social Education Organiser in consultation with the Secretary of the Gram Panchayat.
  2. Bill.- A bill for allowances under these rules shall be countersigned by Chief Executive Officer of Janpad Panchayat.
  3. Claim for allowance.- (1) A claim for allowances under these rules shall be preferred within one year of its becoming due.

(2) If claim is preferred after one year, the reason for the delay for submission of the same shall be stated by the claimant in his bill, to the satisfaction of the countersigning authority.

  1. Fund.- The expenditure on various items mentioned in these rules will be primarily met out of the funds of the Panchayat concerned.
  2. Removal of difficulties.- If any doubt or difficulty arises about the interpretation of these rules, the matter shall be referred to the State Government whose decision shall be final.
  3. Repeal.- The Madhya Pradesh Gram Panchayats (Allowances to Panchs) Rules, 1967 shall stand repealed from the date on the final publication of these rules in the "Madhya Pradesh Gazette".
