G.S.R. 191(E). - In exercise of the powers conferred by section 87, 98, 457 and 458 of the Merchant Shipping Act, 1958 (44 of 1958), the Central Government hereby makes the following rules, namely :-

CHAPTER I

General Provisions

  1. Short title and commencement.- (1) These rules may be called the Merchant Shipping (Standards of Training, Certification and Watchkeeping for Seafarers) Rules, 1998.

(2) These rules shall come into force on the 1st day of August, 1998.

  1. Application.- These rules shall apply to,-

(a) any candidate who is a citizen of India; and

(b) any other candidate who is not a citizen of India and is permitted by the Chief Examiner concerned to be examined, assessed and certified under these rules.

  1. Objective.- The objective of these rules is to give full effect of implementation to the provisions of International Convention on Standards of Training, Certification and Watch-keeping for Seafarers, 1978 as amended on the 7th day of July, 1995 and as adopted by International Maritime Organisation, London.
  2. Definitions.- (1) In these rules, unless the context otherwise requires,-

(a) "Act" means the Merchant Shipping Act, 1958 (44 of 1958);

(b) "Appropriate certificate" means a certificate issued and endorsed in accordance with the provisions of these rules and entitling the lawful holder thereof to serve in the capacity and perform the functions involved at the level of responsibility specified therein on a ship of the type, tonnage or power and means of propulsion indicated by the endorsement while engaged on the particular voyage concerned;

(c) "Approved" means approved by the Central Government;

(d) "Training and Assessment Programme" means the programme of training and assessment of seafarers as approved by the Central Government;

(e) "Assessment Centre" means a centre designated by the Director General of Shipping responsible for assessment of candidates and maintaining records for the purposes of assessment;

(f) "Certificate of competency" means an appropriate certificate issued by the Government of India for the purposes of rule 5;

(g) "Chief Examiner" means the Chief Examiner of Master and Deck Department personnel or the Chief Examiner of Engine Department personnel, as the case may be;

(h) "Company" means the owner of the ship or any other organisation or person such as the manager or the bareboat charterer, who has assumed the responsibility for operation of the ship from the shipowner and who, on assuming such responsibility, has agreed to take all the duties and responsibilities imposed on the company by the STCW Convention;

(i) "Examiner" means Principal Officer Nautical, Deputy Nautical Adviser, Nautical Surveyor or Principal Officer Engineering, Deputy Chief Surveyor, Engineer and Ship Surveyor, as the case may be, appointed under section 79 of the Act;

(j) "Form" means a form appended to these rules;

(k) "Month" means a month reckoned according to the British calendar. The time included between any given day in any month and the preceding day of the following month (both days inclusive) shall be reckoned as one month;

(l) "Near-Coastal Voyages" means the coastal trade or voyages from any port or place in Bangladesh, India, Maldives, Myanmar and Sri Lanka to any other port or place in these countries including proximity of safe havens on such voyages;

(m) "STCW Convention" means International Convention on Standards of Training, Certification and Watch-keeping for Seafarers, 1978 as amended on the 7th day of July, 1995;

(n) "STCW Code" means Seafarers' Training, Certification and Watch-keeping Code adopted by the 1995 conference of Parties to the STCW Convention;

(o) "Year" means a year reckoned according to the British calender.

(2) Words and phrases used in these rules and not defined but defined in the Act shall have the meanings respectively assigned to them.

  1. Issuance of certificate of competency.- (1) A Certificate of Competency may be issued for the following grades, namely:-

(i) Second Mate of a Foreign-going Ship;

(ii) First Mate of a Foreign-going Ship;

(iii) Master of a Foreign-going Ship;

(iv) Extra Master;

(v) Navigational Watch-keeping Officer;

(vi) Mate of a Home Trade Ship;

(vii) Master of a Home Trade Ship;

(viii) Marine Engineer Officer Class IV;

(ix) Marine Engineer Officer Class III;

(x) Marine Engineer Officer Class II;

(xi) Marine Engineer Officer Class I;

(xii) Extra First Class Engineer;

  1. Training and assessment.- (1) The Chief Examiner concerned shall ensure that the training and assessment of candidates for certification as a seafarer are administrered, supervised and monitored in accordance with the provisions of the Act, these rules and the STCW Code, (and those persons responsible for imparting the training and assessment as required under the STCW Convention, are appropriately qualified for the type and level of training and assessment of competence in accordance with the provisions of the Act, these rules and the STCW Code.
  2. Quality standards.- (1) The Chief Examiner concerned shall ensure that all the training, assessment of competence, certification, endorsement and revalidation activities under his authority are continuously monitored through a quality standards system including the qualifications and experience of instructors and assessors.
  3. Standards of medical fitness.- (1) Every candidate for certification as a seafarer shall provide satisfactory proof of the following documents to the Chief Examiner concerned, namely:-

(a) a valid passport;

(b) a certificate showing the date of birth; and

(c) a medical fitness certificate including eyesight and hearing as prescribed in the Merchant Shipping (Medical Examination) Rules, 1986.

(2) The standards of medical fitness for the candidates shall be the same as given in the Merchant Shipping (Medical Examination) Rules, 1986.

  1. Examination, assessment, certification and registration of certificates.- (1) The Director General of Shipping shall designate an Assessment Centre.

(2) The Assessment Centre shall -

(a) maintain records of all candidates with regard to their seagoing service, progress of ashore and on-board training. courses attended, examinations and assessments completed and certificates held by the seafarers;

(b) receive periodical returns of the progress of ashore and on-board training and also monitor such returns;

(c) examine the documentary evidence that the candidate has fulfilled the eligibility criteria for joining an approved training and assessment programme; and

(d) assist the Chief Examiner or Examiner concerned, as the case may be, in the conduct of written, oral and practical examinations and assessment on completion of the approved training and assessment programme for each function.

(3) Every seafarer shall carry all appropriate certificates in original while serving in a relevant capacity on board a ship in accordance with the applicable safe manning requirements as provided in these rules.

  1. Revalidation and upgrading of certificates.- (1) Every seafarer who holds an appropriate certificate in accordance with the Convention, the Act and the rules framed thereunder prior to the date of commencement of these rules, may apply for revalidation and upgrading during the transitional period of the STCW convention that is from the 1st day of February, 1997 to the 1st day of February, 2002 (both days inclusive). Such candidate shall,-

(i) meet the standards of medical fitness as prescribed in the Merchant Shipping (Medical Examination) Rules, 1986 and the STCW Code;

(ii) complete an approved refresher and updating course in accordance with section A-1/11 of the STCW Code;

(iii) be subject to scrutiny and assessment by an assessment centre; and

(iv) be issued with a certificate regarding complying with the requirements of the STCW Convention whereupon the earlier certificate shall be withdrawn.

(2) Every seafarer holding an appropriate certificate who is serving at sea or intends to return to sea for service after a period ashore in order to continue to qualify for sea-going service, at intervals not exceeding five years, shall -

(i) meet the standards of medical fitness as prescribed in the Merchant Shipping (Medical Examination) Rules, 1986 and the STCW Code:

(ii) establish continued professional competence by attending an approved revalidation course in accordance with section A-1/11 of the STCW Code:

(iii) be subject to scrutiny and assessment by an assessment centre; and

(iv) be issued with an endorsement revalidating the candidate's certificate.

  1. Indian Naval officers.- Indian Naval officers holding valid certificates of service issued prior to coming into force of the Merchant Shipping (Examination of Masters and Mates) Rules, 1985 and Merchant Shipping (Examination of Engineer Officers in the Merchant Navy) Rules, 1989 who intend to become holders of a certificate of competency complying with the requirements of these rules shall be required to complete approved training and assessment programme prior to issuance of a certificate of competency. Such candidate's existing experience, qualifications and certificates shall form the basis for determining qualifying merchant ship sea-going service as per approved training and assessment programme.
  2. Responsibilities of the company.- (1) The company shall provide written instructions to the Master for policies and procedures and be responsible for the assignment of seafarers for service in their ships in accordance with the provisions of these rules and the STCW Convention and it shall ensure that -

(a) each seafarer assigned to any of its ships holds an appropriate certificate in accordance with the provisions of the STCW Convention:

(b) its ships are manned in compliance with the applicable safe manning requirements as provided in these rules;

(c) documentation and data including their experience, training, medical fitness and competency in assigned duties relevant to all seafarers employed on its ships, are maintained and readily accessible to all concerned,

(d) seafarers, on being assigned to any of its ships, are familiarised with their specific duties and with arrangements, installations, equipments, procedures and ship characteristics that are relevant to their routine or emergency duties;

(e) the ship's complement can effectively co-ordinate their activities in an emergency situation and in performing functions vital to safety or to the prevention or mitigation of pollution; and

(f) the Master of the Ship under whose command an individual seafarer sails on a particular ship shall be responsible to the company in respect of his duties and obligations.

CHAPTER II

Master and Deck Department

  1. Minimum requirements for certification of officer in charge of a navigational watch (Second Mate of a foreign-going ship) on ships of 500 gross tonnage or more.- (1) Every officer in charge of a navigational watch serving on a sea-going ship of 500 gross tonnage or more shall hold an appropriate certificate of competency in Form 1.

(2) Every candidate for the certification shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have approved sea-going service tor a period of one year or more as part of an approved training and assessment programme which includes on-board training in accordance with the requirements of section A-11/1 of the STCW Code and is documented in an approved training record book for assessment or otherwise have approved sea-going service for a period of not less than three years;

(iii) have performed bridge watch-keeping duties for a period of not less than six months during the required sea-going service under the supervision of the Master or an officer of the Deck Department holding a certificate of competency under rule 5;

(iv) meet the requirements of rule 29 for performing designated radio duties as a Radio Operator; and

(v) have completed approved education, training, examination and assessment and meet the standard of competence as specified in section A-11/1 of the STCW Code.

  1. Minimum requirements for certification of Chief Mate (First Mate of a foreign-going ship) on ships of 500 gross tonnage or more.- (1) Every Chief Mate on a sea-going ship of 500 gross tonnage or mere shall hold an appropriate certificate of competency in Form 2.

(2) Every candidate for certification shall -

(i) hold a certificate of competency as Second Mate of a foreign-going ship (Officer in charge of a navigational watch on ships of 500 gross tonnage or more);

(ii) have approved see-going service for a period of not less than eighteen months; and

(iii) have completed approved education, training, examination and assessment and meet the standard of competence specified in section A-11/2 of the STCW Code for Masters and Chief Mates on ships of 3000 gross tonnage or more.

  1. Minimum requirements for certification of Master (Master of a foreign-going ship) on ships of 500 gross tonnage or more.- (1) Every master on a sea-going ship of 500 gross tonnage or more shall hold an appropriate certificate of competency in Form 3.

(2) Every candidate for certification shall -

(i) hold a certificate of competency as First Mate of a foreign going ship (Chief Mate on ships of 500 gross tonnage or more);

(ii) have approved sea-going service as an officer in charge of a navigational watch on ships of 500 gross tonnage or more for a period of not less than three years. However, this period may be reduced by the Chief Examiner concerned to a period of not less than thirty months, or pro-rata, if not less than one year of such sea-going service served as Chief Mate;

(iii) have completed an approved ship management course;

(iv) have completed approved simulator training in shiphandling and manoeuvring; and

(v) have completed approvE.d examination and assessment

  1. Minimum requirements for certification of Extra Master.- (1) An Extra Master certificate in Form 4 is an optional certificate and is an evidence that the candidate has attained a higher level of professional excellence.

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Master of a foreign-going ship (Master on ships of 500 gross tonnage or more);

(ii) have completed an approved training and assessment programme conducted by an approved institution; and

(iii) have completed the approved examination and assessment.

(3) Every candidate who meets the requirements of this rule, shall be issued an Extra Master certificate of competency. This shall be issued in addition to the certificate of competency as Master of a foreign-going ship (Master on ships of 500 gross tonnage or more) as per regulation 11/2 of STCW Convention and section A-11I2 of the STCW Code held by the candidate.

  1. Minimum requirements for certification of officer In charge of a navigational watch (Navigational Watch-keeping Officer) on ships of 600 gross tonnage or more operating In Near·Coastal Voyages.- (1) Every officer in charge of a navigational watch serving on a sea-going ship of between 500 gross tonnage and 3000 tonnage operating in Near-Coastal Voyages shall hold an appropriate certificate of competency in Form 5.

(2) Every candidate for the certification shall.

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have approved sea-going service of not less than eighteen months as part of an approved training and assessment programme which includes on-board training and meets the requirements of the Tables of competence for the certification as contained in section A-1I/2 of the STCW Code as applicable to ships engaged in Near-Coastal Voyages and is documented in an approved training record book or otherwise have approved sea-going service of not less than three years. A candidate who has performed approved sea-going service on a ship of less than 500 gross tonnage shall be assessed at two-thirds of the actual sea-going service claimed;

(iii) have performed, bridge watch-keeping duties for a period of not less than six months during the required sea-going service under the supervision of the Master or an officer of the Deck Department holding a certificate of competency under rule 5;

(iv) meet the requirements of rule 29 for performing designated radio duties; and

(v) have completed approved education, training, examination and assessment and meet the standard for competence as specified in the approved training and assessment programme.

  1. Minimum requirements for certification of Chief Mates (Mate of a home-trade ship) on ships of between 600 and 3,000 gross tonnage operating In Near-Coastal Voyages.- (1) Every Chief Mate on a sea-going ship of between 500 and 3,000 gross tonnage operating in Near-Coastal Voyages shall hold an appropriate certificate of competency in Form 6.

(2) Every candidate for the certification shall,-

(i) hold a certificate of competency as Navigational Watch-keeping Officer in charge of a navigational watch on ships of 500 gross tonnage or more on Near-Coastal Voyages;

(ii) have approved sea-going service of not less than eighteen months; and

(iii) have completed approved education, training, examination and assessment and meet the standard of competence as specified in section A-1I/2 of the STCW Code for Masters and Chief Mates on ships of between 500 and 3,000 gross tonnage.

  1. Minimum requirements for certification of Masters on ships (Master of a home-trade ship) of between 600 and 3,000 gross tonnage operating in Near-Coastal Voyages.- (1) Every Master on a sea-going ship of between 500 and 3,000 gross tonnage operating in Near-Coastal Voyages shall hold an appropriate certificate of competency in Form 7.

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Mate of a home-trade ship (Chief Mate) in Near-Coastal Voyages on ships of between 500 and 3,000 gross tonnage;

(ii) have approved sea-going service as an officer in charge of a navigational watch on ships of 500 gross tonnage or more operating in Near-Coastal Voyages of not less than three years. However, this period may be reduced by the Chief Examiner concerned to a period of not less than thirty months, or pro-rata, if not less than one year of such sea-going service served as Chief Mate on ships of between 500 gross tonnage and 3000 tonnage operating in Near-Coastal Voyages;

(iii) have completed an approved ship management course;

(iv) have completed approved simulator training in shiphandling, and manoeuvring, or ninety days approved sea-going service as Chief Mate on Near-Coastal Voyages; and

(v) have completed approved examination and assessment.

  1. Minimum requirements for certification of ratings forming part of a navigational watch.- (1) Every rating forming part of a navigational watch on a sea-going ship of 500 gross tonnage or more, other than ratings under training and ratings whose duties while on watch are of an unskilled nature. shall be duly certificated by the Chief Examiner concerned to perform such duties.

(2) Every candidate for the certification shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have completed -

(a) approved sea-going service for a period of not less than nine months: or

(b) approved pre-sea training or special training for a period of ninety days and approved sea-going service for a period of not less than six months; and

(iii) meets the standard of competence as specified in section A-11/4 of the STCW Code.

(3) The sea-going service. training and experience as required by clause (ii) of sub-rule (2) shall be associated with navigational watch keeping functions and shall also involve the performance of duties carried out on board the ship under the direct supervision of the Master or the officer in charge of the navigational watch or a certified rating duly documented in an approved rating training record book

(4) Rating who has served in a relevant capacity in the Deck Department for a period of not less than one year within the last five years preceding the 1st day of August, 1998 shall be eligible for assessment by the assessment centre.

CHAPTER III

Engine Department

  1. Minimum requirements for certification of officer in charge of an engineering watch in a manned engine room or designated duty engineer In a periodically unmanned engine room (Marine Engineer Officer Class IV).- (1) Every officer in charge of an engineering watch serving on a sea-going ship powered by main propulsion machinery of 750 KW propulsion power or more shall hold an appropriate certificate of competency in Form 8.

(2) Every candidate for the certification shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have completed approved education and training for a period of at least thirty months as provided in an approved training and assessment programme including on-board training documented in an approved training record book and meet the standards of competence as specified in section A-111/1 of the STCW Code;

(iii) have completed approved sea-going service for a period of not less than six months in the Engine Department of a seagoing ship powered by main propulsion machinery of 750 KW propulsion power or more, closely supervised and monitored by a Marine Engineer Officer Class I or an officer of the Engine Department holding certificate of competency under rule 5 and which is duly documented in an approved training record book in accordance with section A-111/1 of the STCW Code; and

(iv) have completed approved education, training, examination, assessment and meets the standard of competence as specified in section A-111/1 of the STCW Code.

  1. Minimum requirements for certification of second engineer officers on ships powered by main propulsion' machinery of 3000 KW propulsion power or more (Marine Engineer Officer Class 11).- (1) Every second engineer officer on a sea-going ship powered by main propulsion machinery of 3,000 KW propulsion power or more shall hold an appropriate certificate of competency in Form 9,

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Marine Engineer Officer Class IV (Officer in charge of an engineering watch);

(ii) have not less than one year approved sea-going service as assistant engineer officer or engineer officer In charge of an, engineering watch; and

(iii) have completed approved education, training, examination and assessment and meets the standard of competence as specified in section A-111/2 of the STCW Code.

  1. Minimum requirements for certification of Chief Engineer Officer on ships powered by main propulsion machinery of 3000 KW propulsion power or more (Marine Engineer Officer Class I).- (1) Every chief engineer officer on a sea-going ship powered by main propulsion machinery of 3000 KW propulsion power or more shall hold an appropriate certificate of competency in Form 10.

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Marine Engineer Officer Class II (Second engineer officer on ships powered by main propulsion machinery of 3000 KW propulsion power or more);

(ii) have not less than eighteen months as approved sea-going service as engineer officer in charge of an engineering watch on ships powered by main propulsion machinery of 3000 KW propulsion power or more;

(iii) have completed an approved engineering management course;

(iv) have completed approved machinery space simulator training; and

(v) have completed approved examination and assessment.

  1. Minimum requirements for certification of Extra First Class Engineer.- (1) An Extra First Class Engineer certificate of competency in Form 11 is an optional certificate and is an evidence that the candidate has attained a higher level of professional excellence.

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Chief Engineer Officer for sea-going ships of 3000 KW propulsion power or more (Marine Engineer Officer Class I);

(ii) have completed an approved training and assessment programme conducted by an approved institution; and

(iii) have completed the approved examination and assessment.

(3) Every candidate who meets requirements of this rule, shall be issued with an Extra First Class Engineer certificate of competency. This shall be issued in addition to the certificate of competency as Chief Engineer Officer on ships of 3000 KW propulsion power or more (Marine Engineer Officer Class I) as per regulation 11112 of the STCW Convention and section A-111/2 of the STCW Code held by the candidate.

  1. Minimum requirements for certification of officer In charge of an engineering watch in a manned engine room or designated duty engineer In a periodically unmanned engine room of ships powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power, operating In Near-Coastal Voyages (Marine Engineer Officer Class IV - Near-Coastal Voyages).- (1) Every Officer in charge of an engineering watch serving on a seagoing ship of between 750 KW and 3000 KW propulsion power operating in Near-Coastal Voyages shall hold an appropriate certificate of competency in Form 12.

(2) Every candidate for the certification shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have completed approved training and assessment programme for a period of thirty months including on-board training duly documented in an approved training record book and meet the standard of competence as specified in section A-111/1 of the STCW Code as applicable to ships engaged in Near-Coastal Voyages;

(iii) have completed for a period of not less than six months approved sea-going service in the engine department on ships powered by main propulsion machinery of 750 KW or more closely' supervised and monitored by a Marine Engineer Officer Class III which is duly" documented in an approved training record book as specified in section A-11I/1 of the STCW Code as applicable to ships engaged in Near-Coastal Voyages; and

(iv) have completed approved education, training, examination and assessment and meet the standard of competence as specified in section A-111/1 of the STCW Code as applicable to the ships engaged in Near-Coastal Voyages.

  1. Minimum requirements for certification of Second Engineer Officer on ships powered by main propulsion machinery of between 760 KW and 3000 KW propulsion power operating In Near-Coastal Voyage (Marine Engineer Officer Class III - Second Engineer Officer - Near-Coastal Voyages).- (1) Every Second Engineer Officer on a sea-going ship powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power operating in Near-Coastal Voyages, shall hold an appropriate certificate of competency in Form 13.

(2) Every candidate for the certification shall -

(i) hold a certificate as officer in charge of an engineering watch on ships powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power operating in Near-. Coastal Voyages (Marine engineer Officer Class IV - Near Coastal Voyages);

(ii) have not less than one year approved sea-going service as an assistant engineer officer or engineer officer in charge of an engineering watch; and

(iii) have completed approved education, training, examination, assessment and meet the standard of competence as_ specified In section A-111/2 of the STCW Code as applicable to the ships operating in Near-Coastal Voyages.

  1. Minimum requirements for certification of Chief Engineer Officer on ships powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power operating In near coastal voyages (Marine Engineer Officer Class III - Chief Engineer Officer - Near-Coastal Voyages).- (1) Every Chief Engineer Officer on a sea-going ship powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power operating in Near-Coastal Voyages shall hold an appropriate certificate of competency in Form 14.

(2) Every candidate for the certification shall -

(i) hold a certificate of competency as Marine Engineer Officer Class III (Second Engineer Officer - Near-Coastal Voyages) on a sea-going ship powered by main propulsion machinery of between 750 KW and 3000 KW propulsion power operating in Near-Coastal Voyages;

(ii) have not less than one year approved sea-going service as an office(in charge of an engineering watch on such ships;

(iii) have completed an approved engineering management course:

(iv) have completed approved machinery space simulator training; and

(v) have completed approved examination and assessment.

  1. Minimum requirements for certification of ratings forming part of an engine room watch.- (1) Every rating forming part of an engine room watch or designated to perform duties in a periodically unmanned engine room on a sea-going ship powered by main propulsion machinery of 750 KW propulsion power or_ more, other than ratings under training and ratings whose duties while on watch are of an unskilled nature, shall be duly certificated by the Chief Examiner concerned to perform such duties.

(2) Every candidate for the certification shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) have completed -

(a) approved sea-going service for a period of not less than nine months or

(b) approved pre-sea training or special training for a period of ninety days and approved sea-going service for a period of not less than six months; and

(iii) meets the standard of competence as specified in section A-111/4 of the STCW Code.

(3) The sea-going service, training and experience requirements by clause (ii) of sub-rule (2) shall be associated with engine room watch keeping functions and shall also involve the performance of duties carried out on board the ship under the direct supervision of the Chief Engineer or the officer in charge of an engineering watch or a certified rating duly documented in an approved rating training record book:

(4) Rating who has served in a relevant capacity in the Engine Department for a period of not less than one year within the last five years preceding the 1st day of August, 1998, shall be eligible for assessment by the assessment centre.

CHAPTER IV

Radiocommunication and Radio personnel

  1. Minimum requirements for certification of Global Maritime Distress and Safety System radio personnel.- (1) Every person in charge of or performing radio duties on a ship required to participate in the Global Maritime Distress and Safety System in addition to the provisions of Merchant Shipping (Distress and Safety Radio Communication) Rules, 1995 shall -

(i) be not less than 18 years of age on the last date prescribed for receipt of application;

(ii) attend an approved Global Maritime Distress and Safety System General Operator's Course and meet the standard of competence as specified in section A-IV/2 of the STCW Code; and

(iii) on completion of the approved Global Maritime Distress and Safety System General Operator's Course and demonstration of competence to perform the tasks, duties and responsibilities as set out in Table A-IV/2 of the STCW Code, be issued with an appropriate certificate and necessary-endorsement shall be made on the same as required by the STCW Convention.

CHAPTER V

Special training requirements for personnel on certain types of ships

  1. Minimum requirements for the training and qualifications of masters, officers and ratings on tankers.- (1) Officers and ratings assigned specific duties and responsibilities relating to cargo or cargo equipment on tankers shall have completed an approved shore-based fire-fighting course and shall have completed -

(a) at least ninety days of approved sea-going service on tankers in order to acquire adequate knowledge of safe operational practices; or

(b) an approved tanker-familiarisation course covering at least the syllabus given for that course in section A-V/1 of the STCW Code On satisfactory completion of the course an appropriate certificate shall be issued to the candidate.

(2) Masters, Chief Engineer Officers, Chief Mates, Second Engineer Officers and any person with immediate responsibility for loading, discharging and care in transit or handling of cargo shall, in addition to meet the requirements of sub-rule (1), have -

(a) at least ninety days experience appropriate to their duties on the type of tanker on which they serve; and

(b) completed an approved specialised training programme which at least covers the subjects set out in section A-V/1 of the STCW Code that are appropriate to their duties on the oil tanker, chemical tanker or liquefied gas tanker on which they serve. On satisfactory completion of such training an appropriate certificate shall be issued to the candidate.

(3) Masters and officers, who are qualified in accordance with sub-rule (2) shall present their certificate of competency to the Chief Examiner concerned or Examiner, as the case may be; and obtain an endorsement for service on oil tanker, chemical tanker or liquefied gas tanker, as appropriate.

  1. Minimum requirements for the training and qualifications of masters, officers, ratings and other personnel on ro-ro passenger ships.- (1) Masters, officers and ratings and other personnel serving on board ro-ro passenger ships, prior to being assigned shipboard duties, shall have completed the relevant training in accordance with their capacity, duties and responsibilities.

(2) Masters, officers and other personnel deSignated on muster lists to assist passengers in emergency situations on board ro-ro passenger ships, shall have completed training in crowd management as specified in section A-V/2, paragraph 1 of the STCW Code.

(3) Masters, officers and other personnel assigned specific duties and responsibilities on board ro-ro passenger ships shall have completed the familiarisation training as specified in section A-V/2, paragraph 2 of the STCW Code.

(4) Personnel providing direct service to passengers in passenger spaces on board ro-ro passenger ships shall have completed the safety training as specified in section A-V/2, paragraph 3 of the STCW Code.

(5) Masters, Chief Mates, Chief Engineer Officers, Second Engineer Officers and every person assigned immediate responsibility for embarking and disembarking passengers, loading, discharging or securing Cargo or closing hull openings on board ro-ro passenger ships shall have completed approved training in passenger safety, cargo safety and hull integrity as specified in section A-V/2, paragraph 4 of the STCW Code.

(6) Masters, Chief Mates, Chief Engineer Officers, Second Engineer Officers and any person having responsibility for the safety of passengers in emergency situations on board ro-ro passenger ships shall have completed approved training in crisis management and human behaviour as specified in section A-V/2, paragraph 5 of the STCW Code.

(7) Masters, officers, ratings and other personnel serving on board ro-ro passenger ships shall, on satisfactory completion of approved relevant training in crowd management, familiarisation, safety, passenger safety, cargo safety and hull integrity, crisis management and human behaviour be issued with an appropriate certificate.

(8) Masters, Chief Mates, Chief Engineer Officers and Second Engineer Officers who are qualified in accordance with this rule and hold an appropriate certificate, shall present their certificate of competency to the Chief Examiner or the Examiner concerned, as the case may be, and obtain an endorsement for service on ro-ro passenger ships.

(9) Seafarers who are required to be trained in accordance with sub-rules (2), (5) and (6) shall, at intervals not exceeding five years, undertake appropriate refresher training.

  1. Minimum requirements for the training and qualifications of masters, officers, ratings and other personnel on passenger ships.- (1) Masters, officers and ratings and other personnel serving on board passenger ships, other than ro-ro passenger ships, prior to being assigned shipboard duties, shall have completed the relevant training in accordance with their capacity, duties and responsibilities.

(2) Masters, officers and other personnel designated on muster lists to assist passengers in emergency situations on board passenger ships shall have completed training in crowd management as specified in section A-V/3, paragraph 1 of the STCW Code.

(3) Masters, officers and other personnel assigned specific duties and responsibilities on board passenger ships shall have completed the familiarisation training as specified in section A-V/3, paragraph 2 of the STCW Code.

(4) Personnel providing direct service to passengers in passenger spaces on board passenger ships shall have completed the safety training as specified in section A-V/3, paragraph 3 of the STCW Code.

(6) Masters, Chief Mates, Chief Engineer Officers, Second Engineer Officers and any person having responsibility for the safety of passengers in emergency situations on board passenger ships shall have completed approved training in crisis management and human behaviour as specified in section A-V/3, paragraph 5 of the STCW Code.

(7) Masters, officers, seamen, ratings and other personnel serving on board passenger ships shall, on satisfactory completion of approved relevant training in crowd management, familiarisation, safety, passenger safety, crisis management and human behaviour, be issued with an appropriate certificate.

(8) Masters, Chief Mates, Chief Engineer Officers and Second Engineer Officers who are qualified in accordance with this rule and hold an appropriate certificate, shall present their certificate of competency to the Chief Examiner concerned or the Examiner concerned, as the case may be, and obtain an endorsement for service on passenger ships.

(9) Seafarers who are required to be trained in accordance with sub-rules (2), (5) and (6) shall, at intervals not exceeding five years, undertake appropriate refresher training.

CHAPTER VI

Emergency, occupational safety, medical care and survival functions

  1. Minimum requirements for familiarisation, basic safety training and instructions for all seafarers.- (1) All persons employed or engaged on a sea-going ship, other than passengers shall, before being assigned to shipboard duties, receive approved familarisation training and instructions in accordance with paragraph 1 of section A-VI/I of the STCW Code and shall meet the appropriate standard of competence as specified therein.

(2) Seafarers employed or engaged in any capacity on board ship on the business of that ship as part of the ship's complement with designated safety or pollution prevention duties in the operation of the ship shall, before being assigned to any shipboard duties, receive appropriate approved basic training or instructions in -

(i) personal survival techniques as set out in Table A-VI/1-1 of the STCW Code:

(ii) fire prevention and fire fighting as set out in Table A-VI/1-2 of the STCW Code;

(iii) elementary first aid as set out in Table A-VI/1-3 of the STCW Code: and

(iv) personal safety and social responsibilities as set out in Table A-VI/1-4 of the STCW Code.

(3) On satisfactory completion of each of the approved basic safety training, an appropriate certificate shall be issued to the seafarer.

  1. Minimum requirements for the issue of certificates of proficiency in survival craft, rescue boats and fast rescue boats.- (1) Every candidate for a certificate of proficiency in survival craft and rescue boats other than fast rescue boats shall -

(a) be not less than 18 years of age on the last date prescribed for receipt of application;

(b) have approved sea-going service of not less than one year or have attended an approVed training course and' have approved sea-going service of not less than six months;

(c) attend an approved training course and meet the standard of competence for certificates of proficiency in survival craft and rescue boats set out in section A-V 112 , paragraphs 1 to 4 of the STCW Code; and

(d) on satisfactory completion of the approved training course and demonstration of competence to undertake the tasks, duties and responsibilities set out in Table A-VI/2-1 of the STCW Code, be issued with an appropriate certificate.

(2) Every candidate for a certificate of proficiency In fast rescue boats shall -

(i) be the holder of a certificate of proficiency in survival craft and rescue boats other than fast rescue boats;

(ii) have attended an approved training course;

(iii) meet the standard of competence for certificates of proficiency in fast rescue boats set out in section A-VI/2, paragraphs 5 to 8 of the STCW Code: and

(iv) on satisfactory completion of the approved training course and demonstration of competence to undertake the tasks, duties and responsibilities set out in Table A-VII2-2 of the STCW Code, be issued with an appropriate certificate.

  1. Minimum requirements for training In advanced fire fighting.- (1) Seafarers designated to control fire-fighting operations shall have successfully completed advanced training in techniques for fighting fire with particular emphasis on organisation, tactics and command in accordance with the provisions of section A-VI/3 of the STCW Code and shall meet the standard of competence specified therein.

(2) On satisfactory completion of advanced training in techniques for fighting fire and demonstration of competence to undertake the tasks, duties and responsibilities set out in Table A-VI/3 of the STCW Code, an appropriate certificate shall be issued to the seafarer

  1. Minimum requirements relating to medical first aid and medical care.- (1) Seafarers designated to provide medical first aid on board ship shall complete an approved training programme and meet the standard of competence in medical first aid specified in section A-V1/4, paragraphs 1 to 3 of the STCW Code. On satisfactory completion of the approved training and assessment programme in medical first aid and demonstration of competence to undertake the tasks, duties and responsibilities set out in Table A-V1/4-1 of the STCW Code, an appropriate certificate shall be issued to the seafarer.

(2) Seafarers designated to take charge of medical care on board ship shall complete an approved training and assessment programme and meet the Standard of competence in medical care as specifier in section A-VI/4, paragraphs 4 to 6 of the STCW Code. On satisfactory completion of the approved training and assessment programme in medical care and demonstration of competence to undertake the tasks, duties and responsibilities set out in Table AVII4-2-of the STCW Code, an appropriate certificate shall be issued to the seafarer.

CHAPTER VII

Alternative Certification

  1. Power of the Chief Examiner concerned.- (1) The Chief Examiner concerned may allow assessment of competence in one or more functions falling outside a candidate's certificate of competency provided the arrangement has been notified to the International Maritime Organisation in accordance with article IV and regulation 1/7, relating to communication of information, of the STCW Convention
  2. Minimum requirements for issue of alternative certificates.- (1) The Chief Examiner concerned if satisfied that approved training and assessment programme in additional function fully meet the requirements of the STCW Code, as appropriate to the level of responsibility including qualifying sea-going service, may issue a certificate duly endorsed to the effect and stating clearly the qualifications obtained in one or more functions and limitations, if any, as per regulation Villi and VII/2 of the STCW Convention and subject to prinCiples governing the issue of alternative certificates as per regulation VII/3 of the STCW Convention.
  3. Principles governing the Issue of alternative certificates.- (1) The Chief Examiner concerned before issuance or authorising the issuance of alternative certificates shall ensure that no such certificates are issued unless it maintains equivalent level of safety and pollution prevention and certificates of competency issued under these rules will continue to allow interchangeability without the reduction in competency, manning, de-skilling or Watch-keeping provisions of the STCW Convention.

CHAPTER VIII

Watch-keeping

  1. Fitness for duty.- (1) The company shall, for the purpose of preventing fatigue -

(a) establish and enforce rest periods for Watch-keeping personnel;

(b) require that watch systems are so arranged that the efficiency of all watch-keeping personnel is not impaired by fatigue and the duties are so organised that the first watch at the commencement of a voyage and subsequent relieving watches are sufficiently rested and otherwise fit for duty; and

(c) comply with the requirements of rest periods set out in.section A-VIII/I of the STCW Code and display watch schedules on board their ships where they are easily accessible.

  1. Watch-keeping arrangements and principles to be observed.- (1) Masters, Chief Engineer Officers and all Watch-keeping personnel on board their ships shall comply with the requirements, principles and guidance set out in section A-V11/2 of the STCW Code. The requirements shall be observed to ensure that safe continuous watches appropriate to the prevailing circumstances and conditions are maintained in aI/ sea-going ships at all times.

(2) The Master of every ship shall ensure that Watch-keeping arrangements are adequate for maintaining safe watches, taking into account the prevailing circumstances and conditions and that, under the Masters general direction -

(i) officers in charge of the navigational watch are responsible for navigating the ship safely during their periods of duty when they shall be physically present on the navigating bridge or in a directly associated location such as the chartroom or bridge control room at all times;

(ii) radio operators are responsible for maintaining a continuous radio watch on appropriate frequencies during their periods of duty;

(iii) officer in charge of an engineering watch under the direction of the Chief Engineer Officer, shall be immediately available and on call to attend the machinery spaces and, when required, shall be physically present in the machinery space during their periods of responsibility; and

(iv) an appropriate and effective watches are maintained for the purpose of safety at all times, while the ship is at anchor or moored and, if the ship is carrying hazardous cargo, the organisation of such watches takes full account of the nature, quantity, packing and stowage of the hazardous cargo and of any special conditions prevailing on board, afloat or ashore.

CHAPTER IX

Miscellaneous Provisions

  1. Minimum qualifications for a seaman.- (1) No seaman forming part of a navigational or engine-room watch shall be engaged or carried to· sea in any capacity in any ship unless he -

(i) is of 18 years of age on the last date prescribed for receipt of application;

(ii) has passed Matric or an equivalent examination from a Board of Education established under law;

(iii) has completed the approved pre sea-going training;

(iv) meets the standards of medical and physical fitness as specified In the Merchant Shipping (Medical Examination) Rules, 1986 and the STCW Code; and

(v) holds a certificate showing the date of birth and a valid passport.

  1. Responsibility of an employer.- (1) No person shall engage or carry to sea any seaman to work In any capacity of navigational or engine-room watch unless he is certified by the· Chief Examiner concerned to the effect that he is fit in all respects to be employed In a relevant capacity and meets the requirements of the Act, these rules and the STCW Code, Before certifying as such the Chief Examiner concerned shall satisfy that the certificates produced by the seaman are genuine and valid,
  2. Action against candidates found guilty of misconduct.- (1) Candidates are warned that they should not furnish any particulars that are false or suppress any material information in filling in the application in Form 15. Candidates are also warned that they should in no case correct or alter or otherwise tamper with any entry in a document or its attested or certified copy submitted by them nor should they submit a tampered or fabricated document. If there is any inaccuracy or any discrepancy between two or more such documents or their attested or certified copies, an explanation regarding this discrepancy should be submitted.

(2) A candidate who is or has been declared by the Director General of Shipping to be guilty of-

(i) obtaining support of his candidature by any means; or

(ii) impersonating; or

(iii) procuring impersonation by any person; or

(iv) submitting fabricated documents or documents which have been tampered with; or

(v) making statements which are incorrect or false or suppressing material information; or

(vi) resorting to any other irregular or improper means in connection with his candidature for the examination; or

(vii) using unfair means during the examination; or

(viii) writing irrelevant matter including obscene language or pornographic matter in the script; or

(ix) misbehaving in any other manner in the examination hall or

(x) harassing or doing bodily harm to the staff employed by the Director General of Shipping for the conduct of their examination" or

(xi) attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses. may in addition to rendering himself liable to criminal prosecution, be liable -

(a) to be disqualified by the Director General of Shipping from examination for which he is a candidate; or

(b) to be debarred either permanently or for a specified period:-

(i) by the Director General of Shipping from any examination or assessment held by him;

(ii) by the Central Government, from any employment under them; and

(c) if he is already in any service to disciplinary action under the relevant rules.

  1. Appeal.- (1) Any seafarer aggrieved by any order made under these rules by any officer below the rank of the Director General of Shipping may prefer an appeal to the Director General of Shipping within a period of sixty days from the date of receipt of the order.

(2) Any seafarer aggrieved by any order made under these rules by the Director General of Shipping may prefer an appeal to the Central Government within a period of sixty days from the date of receipt of the order.

(3) No appeal shall be admitted if it is preferred after the expiry of the period prescribed therefor:

Provided that an appeal may be admitted after the expiry of the period prescribed therefor if the appellant satisfies the appellate authority that he had sufficient cause for not preferring the appeal within the prescribed period.

(4) Every appeal made under this rule shall be accompanied by a copy of the order appealed against.

(5) The appellant authority, before disposing of an appeal, shall give a reasonable opportunity of being heard to the appellant.

(6) An appeal shall be disposed of as expeditiously as possible but within a period of six months from the gate-of the order.

(7) The appellate authority may confirm, modify or reverse the order appealed against.

  1. Power to exempt.- Where the Director General of Shipping is satisfied that the application of full requirements of the provisions of the STCW Convention are unreasonable or impracticable, he may, to such exceptions and conditions as he may consider necessary, by order in writing, exempt a seafarer from such requirements.
  2. Supervision by the Director General of Shipping.- The Director General of Shipping shall supervise that all training and assessment of seafarers for certification is -

(a) structured in accordance with written programmes including such methods and media of delivery, procedure and course material as are necessary to achieve the standard of competence as specified in Chapters II to VIII of the STCW Code;

(b) conducted, monitored, evaluated and supported by persons qualified in accordance with paragraphs 4 to 6 of section A-1/6 of the STCW Code.

  1. Replacement of lost of damaged certificates.- (1) Any person whose certificate has been damaged or lost, may apply for a duplicate of the same to the Principal Officer, Mercantile Marine Department who delivered the certificate.

(2) Every such application shall be in Form 16 and shall be accompanied by an appropriate fee as specified in Schedule:

Provided that In case of loss of a certificate due to fire on board the ship or total loss of the ship such fee shall not be charged.

(3) On receipt of an application under sub-rule (1) the Principal Officer shall refer the same to the Chief Examiner concerned, who shall, after making such inquiry as he may deem fit, issue a duplicate certificate to the applicant through the Principal Officer as soon as may be practicable but in any case not later than the expiry of a period of six months.

  1. Review of results of examination.- A candidate who has been declared failed in any examination may apply to the Principal Officer, Mercantile Marine Department for review of results within a period of thirty days from the date of declaration of the results. Such application shall be accompanied by a fee as specified in the Schedule The Principal Officer shall forward the application to the Chief Examiner concerned who shall assign an Examiner other than who. dealt with the examination originally to review the evaluation. Results of review when approved shall be final and no appeal shall be against such review. In case the original result is reversed the fee shall be refunded to the candidate.
  2. Fees.- (1) Every candidate shall pay fees in accordance with the scale of fees specified in the Schedule on each occasion he applies for examination or enquiries, as the case may be, as to his eligibility for examination or exemption or both.

(2) Fees paid under these rules shall not be refunded.

  1. Repeal.- (1) The Merchant Shipping (Examination of Masters and Mates) Rules, 1985 and the Merchant Shipping (Examination of Engineer Officers in the Merchant Navy) Rules, 1989 are hereby repealed.

(2) All appointments made, acts done or omitted to be done under the repealed rules shall be deemed to have been made or done or omitted to be done under the corresponding provisions of these rules.

(3) All certificates issued under the repealed rules shall be revalidated under the provisions of rule 10.
