Haryana Municipal (Delegation of Powers for the Execution of Contract) Rules, 1981

  1. Short title and extent.- (1) These rules may be called the Haryana Municipal (Delegation of Powers for the Execution of Contracts) Rules, 1981.

(2) These rules shall apply to all the municipalities in the State of Haryana.

  1. Delegation of powers and restrictions.(Section 49). - (1) No delegation in respect of the following classes of contracts shall be made by the committee namely :-

(a) alienation of municipal properties;

(b) collection of octroi;

(c) engaging the services of legal advisers, Labour advisers and architects;

(d) contract for the execution of development works; and

(e) purchases of the value or amount of which exceeds Rs. 50,000, Rs. 20,000 and Rs. 10,000 in respect of A, B & C class committees, respectively.

(2) The powers in respect of entering into the following classes of contracts shall be delegated to not less than five members of whom one shall be the President or the Vice President, namely :-

(a) purchases of the value or amount exceeding Rs. 20,000 but not exceeding Rs. 50,000 in respect of A class committees and exceeding Rs. 10,000 but not exceeding Rs. 20,000 in respect of B class committees;

(b) lease of lands, shops, buildings and other immovable property;

(c) lease of sullage water;

(d) contract for the removal of dead animals;

(e) contract for the removal of rubbish;

(f) contract for annual maintenance and repairs of water stand posts and hand pumps;

(g) supply of petrol, diesel and lubricants; and

(h) repair of vehicles.

(3) The power in respect of entering into the following classes of contracts shall be delegated to not less than two members, namely :

(a) contract for bicycle stand;

(b) contract for canteen; and

(c) supply of charcoal.

  1. Instruments of contract to bear an official seal of the committee.(Section 49) - Every instrument of contract executed on behalf of a committee shall bear the official seal of the Committee.
