Haryana Municipal (Control of Traffic) Bye-laws, 1976

- (1) These bye-laws shall be called the Haryana Municipal (Control of Traffic) Bye-laws, 1976.]
(2) They shall apply to all the municipalities.
- No person shall take an elephant along a street or road without the previous sanction in writing of the Superintendent of Police concerned.
- No person under the age of fifteen years unless accompanied by a competent instructor, shall drive a vehicle of any description drawn by an animal.
- No person shall take a cart used for carrying bricks, kankars, earth, stone, metal, or other loose material along any public road or street unless the cart is protected by side, front and back-board which shall be at least six inches higher than the level of the material in the cart.
- All persons, including the driver, incharge of any vehicle loaded with bamboos, planks, girders, pipes, iron bars or any other material projecting beyond the rear of the vehicle or on either side of it, shall provide during day time a red flag and a circular white printed metal discover twelve inches in diameter fastened to the end of the largest projections and during night time a red light at some conspicuous place on the rear of the vehicle, and will turn the vehicle only after taking all precautions to safeguard the safety of the nearby traffic and after giving clear and adequate indication of the intention to do so.
- Drivers of all vehicles, and cyclists shall obey all signals of police officers directing traffic.
- Drivers of all vehicles, and cyclists shall obey all directions issued by the committee and conveyed by signs or notices fixed at the side of or marked on the surface of the public roads in the municipality.
- (i) The drivers of all vehicles and all persons in charge of animals passing along any public road or street shall keep to the left or rear side, unless there be reasonable cause for divergence and shall pass other vehicles or animals in front to the right of such vehicles or animals.
(ii) Vehicles entering or crossing a main road from a side road shall give way to traffic in the main road and come to a halt and not move on until signalled to do so if there is arrangement for such signal or or until the way is clear.
(iii) Drivers of vehicles wishing to stop, turn or slow down shall give proper signals well in time in order to indicate their intention to traffic in front or rear. When turning about drivers shall invariably turn to the right.
(iv) A vehicle on entering a circle will turn to the left and travel on the circumstances of the circle until reaching its deviation point when it will again turn to the left.
- The drivers of all conveyances shall, unless there be some reasonable cause for not doing so, stop by pulling up at the extreme side of the road, street or thoroughfare along with the conveyance is proceeding.
- No person shall keep any animal or conveyance of any kind standing longer than it is necessary for loading or unloading or for taking up or setting down passenger or leave any conveyance in such a manner as to cause inconvenience to the public in any road, street or thoroughfare.
- No person shall cause any vehicle to stand in a narrow street except in a portion thereof as shall admit the passage of two vehicles abreast each other and in such a way that a passage is left for a second vehicle.
- While loading or unloading a cart in a street, the person incharge of the cart shall cause it to stand parallel with the footpath and immediately on the edge of the carriage way, or if there is no footpath, then parallel with and immediately on the edge of the street.
- (1) No driver of any vehicle except a motor vehicle shall keep on his vehicle any horn of the kind usually kept for warning purpose on motor vehicles.
(2) The committee may, from time to time, by a resolution passed in a special meeting declare that specified areas of roads shall be treated a silence zones. Such specified areas shall be notified to the public in the manner, the committee may deem fit.
(3) No person or driver of any vehicle including a motor vehicle shall blow horn or create noise by any other contrivance in an area or on a road which has been declared as a Silence Zone under the provisions of clause (2).
- No person shall drive any vehicle on a public road or street after sunset unless the vehicle carries a light or lights are placed as follows :-
(i) for bicycles and tricycles, one bright light affixed to the machine in front;
(ii) for Ekkas, Thelas, bullock-carts or hand carts, one bright light placed on the right hand side of the vehicle visible from front; and
(iii) for all other vehicles one bright light placed on each side of the vehicle and visible from the front.
Note :- For the purpose of this bye-laws "lighting up" notices exhibited in the street by the Superintendent of Police shall be taken as determining at what time it becomes dark.
- No person riding on a bicycle in any street or public place shall carry any other person on the same bicycle except a child below the age of the twelve years.
- Cyclists shall be prohibited from riding more than two abreast each other.
- No person on a cycle shall be towed by any motor vehicle or horse drawn vehicle.
- Every bicycle shall possess a bell and brake both in good working order and shall have a red reflector (ruby light) on the back or have its rear mud- guard painted white at least six inches from its tail end.
- No person shall permit his cattle to stray on public streets.
- All cattle passing through the public streets shall be accompanied by drivers. There should at least be one driver to every ten heads of cattle.
- No person in charge of a vehicle or animal shall take his vehicle or animal or part of his vehicle on to any footpath ordinarily reserved for pedestrians.
- (1) Pedestrians shall always walk on the pavements or footpaths, wherever these are provided.
(2) No person shall cross the road except over the pedestrians crossing, where these have been suitably marked on the roads.
(3) The pedestrian shall always obeys the direction of Police Officers and of men engaged in the regulation or control of traffic on all public streets and thoroughfares.
(4) No pedestrian shall stop or remain on any pedestrian crossing longer than is necessary for the purpose of passing from one side of the road to the other.
(5) The driver of all vehicles approaching a crossing shall, unless he can see that there is no person on foot thereon proceed at such a speed as to be able, if necessary, to stop before reaching such crossing.
(6) The driver of every vehicle at, or while approaching a crossing, where the traffic is not for the time being controlled by police constable, or by a signalling device, shall allow free and an interrupted passage to any person on foot who is on the carriage way at such crossing and every such person on foot shall have precedence over all vehicular traffic at such crossing.
(7) No driver of any vehicle shall cause such vehicle or any part thereof to stop upon any crossing unless either -
(i) he is prevented from proceeding by circumstances beyond his control;
(ii) it is necessary for him to stop in order to avoid an accident.
(8) The driver of every vehicle at or approaching a crossing at a road intersection, where traffic is for the time being controlled by a police constable, or any signalled device, shall allow free and uninterrupted passage to every pedestrian who had started going over the crossing before the driver receives a signal that he may proceed over the crossing.
- No person shall drive or cause to be driven on the public highway a Thela which has any tyre less than 2½ inches wide or of which an axle is so worn as to cause unnecessary damage to the road.
- No person shall drive on any public road any Thela of which any wheel is less than 1 ft. 9 inches in diameter.
- No person shall, without the written permission of the Committee, drive or draw or cause to be driven or drawn on any public street or road in a municipality any tractor or other heavy vehicle having iron or steel wheels but not fitted with street plates or other mechanical safeguards to prevent damage to street, road.
Note :- This bye-law not apply to road rollers.
- No person shall park any vehicles at any place where parking may be prohibited by the committee by a resolution.
- No person shall smoke or light a match or a fire or carry or deposit a naked light within ten feet or a kerb side pump intended for the supply of dangerous petroleum as defined in section 2 of the Petroleum Act, 1899.
- The committee may be an order prohibit the overtaking to vehicles on a particular road or in a particular street generally or of class of vehicles by the same class, namely -
(i) a motor vehicle other than motor cycle rickshaw by another motor vehicle;
(ii) a motor cycle-rickshaw by another motor-cycle rickshaw;
(iii) a horse driven vehicle by another horse driven vehicle;
(iv) a bullock-cart or a hand cart by another bullock cart or hand cart.
- The committee may, from time to time, by a resolution passed in a meeting, declare that one way traffic may be observed at all times or during special hours of the day on specified areas or roads.
- No person shall, without the written permission of the committee, smoke out or cause to be smoked out the bees or in any other way disturb the bees- hives on any of trees on any streets, roads berms, public parks, public places or other places or buildings, vesting in the committee or on any other places or buildings up to a distance of the hundred feet from the centre of a public street or thoroughfare:
Provided that the committee may grant permission to smoke out bee-hives subject to payment of such fees as it may fix and such conditions as it may consider necessary to impose in the interest of public safety.
- Any person who commits or abets the commission of, a breach of any of these bye-laws, shall on conviction by a magistrate, be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees, and if the breach is a continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.
- All bye-laws relating to control of traffic, in force in the municipalities immediately before the commencement of these bye-laws shall stand repealed :
Provided that any order made or action taken under the bye-law so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.
