  1. Short title and application.- (1) These rules may be called the Haryana Municipal (Formation and Working of Fire Brigade) Rules, 1985.

(2) These shall apply to all municipalities in the State of Haryana.

  1. Definitions.- In these rules, unless the context otherwise requires.-

(a) "Act" means the Haryana Municipal Act, 1973;

(b) "Government" means the Secretary to Government, Haryana, Local Government Department;

(c) "Fire Officer" means an office appointed by the Government to perform the duties of a Fire Officer;

(d) "Fire Station Officer" means a person appointed by the Government to perform the duties of a Fire Station Officer;

(e) "Mechanical Foremen" means a person appointed by the Government to perform the duties of a Mechanical Foreman;

(f) "Committee" means the municipal committee constituted under the provisions of the Act and shall include such other person appointed under sections 251 or 254 of the Act to exercise and perform the powers and duties of the Municipal Committee.

  1. Fire fighting equipment.- The Fire Officer/Mechanical Foreman shall be the technical adviser to all the Committees on Fire fighting equipments and personnel. The Fire Officer/Mechanical Foreman shall cause inspections with such tests as may be necessary to be carried out on the fire fighting equipments of committees to ensure that the fire fighting equipment is of proper and suitable design and construction and in working order.
  2. Maintaining of fire brigade etc.- Every A class committee shall maintain a fire brigade along with requisite equipment and personnel and B class or C class committee may at its option maintain fire brigade.
  3. Sanctions of municipal officers.- (1) The Fire Station Officer of the Committee shall be responsible for the proper upkeep, maintenance, training discipline and quick turnout of the fire brigade.

(2) The Executive Officer, or in his absence the Secretary of the Committee shall deal with all financial and administrative matters pertaining to the fire brigade.

(3) The Fire Station Officer and the leading fireman shall be responsible for directing all fire fighting officers whenever the fire brigade is called for service.

(4) In the event of a number of fire brigades being involved in a fire fighting operation the Seniormost Fire Station Officer shall conduct the operations and be responsible for the fire fighting operations.

  1. Maintenance of equipment, engines trials and practices.- (1) The fire brigade, its appliances and inventories shall be inspected at least once a week by the Fire Station Officer who shall make at least two test calls every month at irregular timings.

(2) The fire brigade, its appliances and inventories shall be inspected at least once a month by the Executive Officer or the Secretary of the Committee who shall give a test alarm at irregular timings.

(3) The Fire Officer shall inspect the fire brigade of each committee once in a quarter and his inspection report would be sent to concerned committee for necessary action.

(4) The Mechanical Foreman shall inspect the fire units in order to maintain and fix up the fuel consumption and for removing the defects of the unit once in six months.

(5) Every committee having more than four fire units shall maintain a workshop for re-unioning and repair of fire appliances.

  1. Water supply.- In the order to get sufficient water supply for fire fighting, the committee shall make provisions for fire hydrants. For this purpose the Fire Officer shall provide necessary advice to the committee, and the Public Health Department of the State.
  2. Fire Station building and staff accommodation.- Every Committee shall construct or expand the existing Fire Station building as per the standard design approved by the Government, and modified from time to time.
  3. Submission of fire report.- Every committee shall send a report of an incident of fire to the Fire Officer and the Deputy Commissioner within seventy-two hours of such incident. Monthly reports pertaining to fire incidents duly verified and countersigned by the Executive Officer or Secretary of the Committee shall be sent to the Fire Officer before the 5th of every month.
  4. Training.- Every Committee shall also provide requisite in-service training to the persons appointed in the fire brigade from time to time.
  5. Fire charge and recoveries thereof.- (1) No charge shall be levied by the committee on the owner or occupier of land of buildings within municipal limit for the attendance of the fire brigade for extinguishing fire or rescue job :

Provided that the Committee may enter into contract with the Insurance Company for the payment of the actual expenses of the fire brigade in attending and extinguishing fire on land and building insured by the Company.

(2) The Committee may, by a general order, authorise the Fire Station Officer to depute on demand the fire bridge beyond municipal limits for extinguishing fire outside such limits and the committee may make a charge for its services.

(3) In case of rural fire the charges may be recovered from Panchayat or Panchayat Samiti concerned. The committee may, however, write off the charges if considered in public interest in accordance with provision of rule XVII 13 of the Municipal Account Code, 1930.

  1. Repeal and saving.- The Fire Brigade Rules, 1925, are hereby repealed:

Provided that any order made or action taken under the rules so repealed shall be deemed to have been made or taken under the corresponding provision of these rules
