Haryana Municipal Piggery Bye-laws, 1976

- (1) These bye-laws may be called the Haryana Municipal Piggery Bye-laws, 1976.
(2) They shall apply to all the municipalities.
- In these bye-laws, unless the context otherwise requires, -
(a) "Act" means the Haryana Municipal Act, 1973;
(b) "Licence" means a licence issued in form appended to these bye-laws;
(c) "Licensee" means a person to whom a licence has been granted under these bye-laws;
(d) "Piggery" means any premises where more than twenty-five pigs and swine are kept for sale or slaughter;
(e) words and expressions used herein but not defined in these bye-laws shall have the same meaning as are assigned to them in the Act.
- No person shall use or permit to be used any premises, owned or occupied by him, as a piggery except without a licence to be issued in this behalf by the Executive Officer or the Secretary, as the case may be, of the committee, in the form appended to these bye-laws.
- Every licence shall be in force from 1st April to 31st, March, next following and a licence granted during this period shall expire on the 31st March. An application for a licence shall be made to the Licensing Officer, so authorised by the committee.
- The licence granted under these bye-laws, shall be subject to the following conditions, namely :-
(a) the site of the piggery shall be approved by the Municipal Medical Officer of Health;
(b) no piggery shall be allowed within a distance of six hundred feet from any habitation.
(c) a piggery shall consist partly of a well ventilated sty and partly of an open court-yard surrounded by a wall not less than six feet in height;
(d) the walls of the court-yard and the sty shall be made of 1st class burnt bricks in lime to a height of at least three feet. The inside of the walls shall be cement pointed or plastered. The floor shall be paved and cement pointed or made of any non-absorbent material. The roof of the sty shall consist of non-inflammable material;
(e) the sty and the courtyard shall be properly drained into a municipal drain or sewer;
(f) the piggery shall be lime washed twice a year;
(g) pigs shall be fed on wholesome food;
(h) pigs shall not be allowed to stray outside the licenced premises at any time;
(i) every pig shall carry porch mark on its ears, as prescribed by the committee;
(j) no piggery shall be used for human habitation. The licensee shall not permit any person to cook food in the premises;
(k) no pigs shall be slaughtered in any place other than a public slaughter house or any other place licensed by the committee for the said purpose;
(l) the piggery shall be open to inspection by any member of the committee, the Executive Officer, Secretary, the Medical Officer of Health, the Veterinary Officer or any other officer of the committee authorised in this behalf.
- Without prejudice to any other action that may be taken against a licensee for breach of any of the provisions of these bye-laws, his licence may be suspended or cancelled by the licensing officer :
Provided that no licence shall be cancelled unless a reasonable opportunity of being heard shall be afforded to the licensee.
- (1) The fee to be paid for a licence under these bye-law shall be as under]-

(2) The licence shall be renewable within a period of thirty days of its expiry on payment of fee at the above rates.
- An appeal lie to the Committee from any order of the licensing officer refusing a licence to any premises or cancelling or suspending a licence; provided that such an appeal is made within ten days from the communication of the order to the applicant or licensee as the case may be.
- Any person who commits or abets the commission of a breach of any of these bye-laws shall on conviction by a magistrate be punishable with a fine, which shall not be less than twenty-five rupees and more than two hundred rupees and when the breach is a continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
- All bye-laws relating to piggery in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed :
Provided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these by-laws.
