In exercise of the powers conferred by sub-section (2) of Section 15 of the Madhya Pradesh Adhivakta Kalyan Nidhi Adhiniyam, 1982 (No. 9 of 1982), the State Government hereby publish the Madhya Pradesh Advocates (Aid to purchase Law Books) Scheme, 1995 prepared by the Madhya Pradesh Advocates Welfare Fund Committee in pursuance of clause (i) of sub-section (1) of the said Section, namely :-

  1. (1) This Scheme may be called The Madhya Pradesh Advocates (Aid to purchase Law Books) Scheme, 1995.

(2) It shall be deemed to have come into force with effect from 20th August, 1995.

  1. The Trustee Committee shall give aid of rupees five hundred per month for a period of one year to 50 such Junior Advocates in the rolls of the Madhya Pradesh State Bar Council who are not more than thirty years of age.
  2. Those Advocates who fulfil the criteria specified in clause 2 may apply to the Secretary, Trustee Committee through the State Bar Council of Madhya Pradesh.
  3. The Bar Council shall after scrutinizing the application forward to the same to the Trustee Committee with its recommendation.
  4. The Trustee Committee shall consider the application on the basis of merit:

Provided that reservation will be given to such Advocates who belong to Scheduled Castes or Scheduled Tribes as per policy of the State Government :

Provided further that in case an Advocate is already in receipt of an amount from the Scheduled Castes and Scheduled Tribes Welfare Department of the State Government for this purpose, such amount shall be adjusted in the amount to be paid under this scheme.

  1. An Advocate who is given any amount under this scheme is required to produce cash memos in respect of the books purchased by him within one month from the date of receipt of the amount to the State Bar Council.
  2. In case an Advocate fails to submit the receipt under clause 6 the amount paid to him shall be recovered from him.
  3. The State Bar Council shall have right to inspect the library of the Advocate who is given aid under this scheme.
  4. In case the State Bar Council on inspection under clause 8 is satisfied that the Advocate has not utilised the amount granted to him for the purchase of books the amount paid to him shall be recoverable from him together with interest at the rate of 12 per cent per annum.
  5. The decision of the Trustee Committee about any matter under this scheme shall be final.
