- (1) These bye-laws may be called the Haryana Municipal (Regulation of Tanks, Ponds, Wells and Baolis) Bye-laws, 1976.
(2) They shall apply to all the municipalities.
(3) These bye-laws shall apply only to those tanks, ponds, wells and Baolis from which water is or may be made available for the public and declared as such, by an order of committee.
- In these bye-laws, unless the context otherwise requires, -
(a) "Act" means the Haryana Municipal Act, 1973.
(b) "tanks, ponds, wells and baolis" means tanks, ponds, wells and Baolis declared as such under bye-laws 3.
(c) Words and expressions used herein but not defined in these bye-laws shall have the same meaning as are assigned to them in the Haryana Municipal Act, 1973.
- The committee may, by a public notice fixed near a tank, pond, well or Baoli, prohibit, either permanently or temporarily, for a specified period, the lowering of private receptacles for drawing water from such tank, pond, well or Baoli.
- No person shall, -
(a) throw any rubbish, filth or any other unwholesome or objectionable article into a tank, pond, well or Baoli;
(b) wash or soak skins, leather or any other dirty substance in a tank, pond, well or Baoli;
(c) permit water from a drain to flow into a tank, pond, well or Baoli.
- No person shall, in the open space within a radius of thirty metres of a tank, pond, well or Baoli, -
(a) place any rubbish or filth or any other unwholesome or objectionable articles;
(b) each himself of urinate;
(c) in the case of a tank, pond, well or Baoli the water of which is used for drinking purposes, wash any clothes or utensils or water any animal.
- No water shall be used for filling a tank unless it is obtained from a source, and conveyed through a channel, approved by the committee.
- No person shall bathe on, or within a distance of ten feet of, a well or a Baoli.
- The owner or person in charge of a well, tank, pond or Baoli shall carry out such measures as the Committee or the Medical Officer of Health or any other Officer authorised in this behalf by the committee, may prescribe for preventing the pollution of water in such a well, tank pond or Baoli.
- When so required by the committee, the owner or person in charge of a well, tank, pond or Baoli -
(a) shall build, of the type and the material specified, a drain or a cistern or shall make pacca floor to provide for dairy water to flow off and to prevent the flow of surface water or the water of any drain into the well;
(b) shall provide the well with a suitable covering to prevent pollution from natural causes such as the falling in of leaves or fruits of trees or the excreta of birds;
(c) shall provide the well with a parapet wall of the size and type specified;
(d) shall provide a metal receptacle for raising water for drinking purposes, attached to a metal chain, shall always be above the surface of the water;
(e) shall render the lining of the well impervious to contamination from sub-soil water.
- The owner or person in charge of a well, tank, pond or Baoli shall, when so required by the committee, have it cleaned or repaired to the satisfaction of the committee. In default, the committee may have the work performed through its own agency and recover the expenses from the person concerned.
- The Executive Officer or Secretary or the Medical Officer of Health or any other officer authorised in this behalf by the committee may, at all times, inspect any well tank, or Baoli, or its source of water supply.
- Any person who commits or abets the commission of, a breach of any of these bye-laws shall, on conviction by a Magistrate, be punishable with a fine which shall not be less than twenty-five rupees, and more than two hundred rupees, and when the breach is continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
- All bye-laws relating to the regulation of tanks, ponds, wells and Baolis in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed:
Provided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.
