No. G.S.R. 10/H.A.24/73/Section 257/82. - In exercise of the powers conferred by clause (zxi) of sub-section (1) of section 257 of the Haryana Municipal Act, 1973, and all other powers enabling him in this behalf and with reference to Haryana Government, Local Government Department, notification No. No. G.S.R.63/H.A.24/73/Section 257/78, dated the 16th June, 1978, the Governor of Haryana hereby makes the following rules, namely :-

  1. (1) These rules may be called the Haryana Municipal Accounts Committee Rules, 1982.

(2) They shall apply to all the municipal committees.

  1. (1) The State Government will constitute a committee consisting of official and non-official members at Divisional and District Headquarters to examine and discuss the annual accounts and the reports of the committees and to suggest remedial measures thereto.

(2) The Divisional Headquarter Municipal Accounts Committee (hereinafter called the Divisional Committee) shall be in respect of the committees of 'A' class municipalities and shall consist of :-

(4) The Administrators/Presidents of Committees of 'A' Class Municipalities Do
(5) The Executive Officers or Secretaries of Committees of 'A' Class Municipalities Do
(6) The Examiner, Local Fund Accounts, Haryana Member
(7) The Superintending Engineers, P.W.D., Public Health, having jurisdiction over the areas of 'A' Class Municipalities in the Division Members
(8) The Superintending Engineers, P.W.D. Buildings & Roads having jurisdiction over the areas of 'A' Class Municipalities in the Division Do
(9) The Divisional Town Planner of the Division Member
(10) The Director, Colonisation, Haryana Do

(3) The District Headquarter Municipal Accounts Committee (hereinafter called the district committee) shall be in respect of the committees of 'B' class municipalities and the 'C' class municipalities and shall consist of :

(6) The Executive Officers/Secretaries of Committees of *[C] class Municipalities and 'C' class Municipalities Do
(7) The Assistant Examiner, Local Fund Accounts Haryana Member
(8) The Executive Engineers, P.W.D., Buildings and Roads Branch in the district Members
(9) The Executive Engineers, P.W.D., Public Health in the district Do
(10) The District Town Planner or the Assistant Town Planner in this district, as the case may be Member
(11) The Deputy Director, Colonisation, Haryana Do

  1. The Commissioner of the Division in the case of Divisional Committee and the Deputy Commissioner in the case of District Committee may call any officer as a special invitee in regard to the matter concerning that Department.
  2. In the absence of the Commissioner, the senior-most Deputy Commissioner, in the division, and in the absence of the Deputy Commissioner, the senior- most Sub-Divisional Officer (Civil) in the district shall be the Chairman of the meeting of the Divisional Committee, and District Committee, respectively.
  3. The senior-most Deputy Commissioner in the division shall be the Secretary of the Divisional Committee and the seniormost Sub-Divisional Officer (Civil) in the district shall be the Secretary to the District Committee.
  4. The meetings of the Committees shall be held quarterly at the Divisional and District Headquarters, as the case may be
  5. The quorum for the meetings shall be fifty per cent of the members constituting the Divisional or District Committee.
  6. Notice of every meeting specifying the time and place and the business to be transacted at the meeting shall be sent by the Chairman to every member not less than seven days before the date of meeting.
  7. The Chairman of the Divisional or District Committee may, suitably modify, make additions to, if necessary, the items sponsored by the members of the Divisional or District Committee and allow new items to be included in the agenda at the time of meeting for discussions or disallow discussions on any item included in the agenda.
  8. (1) Minutes of the proceedings at each meeting shall be drawn up and recorded in the register to be kept for the purpose and shall be signed by the Chairman of the committee.

(2) Unless the Chairman, for reasons to be recorded in writing, deputes any other officer for the purpose, the minutes of the Divisional Committee shall be written and maintained by the Superintendent of the Commissioner's office and that of the District Committee by the General Assistant to the Deputy Commissioner.

(3) In addition to annual accounts, audit notes, pending audit objections, recovery of municipal dues, ways and means for the augmentation of the municipal resources, the committee may also examine and discuss the methods relating to removal of encroachments and any other item desired by the Chairman of the Divisional or District Committee and remedial measures (Civil) thereto.

  1. (1) As soon as any item on the agenda has been discussed finally, the Chairman shall, within a month, send instructions to all local bodies suggesting and detailing therein the various remedial measures, which in the opinion of the Divisional or District Committee are necessary to be taken up and implemented by them with a copy to the State Government, the Commissioners, the Deputy Commissioners and suggest Sub-Divisional Officers concerned.

(2) The Chairman of the Divisional or District Committee shall also categorise the remedial measures which require immediate attention by the State Government in one list and the suggestions and remedial measures which need further probe and decision by the State Government in another list and send the same to the State Government through a self-contained note and a wait further instructions thereon.

  1. The Municipal Committee on receipt of instructions from the Chairman of the Division or District Committee shall immediately take action accordingly and submit the compliance report to the quarter concerned within a month or at least report the progress made by it in this behalf during that period.
  2. Subject to the instructions issued by the State Government the decisions made and the instructions issued by the Divisional or District Committee under these rules then be final.
  3. The Divisional or District Committee may appoint one or more special sub-committees to examine and discuss any of the matters covered by these rules and the reports of the Municipal Committee and to give its findings or recommendations thereon.
  4. The sub-committee or sub-committees so appointed shall examine and discuss the matters entrusted to them at the headquarter in the division or the district, as the case may be, or within the jurisdictional area of the Committee concerned and submit report within a period of two months to the Chairman of the Divisional or District Committee for inclusion in the agenda.
  5. The members of the Divisional or District Committee shall draw their travelling allowance from the respective heads of accounts of their salary or out of the funds of the institution they belong, as the case may be.
