  1. (1) These bye-laws may be called the Haryana Municipal (Regulation of Dhobi Ghats) Bye-laws, 1976.

(2) They shall apply to all the municipalities.

  1. No person shall make use of a Municipal Dhobi Ghat, unless he is in possession of a licence for the purpose. A licence can be obtained from the Municipal Medical Officer of Health (hereinafter called the Licensing Officer). The conditions printed on the reverse of the licence form shall be deemed to be a part of these bye-laws. When an application for a licence has been sanctioned the applicant shall be called upon to pay the prescribed fee and to produce a recent photograph of himself of the size 1½"x 1½" to be pasted on the licence. On receipt of the amount of fee and the photograph, the Licensing Officer shall cause a licence to be issued in the prescribed form :Provided that if the applicant fails to pay the prescribed fee and produce his photograph within one month from the date on which intimation is sent to him that his application has been sanctioned, no licence shall be issued to him except in pursuance of a fresh application and his original application shall be deemed to have been refused :

Provided further that a Dhobi's child under the age of 14 years shall be exempted from taking out a licence when he works on his father's or mother's licence only in his father's or mother's absence from the Ghat.

  1. The licence fee shall be [three]rupees per month or [thirty] rupees per year. The charges for water consumed shall be fixed by the committee on an ad hoc basis in consultation with the Deputy Commissioner.
  2. (1) No licence shall be issued for a period of more than one year or for less than one month, and subject to these limitations, licences shall be issued for such periods as the applicants may desire :

Provided that no licence shall be valid beyond the 31st day of March next following the date of its issue.

(2) The committee may, in its discretion, get the licences issued for-

(a) the summer season (1st April to 30th September) ;

(b) the winter season (1st October to 31st March) ;

(c) for the whole of the year (1st April to 31st March) ; or

(d) from month to month, as may be convenient, having regard to the circumstances of each applicant.

  1. When an application for a licence is refused, the reasons in writing for such refusal shall be communicated to the applicant.
  2. A licence may, at any time after due notice is given to a licence, be cancelled for a breach of any condition on which it is granted. In the event of such cancellation the licensee shall not be entitled to any refund of any portion of the licence fee.
  3. No licence shall be transferable, and if the licensee changes his occupation he shall report such change and surrender his licence to the Licensing Officer within fifteen days from the date of such change and the Licensing Officer shall cancel the licence and may issue a fresh licence to another person :

Provided when a licence is surrendered under this bye-law, the committee shall refund to the licensee such portion of the fee as may be deemed to cover the unexpired period of the licence.

  1. No person shall erect a Dhobi Ghat or use any public place, water-course, pond, or municipal water-post for washing of clothes without the previous permission of the committee in writing.
  2. No person shall make use of any Dhobi Ghat for bathing or for watering.
  3. No person shall deposit any litter or rubbish or commit any nuisance within fifty yards of a Dhobi Ghat.
  4. No person shall make use of a Dhobi Ghat in such a manner as to cause the water to run to waste.
  5. No person shall wash or cause to be washed at a Dhobi Ghat any clothing which is known to have been exposed to infection.
  6. No person who is suffering from any infectious or contagious disease or from open sores shall use a Dhobi Ghat.
  7. The Municipal Dhobi Ghats shall remain open for use during the day time as under :-

(1) winter, from 0600 hrs. to sunset ;

(2) summer, from 0400 hrs. to sunset.

  1. Dhobi Ghats will be closed during the night.
  2. Wastage of water in Dhobi Ghats must be avoided and taps should be turned off when a Ghat is not being used.
  3. Clothes shall not be spread for drying in public streets and open parks.
  4. No person shall be authorised to sue a municipal Dhobi Ghat without having the necessary licence in his possession. He shall produce the licence for inspection, on demand on the Ghat by a person authorised by the committee to make inspection of the municipal Dhobi Ghat.
  5. Any person who commits, or abets the commission of a breach of any of these bye-laws or any of the conditions forming part of the licence shall on conviction by a magistrate be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees, and if the breach is continuing breach with a further fine of ten rupees for every day after the first during which the breach continues.
  6. All bye-laws relating to the regulation of Dhobi Ghats in force in the municipalities, immediately before the commencement of these bye-laws, shall stand hereby repealed :

Provided that any order made or action taken under the bye-law so repealed shall be deemed to have been made or taken under the corresponding provision of these bye-laws.

Conditions

  1. Use of municipal Dhobi Ghat without a licence is prohibited and the use of a Ghat not authorised by the committee is prohibited.
  2. An annual, half yearly or monthly licence can be obtained on application to the Municipal Medical Officer of Health.
  3. Fees for such licence shall be paid within one month of the receipt of the Medical Officer of Health's sanction to the grant of such licence and must be accompanied by a photograph of the applicant, size 1½"x 1½". If fees are not paid and a photograph is not produced within one month, a fresh application for a licence must be made.
  4. A licence is not transferable and on transfer of occupation a licensee shall surrender his licence for cancellation.
  5. Municipal Ghats shall not be used for bathing or for watering or for washing animals.
  6. No person shall deposit any litter or filth or commit any nuisance within fifty yards of a Ghat.
  7. Tap water must no account be allowed to run to waste.
  8. No clothing known to be infected or which has been exposed to infection shall be washed at the Ghat.
  9. A person suffering from any infectious or contagious disease or from open sores shall not use the Ghat.
  10. A licensee must have his licence in his possession for production on demand at the Ghat by any duly authorised officer of the committee.
  11. Clothes shall not be spread for drying in public streets or in open places and parks.
  12. A Dhobi's child under the age of 14 years is exempted from taking out a licence or from producing a photograph of himself when he works on his father's/mother's licence in the father's or mother's absence from the Ghat.
  13. The committee reserves the right of fixing the hours for the use of Ghats. Ghats are closed from sunset to 4.00 a.m. from 1st April to 30th September and from sunset to 6 00 a.m. from 1st October to 31st March.
  14. The licence may, at any time after due notice is given to the licensee be cancelled for a breach of any condition governing the grants of such licence and in the event of such cancellation, no refund shall be made of any portion of the licence fee. A breach of any abetment of a breach of any of the conditions and of the relevant bye-laws is punishable on conviction by a magistrate.
