No. G.S.R. 12/H.A. 26/74/S.7/81. - In exercise of the powers conferred by Section 7 of the Haryana Prohibition of Smoking in Cinema and Theatre Halls Rules, 1974, the Governor of Haryana hereby makes the following rules for the prohibition of smoking in cinema and theatre halls in the State, namely :-

  1. Short title.- (1) These rules may be called the Haryana Prohibition of Smoking in Cinema and Theatre Halls Rules, 1981.
  2. Definitions.- In these rules, unless the context otherwise requires, -

(a) "Act" means the Haryana Prohibition of Smoking in Cinema and Theatre Halls Act, 1974;

(b) "form" means a form appended to these rules;

(c) "manager" means a person who, for the time being, manages the business of exhibition of cinematograph or stage acting; and

(d) "proprietor" means the proprietor or proprietors of a cinema or a theatre and includes an occupier thereof.

  1. Restrictions. Section 7(1).- No person shall enter an auditorium with a burning cigarette or beeri or churat or Hukka or any such article which may emit smoke during the prohibited period.
  2. Information to audience and spectators. Section 7(1).- The proprietor or the manager shall arrange to advertise in the auditorium by projecting or showing a slide or by such other means, as he deems fit, to the audience and spectators, prohibiting smoking in the auditorium, the authorities empowered to check and prosecute including the amount of penalty.
  3. Power to inspect. Sections 4 and 7.- (1) An Inspector shall have the power to enter any cinema or theatre hall or an auditorium at any time during the prohibited period and to enquire the name, address and other particulars specified in Form I of a person found smoking in the auditorium or on the stage for the purpose of prosecution.

(2) The proprietor or the manager or any other employee of the management of a cinema or theatre, whosoever may be present shall allow the Inspector to enter the cinema or theatre hall or auditorium, as the case may be.

(3) The Inspector, as far as possible, may take along with him the proprietor or the manager or any other employee of the management of cinema or theatre whosoever may be present and the person so directed shall accompany him.

  1. Form of complaint. Sections 5 and 7.- All complaints against person or persons committing an offence under Section 3 of the Act shall be in Form II.
