G.S.R. 702. - In exercise of the powers conferred under sub-section (3) of section 18 read with clauses (h) of sub-section (2) of section 51 of the Airport Economic Regulatory Authority of India Act, 2008, the Central Government hereby makes the following rules, namely :

  1. Short title and commencement.- (1) These rules may be called the Airport Economic Regulatory Authority, Appellate Tribunal (Forms for Application and Appeal and Fee) Rules, 2010.
  2. They shall come into force on the date of their publication in the Official Gazette.
  3. Definitions.- (1) In theses rules unless the context otherwise requires,-

(a) 'Act' means the Airport Economic Regulatory Authority of India Act, 2008 (27 of2008);

(b) 'appeal' means an appeal preferred under sub-section (2) of section 18 of the Act;

(c) 'Application' means an application filed under section (1) of section 18 of the Act;

(d) 'authority' means the Airport Economic Regulatory Authority established under sub-section (1) of section 3 of the Act;

(e) 'Forms' means the form annexed to these rules;

(2) Words and expressions used herein and not defined but defined in the Act shall have the meanings respectively assigned to them in the Act.

  1. Form of application or appeal and verification thereof.- (1) An application to be filed before the Appellate Tribunal for adjudication of dispute under section 18 in the Form I.

(2) An appeal against any direction, decision or order made by authority shall be filed before the Tribunal in Form II and shall be in five copies and accompanied with the certified copy of the direction or decision or order against which the appeal is filed.

(3) Every application or appeal filed before the Appellate Tribunal shall be in English and in case it is in some other Indian language it shall be accompanied by a copy translated in English and shall be fairly and legible type written, lithographed or printed in double spacing on one side of standard petition paper with an inner margin of about four centimeters width on top and with a right margin of 2.5 cm, and left margin of 5 cm, duly paginated, indexed and stitched together in paper book form.

  1. Fee.- (1) Every application or appeal shall be accompanied by a fee of rupees ten thousand which may be remitted in the form of demand draft drawn in favour of Pay and Accounts Officer, Ministry of Civil Aviation, payable at New Delhi.
