Haryana Electricity Regulatory Commission (Conditions of Service of Chairman and Members) Rules, 1998

No. S.O. 111/H.A. 10/98/S.55/98. - In exercise of the powers conferred by Section 55 read with sub-section (2) of section 6 of the Haryana Electricity Reform Act, 1997, the Governor of Haryana hereby makes the following rules, regulating the conditions of the service of the Chairman and members of [he Haryana Electricity Regulatory Commission (hereinafter referred to as "HERC"), namely :-
- Short title and commencement.- (1) These rules may be called the Haryana Electricity Regulatory Commission (Conditions of Service of Chairman and Members) Rules, 1998.
(2) They shall come into force on the date of their publication in the official Gazette.
- Definitions.- In these rules, unless the context otherwise requires,
(a) " Act" means the Haryana Electricity Reform Act, 1997 (Act 10 of 1999)
(b) "Chairman" means the Chairman of the Haryana Electricity Regulatory Commission;
(c) Words and expressions used in these rules and not defined shall have the same meaning as assigned to them in the Act.
- Pay and allowances of Chairman and members.[Sections 6(2) and 55.] - (1) The Chairman shall receive a pay of Rupees 26,000 whereas the pay of other members shall be in the scale of Rs. 24,050-650-26,000 per month (corresponding to Grade level S-33 and S-32 respectively of the 5th pay commission), subject to deduction of the gross amount of pension including any commuted portion thereof if already getting.
(2) The Chairman and members shall be entitled to receive such dearness allowance and all such other allowances as may be admissible to the corresponding grade officers of the Indian Administrative Service posted in the State.
- Housing.[Sections 6(2) and 55.] - The members of the Commission would been titled to accommodation of status, admissible to corresponding Grade Officers of the All India Services posted in the State. In the event of such accommodation not being available for some reason, equivalent suitable accommodation shall be leased out for them subject to a maximum limit of Rs. 12,000 p.m. Payment for water and electricity charges would, however, be paid by the members themselves.
- Transport.[Sections 6(2) and 55.] - (1) Each member of the Commission shall be provided with staff car and a driver. Any member who may wish to use his personal car/driver shall be granted an additional allowance of Rs. 5,000 per month in lieu of both the staff car and the driver.
(2) The members of the Commission shall be entitled to use Government vehicle for private purpose as, applicable to corresponding grade officers of the Indian Administrative Service posted in the State.
- Travelling allowance.[Sections 6(2) and 55.] - (1) Journeys performed on duty within the State of Haryana or at the time of appointment/retirement the members of the Commission would be entitled to draw such travelling allowance and daily allowances as may be admissible to the corresponding grade officers of the Indian Administrative Service posted in the State.
(2) They shall also be entitled the benefits of Home/Leave Travel Concession as admissible; to the Corresponding grade officers of the Indian Administrative Service posted in the State.
(3) For journeys out side the State of Haryana, the Commission may fix the travelling allowance and daily allowance commensurate with their status and the cost of living at the place of travel.
- Medical.[Sections 6(2) and 55.] - The medical treatment of Chairman or a member and his family shall be provided in accordance with the rules which for the time being apply to the corresponding grade officers of the Indian Administrative Service posted in the State.
- Sumptuary allowance.[Sections 6(2) and 55.] - The Chairman and members shall be entitled to a sumptuary allowance at the rate of Rs. 1,000 (one thousand rupees) per month.
- Leave.[Sections 6(2) and 55.] - (1) The Chairman and members shall be entitled to earned leave at the rate or 15 days for every 6 months of completed service. In addition, they would be entitled to casual and other leaves as admissible to the corresponding grade officers of the Indian Administrative Service posted in the State.
(2) A member may be paid cash equivalent to leave salary and dearness allowance in respect of the period of earned leave at his credit at the time of conclusion of his term with the Commission subject to the following conditions, namely :-
(a) the admissibility and such payment shall be limited to a maximum period of one hundred and fifty days earned leave;
(b) the cash so admissible shall become payable on conclusion of his leave with the Haryana Electricity Regulatory Commission and be paid in one lump as a one time settlement; and
(c) the rate of leave salary and dearness allowances admissible under this rule shall be the same as admissible to a member for earned leave on the date of retirement and no compensatory allowance and/or house rent allowance will be payable;
- Pension.[Sections 6(2) and 55.] - The members would not be entitled to any pensionary benefits for the period of service rendered in the Commission.
- Miscellaneous.[Sections 6(2) and 55.] - (1) In respect of any matter for which special provisions is not made by these rules, the conditions of service of a person serving as the Chairman or a member of the Commission shall be governed by the rules and orders for the time being applicable to officers of The All India Services working under the State Government.
(2) The pay and allowances, leave, pension and other service benefits admissible to Chairman and members of the Commission under these rules shall not be varied to their disadvantage during their tenure.
