The M.P. Forest Protection Reward Rules, 2004

In exercise of the powers conferred by clause (b) of Section 76 of the Indian Forest Act, 1927 (No. XVI of 1927), the State Government, hereby makes the following rules, namely :-
- Short title, extent and commencement.- (1) These rules may be called the Madhya Pradesh Forest Protection Rewards Rules, 2004.
(2) They shall extend to the whole of the State of Madhya Pradesh.
(3) They shall come into force from the date of their publication in the "Madhya Pradesh Gazette".
- Definition.- In these rules unless the context otherwise requires :-
(a) "Act" means the Indian Forest Act, 1927 (XVI of 1927);
(b) "Conservator" means an Officer-in-charge of a forest circle or any other officer declared equivalent to him by the State Government;
(c) "Divisional Forest Officer" means an Officer-in-charge of a forest division or any other officer declared equivalent to him by the State Government;
(d) "Other articles" means vehicles, equipments, cattle, weapons, tools or any other material used in the commission of a forest offence;
(e) the words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.
- Rewards.- On the conviction of an offender alleged of a forest offence or on composition of his forest-offence, the Divisional Forest Officer may grant and pay a reward to any person or persons, who have rendered extraordinary help in detecting the forest-offence, apprehension of offender, conviction of offender or the confiscation of forest produce and other articles, in such proportion as he may deem fit, the amount of the rewards shall in a case be more than the amount of compensation accepted under Section 68 of the Act, and the value of confiscated forest produce and other articles or rupees twenty five thousand, whichever is less :
Provided that the prior permission of the concerned Conservator of the Forests shall be required for all rewards exceeding rupees ten thousand :
Provided further that the officers above the rank of Sub-divisional Forest Officer and Sub-divisional Police Officer shall not be entitled to any reward under this rule.
- Sanctioning Authority.- The reward shall be sanctioned by the concerned Divisional Forest Officersuo motuor on any application submitted by a eligible person, on the recommendation of the concerned Sub-divisional Forest Officer.
- Recovery of Reward.- If after the payment of the reward, the conviction is reversed in appeal, the amount paid in reward shall not be recovered from the person to whom it has been paid, unless it appears that they have acted fraudulently in the case.
- Confidential Reward.- The reward sanctioned out of the secret fund of the Forest Department to an informer shall be kept confidential and this shall not be called into examination in any office or Court.
- Repeal and Savings.- All rules and orders corresponding to these rules in force immediately before the commencement of these rules are hereby repealed in respect of matters covered by these rules :
Provided that any order made or action taken under the rules or orders so repealed shall be deemed to have been made or taken under the corresponding provisions of these rules.
