Haryana Municipal Betel Bye-laws 1976

- (1) These bye-laws may be called the Haryana Municipal Betel Bye-laws, 1976.
(2) They shall apply to all the municipalities.
- In these Bye-laws, unless the context otherwise requires, -
(a) "Act" means the Haryana Municipal Act, 1973;
(b) "betel" means the raw betel leaf or with condiments or seasoning for eating or chewing;
(c) all other words and expressions used herein but not defined shall have the meanings assigned to them in the Act.
- No person shall sell or expose for sale betels within the municipal area except in premises licensed in this behalf by the committee. The licence shall be issued by the Executive Officer or the Secretary, as the case may be, of the committee.
- No premises shall be licenced for the sale or exposure for sale of betels unless-
(a) it is provided with drainage arrangements duly connected with public drain ;
(b) a covered spittoon is provided at a corner of the premises ;
(c) a container with a proper lid is provided for the deposit of the refuse ; and
(d) a proper show-case with glass is provided for the display of betels.
- For a licence under bye-law 4, a fee of ten rupees per year shall be paid. No licence shall remain valid beyond the 31st day of March next following the date of issue.
- Any person who commits a breach or abets the breach of these bye-laws shall on conviction by a magistrate be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees, and when the breach is continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
- All bye-laws relating to sale or exposure for sale of betels in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed :
Provided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.
