An Act to provide for the salaries, allowances and other benefits of the Chief Whip and the Deputy Chief Whip of the Majority Party in the Legislative Assembly of the Himachal Pradesh.

Be it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-ninth Year of the Republic of India as follows:-

  1. Short title and commencement.- (1) This Act may be called the Salaries, Allowances and other Benefits of the Chief Whip and the Deputy Chief Whip in the Legislative Assembly of Himachal Pradesh Act, 2018.

(2) It shall come into force on such date as the State Government may, by notification in the Rajpatra (e-Gazette), Himachal Pradesh, appoint.

  1. Definitions.- In this Act, unless the context otherwise requires,-

(a) "Állowances" includes daily allowance, compensatory allowance, sumptuary allowance, conveyance allowance, travelling allowance or any other allowance admissible to a Minister under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000; (11 of 2000 )

(b) "Chief Whip" in relation to the Legislative Assembly of the Himachal Pradesh means the Member of the Legislative Assembly who is, for the time being, declared by the majority party to be the Chief Whip of the party forming the Government and recognized as such by the Speaker of the Legislative Assembly;

(c) "Deputy Chief Whip" in relation to the Legislative Assembly of the Himachal Pradesh means the Member of the Legislative Assembly who is, for the time being, declared by the majority party to be the Deputy Chief Whip of the party forming the Government and recognized as such by the Speaker of the Legislative Assembly;

(d) "Government" or "State Government" means the Government of Himachal Pradesh;

(e) "Minister" means a Member of the Council of Ministers, by whatever name called;

(f) "Notification" means notification published in the Rajpatra (e-Gazette), Himachal Pradesh;

(g) "Section" means a section of this Act;

(h) "Speaker" means the Speaker of the Legislative Assembly of the Himachal Pradesh; and

(i) "State" means the State of Himachal Pradesh.

  1. Salary and Allowances.- (1) The Chief Whip shall be entitled to receive a salary and allowances at the same rate as are admissible to a Cabinet Minister of the Government under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000.

(2) The Deputy Chief Whip shall be entitled to receive a salary and allowances at the same rate as are admissible to a Minister of State of the Government under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000.

  1. Residence.- (1) The Chief Whip shall be provided with residential facilities or allowances, as the case may be, as are admissible to a Cabinet Minister of the Government under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000.

(2) The Deputy Chief Whip shall be provided with residential facilities or allowances, as the case may be, as are admissible to a Minister of State of the Government under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000.

  1. Other benefits.- The Chief Whip and the Deputy Chief Whip shall be entitled to other benefits like free transit by railway or by air, advance of loan for purchase of motor car, House building advance and free installation of telephone etc. as are admissible to a Minister of the Government under the Salaries and Allowances of Ministers (Himachal Pradesh) Act, 2000.
  2. The Chief Whip and the Deputy Chief Whip not to draw salary or allowances as a Member of Legislative Assembly.- The Chief Whip and the Deputy Chief Whip shall not be entitled to receive any sum by way of salary or allowances, as a Member of the Legislative Assembly of Himachal Pradesh except what is specifically provided for under this Act.
  3. Notification in respect of appointment etc. of the Chief Whip and the Deputy Chief Whip to be conclusive evidence thereof.- The date on which any person becomes or ceases to be a Chief Whip or a Deputy Chief Whip shall be published in the Rajpatra (e-Gazette), Himachal Pradesh and any such notification shall be conclusive evidence of the fact that he became or ceased to be a Chief Whip or a Deputy Chief Whip on that
