Notification No.113-X-163, dated 31-1-1963. - In exercise of the powers conferred by clause (i) of sub-section (1) of Section 26, clause (j) of Section 32 and clause (d) of Section 76 of the Indian Forest Act, 1927 (XVI of 1927), the State Government has made following rules namely :-

  1. Short title and extent.- These rules may be called the Madhya Pradesh Forests (Hunting, Shooting, Fishing, Poisoning Water and Setting Traps or Snares in Reserved or Protected Forests) Rules, 1963.
  2. Definitions.- In these rules, unless tire context otherwise requires,

(a) "Act" means the Indian Forest Act, 1927 (XVI of 1927);

(b) "Appendix" means an appendix annexed to these rules;

(c) "Block" means a shooting block into which forests of a division are divided under Rule 5;

(d) "Form" means a form appended to these rules;

(e) "Licence" means a licence granted under these rules for fishing or setting traps or snares in the forests closed under clause (b) of sub-rule (i) of Rule 4;

(f) "Permit" means a permit granted under these rules for hunting or shooting in the forests closed under clause (b) of sub-rule (i) of Rule 4;

(g) "Big game" or "small game" means a game specified as such in the Schedule to the Madhya Pradesh Game Act, 1935 (No. 15 of 1935).

  1. Acts prohibited in reserved and protected forests.- The following acts are prohibited in all reserved and protected forests :-

(a) the poisoning or dynamiting of rivers, streams or tanks;

(b) shooting at any animal other than carnivora, wild dog, blue bull, wild pig and porcupine from mechanically propelled vehicle on water or land or from within 100 yards of such vehicle which has brought the person to the vicinity of the animal;

(c) shooting between sunset and sunrise at carnivora from a mechanically propelled vehicle or from within 100 yards from a mechanically propelled vehicle which has brought him to the vicinity of the animal;

(d) shooting at any animal other than carnivora with the aid of artificial light;

(e) setting of fire to any vegetation;

(f) shooting at-

(i) any big game other than carnivora,

(ii) any small game other than ducks, geese, snipe and porcupine from a fixed position near water or a salt lick or near a path leading to water or salt lick : provided it is not in the course of an organised beat.

(g) shooting at or killing any bird or animal entered in Appendix A in a close season fixed for such bird or animal.

  1. Closing of forests to hunting, shooting, etc.- (1) The Conservator of Forests of the Circle shall prepare in October of each year a list of forests which shall be closed to the public generally for hunting, shooting, fishing, netting or setting traps or snares-

(a) absolutely whether for purposes of forest management or as sanctuaries or for the protection of game other than pigs, blue bulls and wild dogs;

(b) conditionally subject to the issue of a permit or licence under these rules.

(2) The list of forests so closed shall be published by the Conservator of Forests of the Circle in the Madhya Pradesh Gazette and copies of the list so published shall be posted up for information of the public in the office of the Collectors and Divisional Forest Officers.

  1. Division of forests into shooting blocks.- The forests closed conditionally under clause (b) of sub-rule (1) of Rule 4 in each division shall be divided into shooting blocks of convenient size by the Divisional Forest Officer in consultation with the Collector and with the approval of the Conservator of Forests of the Circle.
  2. Hunting, shooting, etc., prohibited except under a permit or licence.- No person shall-

(a) except under a permit granted in this behalf, hunt or shoot; or

(b) except under a licence granted in this behalf net or set traps or snares; in the forests closed under clause (b) of sub-rule (1) of Rule 4.

  1. Powers of the Divisional Forest Officer and Conservator of forests.- (1) The permit or licence under these rules shall be granted by the Divisional Forest Officer.

(2) The Divisional Forest Officer or the Conservator of Forests may, at any time, cancel any permit or licence for a breach of any provision of the Act or these rules or of any condition of the permit or licence whether committed by the permit-holder or the licensee or by any of his retainers or followers or by any member of his party or in the event of fire breaking out in any forest in respect of which the permit or licence has been granted or in the case of unwarrantable interference with forest work.

  1. When application for permit or licence may be made.- (1) An application for permit or licence shall not ordinarily be granted unless it is made not more than three months and not less than one month before the date from which the applicant desires to make use of a permit or licence :

Provided that-

(a) in the case of a resident of the district such application may be made 15 days before such date, and

(b) a permit or licence for a short period not exceeding ten days may be granted as soon as such application is made :

Provided further that in the case of foreign tourist an application for a permit or licence may be made six months before the date from which it is desired to make use of it.

(2) Shooting blocks may be reserved for a period of not more than 2 months preceding the date of beginning of the actual shooting permit for foreign tourist only on payment of Rs. 50 per mensem.

  1. Power to grant or refuse a permit or licence.- (1) On receipt of an application under Rule 8 the Divisional Forest Officer may after making such enquiry as he may deem fit, grant or refuse a permit or licence for reasons to be recorded.

(2) Any person aggrieved by the order of Divisional Forest Officer refusing a permit or licence, may, within fifteen days from the date on which the order is communicated to him, prefer an appeal to the Conservator of Forests.

  1. Permit or licence to be returned on expiry of period.- On the expiry of the period of the permit or the licence, the permit-holder or the licensee, as the case may be, shall return it to the Divisional Forest Officer with an endorsement thereon showing the number and kind, and the horn dimensions in the case of protected animals or length in the case of carnivora and bear, of all game killed or captured by him.
  2. Permit or licence not transferable.- A permit or licence shall not be transferable.
  3. Permit or licence to be produced on demand for inspection.- Every permit-holder or licensee shall, on demand by any forest or Police Officer produce his permit or licence, as the case may be, for inspection.
  4. Blocks for which permits or licence are valid.- A permit or licence shall ordinarily be valid for one block only for which it has been granted but may cover two blocks when there are no applicants for the surplus blocks :

Provided that a wounded game may be-pursued into an adjoining block.

  1. Period of permits and licence.- The period of a permit or licence shall be determined by the Divisional Forest Officer according to the demand for blocks but in no case shall exceed two months.
  2. Number of sportsmen and particulars of permits.- The number of sportsmen allowed to hunt and shoot on any one permit shall be limited to four. Every permit shall specify the names and full addresses and arms and game licence, number of the sportsmen authorised to shoot under it and may limit the numbers of the retainers and of dogs and other animals which may be taken into the forests.
  3. Divisional Forest Officer to limit the game.- The Divisional Forest Officer shall, subject to these rules, fix the maximum number of game of each species which may be allowed to be killed in each block during the year. He shall, subject to the approval of the Conservator of Forests, fix a sliding scale for permits and licences also according to whether they are granted for a period up to fifteen days, one month or over one month.
  4. Maintenance of game books.- Game books shall be kept in each divisional and range forest office in Form I showing the number of heads of protected animals permitted to be killed and the number of game of every kind killed up-to-date.
  5. Annual statement of game.- The Chief Conservator of Forests shall, at the end of each year, compile from an annual statement to be submitted to him by the Conservator of Forests, a statement showing the number and kind of protected game killed by permit-holders.
  6. Fees for permit and royalty.- (1) The fee payable in respect of a permit shall-

(a) in the case of a resident of India, be Rs. 2 per day subject to a minimum of Rs. 20 and a maximum of Rs. 50 per mensem, and

(b) in the case of a non-resident of India or of a party including such persons, be Rs. 350 per mensem and for a period shorter than a month be Rs. 20 per day subject to a minimum of Rs. 200.

(2) In addition to the fee for a permit royalty at the following rates shall also be charged for animals actually shot or killed :-

Explanation. - For the purposes of this rule a resident of India means a citizen of India or a foreigner who has been continuously residing in India for a period of at least 5 years or who has come to India on a specific assignment of the Central or State Government or a Central Government undertaking and is not a casual tourist.

  1. Fee for licence and royalty.- (1) The fee payable in respect of a licence shall be Rs. 50 per mensem.

(2) In addition to the fee for a licence, royalty at the rates as may be prescribed by the State Government shall also be charged.

  1. Restriction on the number of animals to be killed.- No permit-holder shall be permitted to kill in any one year ending on 31st October, in the blocks more than-

(i) one wild buffalo,

(ii) one bison,

(iii) one barasingha,

(iv) one black buck,

(v) two sambhars,

[(vi) two tigers, or

one tiger and one panther, or two panthers.]

  1. Permission for shooting wild buffalo, etc.- Shooting of a wild buffalo, bison, black buck and barasingha shall not be permitted except with the sanction of the Chief Conservator of Forests, subject to the special directions if any, of the State Government.
  2. Permission for wild buffalo and bison.- No permission for shooting of wild buffalo or bison shall be given unless the person possesses arms with minimum 4000 lb. striking energy.
  3. Permit for forests under complete systematic fire protection.- No permit shall ordinarily be granted for forests under complete systematic fire protection between 15th February and 30th June except to approved sportsmen for hunting and killing of carnivorous and such other animals as may be specified in the permit.
  4. Permit for an animal or bird to which Game Act applies.- No permit under these rules shall be granted for shooting any animal or bird to which the Madhya Pradesh Game Act, 1935 (XV of 1935) applies unless the person applying for permit holds a licence under Section 4 or is exempted under Section 9 of the said Act.
  5. Certificate to be signed.- The person to whom a permit is granted shall before receiving the permit sign the certificate in Form II printed in red ink on a detachable slip added to the permit and return the same to the Divisional Forest Officer.
  6. Notice to enter forest.- No permit-holder or licensee shall enter any forest without giving 24 hours previous notice to the local forest official unless exempted by the Divisional Forest Officer.
  7. Camping grounds.- The permit-holder shall camp only on such regular camping grounds as may have been set apart by the forest authorities or in place specially pointed out to him by a Forest Officer.
  8. Confiscation of trophy.- A permit-holder shall be entitled to shoot the maximum number of animals specified in the permit. In every case of infringement of this condition, the trophy may be confiscated, in addition to the penalty that may be imposed by the competent authority in consideration of the merits of each case.
  9. Royalty for animals shot without a permit.- Royalty for animals shot without a permit shall be assessed at the rate equivalent to four times the rates provided in sub-rule (2) of Rule 19.
  10. Limitation of game to be killed.- Only a limited head of game shall be allowed to be killed in any block in any one year. On the limit being reached, the block shall be closed for the remainder of the season as a matter of course. It shall be within the discretion of Conservator of Forests to prohibit the shooting of any animal in any specified block.
  11. Form of application.- Application for the grant of permit shall be made in Form III.
  12. Fee to accompany the application.- No application for the grant of a permit or a licence shall be considered unless it is accompanied by the fee prescribed for it under these rules.
  13. Special shooting permits.- Special shooting permits may be issued free of any charge to approved sportsmen of the district for the destruction of a man-eater or cattle-lifter notified by the Collector. Such permits shall be issued for a period of three months.
  14. Form of permit and licence.- (1) A permit for hunting and shooting shall be in Form IV.

(2) A licence for fishing, or setting traps or snares shall be in Form V.

  1. Liability of the permit-holder or the licensee.- The permit-holder or licensee is not exempted from liability under the Act or any other law for the time being in force for anything done in contravention of such Act or law for any damage caused by him or by any member of his party or by his retainers or followers.
  2. Permit-holder to acquaint with the boundaries of the block.- A permit-holder shall be responsible to acquaint himself and the members of his party with the boundaries of the block before commencing shooting.
  3. Disposal by auction sale, etc.- Nothing in these rules shall prevent the disposal by auction sale, contract or otherwise of the shooting or fishing rights within any part of the forest, but no such disposal shall be made without previous sanction of the State Government obtained in each case.
  4. Refund of fee paid.- A refund of the fee paid for a permit or licence may be sanctioned by the Conservator of Forests of the permit-holder or from licensee is prohibited by an order of the Conservator of Forests from shooting or capturing game in the block on account of an outbreak of fire or the execution of special work therein or the reservation thereof for any high personage or other like cause. Where the permit-holder or licensee applies for the cancellation of his permit or licence, half the fees prescribed under Rule 19 and paid shall be refunded to him and the other half shall lapse to Government. No refund shall be admissible in any other case or circumstances.
  5. Collection of specimen of rarer fauna.- Person requiring specimens of rarer fauna for bonafidescientific or museum purposes shall apply to the State Government who may fix the fee and number of specimens to be shot and depute a special officer to collet the specimens required.
  6. Privileges of the Rules.- Nothing in these rules shall be taken to cancel any privileges granted to the Rulers of Indian States under any covenant or agreement.
  7. Repeal and savings.- If immediately before the commencement of these rules, there are in force in any region of the State any rules relating to hunting, shooting, fishing, poisoning water, and setting traps or snares in reserved or protected forests made under the Act, all those rules shall stand repealed :

Provided that anything done or any action taken under the rules so repealed shall unless such thing or action is inconsistent with any of the provisions of these rules, be deemed to have been done or taken under the corresponding provisions of these rules.

Note. - In returning this report to the Forest Officer, the permit-holder is invited to write below any remarks he may wish to offer, particularly as regards the numbers and condition of game in the Shooting Block visited by him. The following questions may be answered. Negative information is also useful:-

  1. How many bison, barasingha, or chital did you see?
  2. How many tigers, panthers and bears do you think were in your block?
  3. Did you see any signs of illicit shooting such as pits near water, machans or hides, or hear gun-shots?
  4. Give the name of any shikari you can recommend.
  5. Details of any unusual incident notice by you or any outstanding event.

Extracts from the Rules and Conditions

  1. This permit is issued by the Divisional Forest Officer.
  2. A permit is not transferable, and may be cancelled at any time by the officer granting it or by the Conservator. A permit may be cancelled for any breach of the Forest Act committed by the permit-holder or his servants; or on account of fire breaking out, or in case of interference with Government work.
  3. The permit-holder must give at least 24 hours notice of his arrival to the Range Officer. He must camp only at places sanctioned by the Divisional Forest Officer.
  4. The permit-holder is entitled to shoot only those animals and birds shown in his permit subject to the close season fixed for such birds or animals.
  5. Except for shooting carnivora a permit-holder with intent to shoot shall not sit up in the neighbourhood of water or salt licks or on paths leading to such places. No animals except carnivora may be shot from a motor-car or bullock-cart by day or night, nor should artificial lights be used for shooting animals other than carnivora.

This licence is granted under the Indian Forest Act, 1927 (XVI of 1927), and rules made thereunder, and subject to the following conditions :-

(1) The shooting at, killing, or capturing of any game during the close season is prohibited.

(2) The licensee shall report the escape of a wounded dangerous animal to the nearest Forest or Police Officer and failure to make such a report is a breach of this licence.

Notifications

[Notification No. 2293, dated 18-3-1971.] - In exercise of the powers conferred under Rule 4(1) of the Madhya Pradesh Forests (Hunting, Shooting, Fishing, Poisoning Water and Setting Traps and Snares in Reserved and Protected Forests) Rules, 1963, the forest area with its boundaries given in the following Schedule is hereby declared as sanctuary and shall remain closed to public for hunting shooting, fishing, poisoning water and setting traps and snares.
