Haryana Municipal (Regulation of Flour Mills) Bye-laws, 1976

- (1) These bye-law, may be called the Haryana Municipal (Regulation of Flour Mills) Bye-laws, 1976.
(2) They shall apply to all the municipalities.
- In these bye-laws, unless the context otherwise requires, -
(a) "Act" means the Haryana Municipal Act, 1973;
(b) "Executive Officer" means the Executive Officer of a municipal committee;
(c) "Secretary" means the Secretary of a Municipal Committee.
- No person shall run a flour mill at any place within the limits of a municipality except in the premises licensed by the committee in this behalf.
[4. Licences for premises for flour mills shall be issued by the Executive Officer or the Secretary, as the case may be, on the application of the owner or occupier of such premises in the form appended to these bye-laws on payment of a fee at the following rates] :-

(a) Flour Mills having motor upto fifteen horse power | Rupees fifty per annum of five rupees per mensem if the licence is taken for a period of less than one year. |
(b) Flour Mills having motor above fifteen horse power. | Rupees one hundred per annum or ten rupees per mensem if the licence is taken for a period of less than one year |
[4A. (1) Unless previously suspended or revoked, a licence under these bye-laws shall be renewable on payment of a fee prescribed under bye-law 4.
(2) In case an application for the renewal of licence is not made before the expiry of the licence, an additional fee at the following rates shall be charged :-]

(ii) if the application is made after ten days but within one month of the date of the expiry of licence | 10.00 |
(iii) if the application is made after one month of the date of the expiry of the licence | 15.00" |
- The person to whom a licence has been refused, may appeal in writing to the committee against the order of the Executive Officer or Secretary as the case may be, refusing the licence within a period of thirty days of the communication of the order. The decision of the committee shall be final.
- (1) The licence issued under bye-law 5 shall be subject to the conditions specified in clause (2).
(2) The person to whom a licence has been granted, his agent or workmen or other person in-charge of the flour mill shall -
(a) permit any member of the committee, the Executive or Secretary, the Medical Officer of Health or any other officer authorised in this behalf by the committee, to enter into and inspect the premises at all reasonable times and without any notice;
(b) make adequate arrangement to the satisfaction of the committee for the extinction of any out-break of fire;
(c) keep the peremises at all times in a clean and sanitary condition and provide them with adequate drinking water facilities, ventilation, suitable drains, latrines, urinals and other sanitary convenience for the use of workmen employed therein;
(d) not permit any work which gives rise to offensive noises to be carried on at the premises between sunset and sun-rise without the special permission of the committee in this behalf;
(e) affix a silencer in the exhaust pipe in such a way as to prevent the emission of any disagreeable sound;
(f) store in a suitable room which shall be rat free and used for no other purposes, all grains received for milling and flour products so long as they remain in the premises;
(g) make such arrangements for the effective disposal of offensive waste products of the process of manufacture as may be directed by the committee.
- For breach of any of the conditions contained in clause (2) of bye-law 6, the licence granted may be suspended or revoked by an order of the committee and the flour mill in respect of which this permission is suspended or revoked shall not be worked any longer.
- Any person who commits, or abets the commission of, a breach of any of these bye-laws shall, on conviction by a magistrate, be punishable with a fine which shall not be less than twenty five rupees, and more than two hundred rupees, and if the breach is continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
- All bye-laws relating to the regulation of flour mills in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed:
Provided that any order made or action taken under the bye-law so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.

Licence for Premises for Running Flour Mill
The premises of which description is given in the sub-joined Schedule situated in_____________(Name of street, ward etc.,) are hereby licenced for running flour mill.
The licence is granted of Shri______owner/occupier of the said premises for a period of______with effect from___on payment of a sum of Rs.___as licence fee.
