  1. (1) These bye-laws may be called the Haryana Municipal (Regulation of Plying Carts and Rehris Drawn or Propelled by Men) Bye-laws, 1976.

(2) They shall apply to all the municipalities.

  1. No person shall keep for hire or cause to ply for hire or keep for private use within the limits of a municipality any cart or rehri drawn or propelled by one or more men except under a licence granted in this behalf by the committee.
  2. (1) A licence to keep for hire or cause to ply for hire or to keep for private use any cart or rehri which is owned, driven or let out on hire shall be issued by the Executive Officer or Secretary or any other officer so authorised by the committee, on the application of the proprietor of any such cart or rehri on payment of the fees specified in bye-law 5 and on the conditions detailed in bye-law 6:

Provided that the Executive Officer or Secretary or any other officer authorised in this behalf shall issue no licence in respect of any such cart or rehri unless and until the cart or rehri has been inspected and approved by the Executive Officer or Secretary or any other officer so authorised by the committee.

(2) At the time of issue of a licence, the Executive Officer or Secretary or any other Officer, so authorised, shall give to the proprietor of the cart or rehri a number-plate to be affixed to the Cart or Rehri, on payment of the price thereof.

  1. Every licence issued under bye-law 3 shall expire on the 31st March, following the date of its issue.

[5. The fees for the licences shall be as under :-

(i) Cart drawn or propelled by one man .... Rs. 1.00 per annum*
(ii) Cart drawn or propelled by two or more men .... Rs. 1.00 per annum*
(iii) Rehri ... Rs. 6.00 per annum*

[5A. In case an application for renewal of licence is made after the expiry of the licence an additional fee at the rate of one rupee per annum shall be charged.]

  1. Every licence issued under bye-law 3 shall be granted subject to the following conditions:-

(a) that the cart or rehri in respect of which the licence is granted shall be kept at all times in good repairs;

(b) that the person incharge of the cart or rehri which is licensed for plying on hire shall not except for reasonable cause, refuse to let it for hire;

(c) that the person incharge of the cart or rehri and his assistant, if any, shall help in loading and unloading it if required by the hirer to do so;

(d) that no person while plying or attempting to ply a cart or rehri shall be under the influence of drink or drug to such an extent as to be incapable of exercising proper control over the cart or rehri and shall not sleep or make use of any insulting, abusive or obscene language or gestures when plying for hire and shall not stand or loiter or cause a traffic hazard with the cart or rehri upon any public street or places elsewhere than any place which may be declared by the committee as a stand for licensed carts or rehris and shall not refuse to give way to any carriage when reasonably required to do so;

(e) that the person incharge of the cart or rehri shall conduct his cart or rehri on the extreme left of the road in a line with and in rear of any other cart or rehri proceeding in the same direction, and shall not in any way make attempts forcibly to pass any cart or rehri immediately in front of his cart or rehri;

(f) that when loading or unloading a cart in a street or selling products displayed in the rehri, the person incharge thereof shall keep it parallel with and immediately at the edge of street;

(g) that when plying in the dark the cart or rehri shall have four cat's eyes or red reflectors fixed on the back side and two cat's eyes or red reflectors on the front side. These reflectors shall -

(i) be kept clean at all times; and

(ii) not be covered by luggage or other goods the cart/rehri;

(h) that when plying after the sunset, the cart or rehri shall have attached to it a lantern in such a position as to be conspicuous from front and from behind;

(i) that the licensee shall not employ any person of less than seventeen years and more than fifty years of age to drive or to be incharge of the cart and that the licensee shall obtain a certificate from a registered medical practitioner as to the age and physical fitness of such person before employing him for the purpose;

(j) that the cart or rehri shall not be loaded with a load in excess of the maximum load prescribed in bye-law 8;

(k) that the cart or rehri when carrying load shall carry warning signal such as red flag by day and red light lanterns by night at the extremities of the load projecting from the body of the cart or rehri;

(l) that for a breach any of these conditions, the licence may be suspended or cancelled by an order in writing to be signed by the Executive Officer or Secretary or any other officer so authorised by the committee.

  1. Every person incharge of a licensed cart or rehri shall at all times, when plying for hire have with him the licence for the cart or rehri as the case may be and shall if required to do so, produce such licence to hirer, and shall, when called upon to do so by any magistrate, member of the committee, or officer of the committee authorised in this behalf, stop his cart or rehri and produce the licence to such magistrate, member or officer of the committee and state his name and residence and those of proprietor of the cart or rehri.
  2. (1) The maximum load to be carried by any cart plying for hire or rehri within the municipality shall be as follows :-
Kilograms
(i) for a cart drawn or propelled by two or more men 400
(ii) for a cart drawn or propelled by one man 200
(iii) for a rehri 150

(2) No person shall load or cause to be loaded any cart or rehri with a load in excess of the maximum load prescribed for such cart or rehri in clause (1).

[9. (1) No licence issued under these bye-laws shall be transferable. When a licensee changes his occupation or transfers the possession or ownership of the licensed vehicles, he shall report such change or transfer, as the case may be, and surrender his licence for cancellation to the committee within a period of seven days of such change or transfer. On surrendering the licence the committee shall refund to the licensee such portion of the fee as relates to the unexpired period of the licence.]

(2) The original licensee shall, until such transfer is reported and such name is substituted in the licence, be held liable as proprietor of the cart or rehri for the non-compliance of these bye-laws.

  1. Any person who commits or abets the commission of, a breach of any of these bye-laws shall, on conviction by a magistrate, be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees and if the breach is a continuing breach, with a further fine of ten rupees for every days after the first during which the breach continues.
  2. All bye-laws relating to Hand Carts and Rehris in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed :

Provided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.
