  1. Short title and application.- These bye-laws may be called the Haryana Municipal (Control and Regulation of Flaying and Disposal of Dead Animals) Bye-laws, 1988.

(2) They shall apply to all Municipalities.

  1. Definition.- In these bye-laws, unless the context otherwise requires :-

(a) "Act" means the Haryana Municipal Act, 1973;

(b) "Contract" means a contract given in the form appended to these bye- laws

(c) "Contractor" means a person to whom contract has been granted under these bye-laws.

  1. Disposal or flaying of dead animals.- No person shall dispose of or flay the dead animals of any sort within the limits of municipal committee except in accordance with the following conditions, namely :-

(a) Only such person shall be allowed to undertake the disposal of dead animals to whom the municipal committee may allot the works by contract (hereinafter called the contract) in the form in Appendix-A.

(b) The contract shall be granted in public auction after given wide publicity in the local newspapers of Hindi and Urdu and the notices shall also be displayed conspicuously at public places.

[(c) Every contract shall be executed for a period not exceeding three years and not less than one year commencing from 1st April and ending on 31st March next following.]

(d) The contractor shall open an information centre at the place approved by the Municipal Committee.

(e) The contractor and his employees shall have to obtain identification certificates from the Municipal Committee.

(f) The dead animals shall be carried over by the contractor on Rehra driven by a horse.

(g) No person shall erect masonry tomb or smadhi over the dead body of an animal within the municipal limit.

(h) The contractor shall not keep the bones of the dead animals in open.

(i) No dead body of the animal shall be disposed of or flayed by the contractor in any place other than the place fixed by the Municipal Committee.

(j) No unauthorised person shall remove the dead animals failing which the offender on prosecution by a magistrate shall be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees, and when the breach is continued; with a further fine of ten rupees for every day after the first during which the breach continues.

Agreement

This Agreement made this ________ day of ____________ between Municipal Committee __________ (hereinafter called the Municipal Committee which expression shall include his successors in office) of the one part, and Shri __________ s/o Shri _____________ resident of _________ (hereinafter called the contractor which expression shall include his heirs, executors, legal representatives of the other part.

Whereas the work of flaying and disposal of dead animals during the period from 1st April ________ to 31st March _________ within the municipal area of the Municipal Committee _________ has been allotted to the contractor.

The parties do hereby agree as under :-

  1. The contractor shall pay rupees _________ per dead animal which may be carried by him and shall be paid by him monthly/quarterly/biannually/yearly in equal instalments.
  2. The contractor shall open an information centre at the place approved by the Municipal Committee.
  3. The contractor and his employees shall have to obtain identification certificate from the Municipal Committee.
  4. The dead animal shall be carried over by the contractor on Rehra driven by a horse.
  5. The contractor shall not keep the bones of the dead animal in open.
  6. No dead body of the animal shall be disposed of or flayed by the contractor in any place other than the place fixed by the Municipal Committee.
  7. All works relating to flaying and disposal of dead animal to be executed under the contract shall be executed under the direction and subject to the approval in all respects of the Committee and shall be entitled to direct at what point or points and in what manners these are to be carried on.
  8. If any question, difference or objection arises out of this contract, the matters shall be referred to arbitrator to be appointed by the Director, Local Bodies, Haryana Government within _______________ months from the date of _______________ and if the matter is not referred to arbitrator within the said period, all the rights and claims under the contract shall be deemed to have been forfeited and an absolutely time-barred.
