Haryana State Agricultural Marketing Board Sale of Shop plots Rules, 1994

No. 3527-Agri.S(2)94/33807. - In exercise of the powers conferred by sub-section (1) and clause (vi) of sub-section (2) of Section 43 read with Section 18 of the Punjab Agricultural Produce Markets Act, 1961 and all other powers enabling him in this behalf the Governor of Haryana hereby makes the following rules regulating the sale and transfer of immovable property of the committee, namely :-

  1. Short title.- (1) These rules may be called the Haryana State Agricultural Marketing Board Sale of Shop plots Rules, 1994.
  2. Definitions.- In these rules unless the context otherwise requires :-

(a) "category (ii)" means the category as shown under clause (ii) of sub-rule (2) of rule 17 of Punjab Agricultural Produce Markets (General) Rules, 1962.

(b) "reserved category" shall means and include the persons belonging the class or category declared as such by the Government from time to time.

(c) "restricted auction" means the auction of shop plots among licensees or other reserve categories.

  1. Disposal of shop plots by restricted auction.- Immovable property in all developed markets will be offered in the first instance by way of restricted auctions to the old licensees of category (ii) satisfying the prescribed criteria of two years of carrying their business in old market and paying regular market fee of not less than Rs. 5,000 annually for each of the last two years. Similarly on the same terms and conditions the shop plots to be offered all the reserved categories as decided by the Government from time to time shall be put to restricted auction separately.
  2. Cut off date for old licensees.- The cut off date for deciding the eligibility of those licensees of category (ii) to participate in the restricted auction would be the date on which the notification under Section 4 of the Land Acquisition Act, 1894 was issued on the date of transfer of land in respect of the particular market.
  3. Condition of construct.- The persons who will be allotted shop plots in the new market will construct their shops within two years and they will not be allowed to carry out their business in the old market after two years failing which their immovable property will be resumed.
  4. Disposal of shop plots by open auction.- After giving two opportunities under rule 3, the remaining shop plots, if any, will be disposed of by way of open auction.
  5. Reserve price.- Reserve price of all the shop plots disposed of by way of restricted or open auction in all the markets will be fixed or refixed by the Chief Administrator.
  6. Conditions as to business.- The allottee of shop plots shall not do any other business in the market except that of agricultural produce.
  7. Other terms and conditions for sale or shop plots.- The other terms and conditions governing the sale and transfer of shop plots will be as per instruction issued by the Board from time to time.
