  1. (1) These bye-laws may be called the Haryana Municipal (Regulation of Places of Public Resort, Recreation and Amusement) Bye-laws, 1976.

(2) They shall apply to all the municipalities and parks including children's parks, public gardens and play grounds maintained or owned by the committees.

  1. In these bye-laws, unless the context otherwise requires, -

(a) "Executive Officer" means the Executive Officer of the Committee;

(b) "premises" means the parks including children's parks, public gardens and play grounds;

(c) "Secretary" means the Secretary of the committee.

  1. (1) The Executive Officer or the Secretary of the committee may, by a written order, fix the hours during which the premises shall remain open to the public. The Executive Officer or the Secretary, as the case be, may also cause notice boards specifying such hours to be fixed at the gates or some other conspicuous places within or about such premises.

(2) Entry to the premises and exit from them shall be made only through the gates provided for the purpose and not otherwise.

(3) The children's parks shall be maintained for the amusement and recreation of children only below the age of twelve years. No person above the age of twelve years shall, without the written permission of the Executive Officer or Secretary, as the case may be, enter upon or remain in any of the children's parks :

Provided that bona fide attendants of the children may accompany the children into these parks but they shall not use the equipment provided or installed by the committee for recreation of the children nor shall play any games with any person including their wards except when and to the extent, it is necessary to do so to amuse such wards.

(4) The Executive Officer or the Secretary, as the case may be, may, by a written order, authorise any municipal or Government employee to turn out by force persons committing breach of clause (3).

(5) Any person, major or minor, who is found committing nuisance, throwing rubbish, waste or other things on the premises or who has misbehaved or is otherwise considered undesirable, may be asked by the person incharge of the premises to leave and get out of the park forthwith failing which he may be removed out of the premises by force.

  1. No short cuts across grass lawns in the premises shall be allowed.
  2. No bi-cycles shall be allowed in the parks and gardens.
  3. No riding or loading of horses in this premises, except of children's ponies when led by a syce or attendant or to horses being ridden on or lead directly to or from a ride for children, shall be permissible.
  4. Motor cars and motor cycles may enter the gardens and parks, only by roads provided for the purpose and marked by notices as such. Entry of vehicles, of other description, into the parks and gardens shall be prohibited.
  5. Grazing in the premises shall be prohibited.
  6. Plucking of flowers and foliage and damage to buildings, trees, turf, goal posts, benches, racks, notice boards, swings and any other description of municipal property in the premises shall be prohibited.
  7. Holding of public meetings, demonstrations and organised gatherings of all kinds in the premises shall be prohibited :

Provided that the Executive Officer or Secretary, as the case may be, may on payment of fee of twenty rupees by the applicant, authorise the holding of any such meeting in a park and garden only.

  1. No private social or private religious functions, including tea parties, receptions, etc, shall be held in any park or garden without permission in writing of the Executive Officer or Secretary, as the case may be, and without payment of fee of twenty five rupees. The committee may also charge reservation fee fixed by it in this behalf.
  2. Lighting of fires and the hawking or vending of any article in the premises shall be prohibited.
  3. No person shall throw, deposit or leave any paper, litter or refuse anywhere in the premises except in the receptacles provided for the purpose. No person shall be allowed to bathe or watch clothes in the premises.
  4. Cricket, football, hockey and other organised games likely to damage plants and turf in the premises shall not be allowed except on the grounds earmarked and allotted for the purpose.
  5. No sports club or individual shall use the play-grounds or tennis courts in the premises without the written permission of the Executive Officer or the Secretary, as the case may be, and without payment of the ground rent fixed by the committee.
  6. Any person who commits, or abets the commission of, a breach of any of these bye-laws shall, on conviction by a magistrate, be punishable with a fine, which shall not be less than twenty-five rupees and more than two hundred rupees, and if the breach is continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
  7. All bye-laws relating to places of public resort, recreation and amusement in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed:

Provided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.
