In exercise of the powers conferred by sub-section (2) of Section 15 of the Madhya Pradesh Adhivakta Kalyan Nidhi Adhyadesh, 1981 (No. 14 of 1981), the State Government hereby publishes the Madhya Pradesh Advocates Group Insurance Scheme, 1981 prepared by the Madhya Pradesh Advocates Welfare Fund Committee in pursuance of Clause (1) of sub-section (1) of the said section namely :-

  1. Short title and commencement.- (1) This scheme may be called The Madhya Pradesh Advocates Group Insurance Scheme, 1981.

(2) It shall come into force on the date of its publication in the Madhya Pradesh Gazette.

  1. Application of scheme.- The Scheme shall apply to all the members of the Advocates Welfare Fund constituted under Section 3 of the Adhyadesh.
  2. Definitions.- In this Scheme,-

(a) "Adhyadesh" means the Madhya Pradesh Adhivakta Kalyan Nidhi Adhyadesh, 1981 (No. 15 of 1981);

(b) "Scheme" means the Madhya Pradesh Advocates Group Insurance Scheme; and

(c) the words and expressions used herein and defined in the Adhyadesh shall have the meaning assigned to them in the Adhyadesh.

  1. Trustee Committee to provide for Group Insurance.- The Trustee Committee shall provide for the Group Insurance of all the members of the fund for a sum of ten thousand rupees for each member and for that purpose shall take necessary steps to enter into contract with the Life Insurance Corporation of India :

Provided that the members who have attained the age of sixty years on the date of coming into force of the Scheme shall not be included in the Group Insurance.

  1. Trustee Committee to pay premium for Group Insurance.- The Trustee Committee shall, out of its fund, pay to the Life Insurance Corporation a premium in terms of the master policy issued by the Life Insurance Corporation in the name of the Trustee Committee in this behalf.
  2. Trustee Committee to hold insurance policy and arrange for its renewal.- The Trustee Committee shall hold the insurance policy on behalf of the members of the fund and shall as and when necessary take steps to renew the same in terms of the master policy issued by the Life Insurance Corporation.
  3. Life Insurance Corporation to be informed on death of a member.- The Trustee Committee shall give due intimation to the Life Insurance Corporation of death of any of the members covered by the scheme and for that purpose supply to Life Insurance Corporation all necessary documents required for settlement of the claim in terms of the insurance policy including death certificate of the member.
  4. Disbursement of amount.- On receipt of the amount from Life Insurance Corporation in settlement of claim to the deceased member, the Trustee Committee shall without any delay pay the same to the nominee of the deceased or where no nominee has been specified to the legal heirs of the deceased member.
  5. Trustee Committee to undertake work of insurance itself.- Notwithstanding anything contained in the foregoing provisions, the Trustee Committee may instead of providing for group life insurance through Life Insurance Corporation of India, undertake the same itself in accordance with the law relating to insurance for the time being in force.
