In exercise of the powers conferred by clause (t) of sub-section (2) of section 87 of the Information Technology Act, 2000 (21 of 2000), the Central Government hereby makes the following rules regulating the method of recruitment to the Gazetted and Non-Gazetted Posts in the Cyber Regulations Appellate Tribunal, namely : —

  1. Short title and commencement .—(1) These rules may be called the Cyber Regulations Appellate Tribunal, Gazetted and Non-Gazetted Posts Recruitment Rules, 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

  1. Application .—These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.
  2. Number of posts, classification and scale of pay .—The number of posts, their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule.
  3. Method of recruitment, age limit and other qualifications, etc .—The method of recruitment to the said posts, age limit, qualifications and other matters connected therewith shall be as specified in columns 5 to 14 of the aforesaid Schedule.
  4. Disqualification .—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

  1. Power to relax .—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded, in writing, relax any of the provisions of these rules with respect to any class or category of persons.
  2. Saving .—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation:

(i) Officers holding analogous posts in the Central or State Government or having five years’ regular service in the scale of pay of Rs.12,000-16,500, preferably possessing Law Degree or have experience of judicial work;or

(ii) Officers from Judicial service in the Selection Grade in the scale of pay of Rs.12,000-16,with five years regular service in the grade;or

(iii)Officers of High Court or District and Sessions Court or Tribunals holding analogous post; or Assistant Registrar in the scale of pay of Rs.12,000-16,500 or equivalent with five years regular service in the grade.

Desirable:Preference will be given to persons having experience in legal or judicial work.

Note 1.-Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or other organization or department of the Central Government shall ordinarily not exceed three years.

Note 2.-The maximum age limit for appointment on deputation shall be not exceeding 56 years as on the closing date of receipt of applications.

(i) Officers holding analogous posts in the Central or State Governments or having five years’ regular service in the scale of pay of Rs.10,000-15,200 having law degree;or

(ii) Officers of High Court or District and Sessions Court or Tribunals holding analogous post; or Court Masters in the scale of pay of Rs.10,000-15,200 or equivalent such as Administrative officer (Judicial) or Superintendent in High Court or District and Sessions court or Tribunals with five years regular service in the grade.

Desirable:Preference will be given to persons having experience in legal or judicial work.

Note 1.-Period of deputation including period of deputation in another excadre post held immediately preceding this appointment in the same or other organization or department of the Central Government shall ordinarily not exceed three years

(i) Officers in the Central Government or State Governments or in Courts holding analogous posts on regular basis and having a degree from a recognized University:or

(ii) Stenographers Grade ‘C` with eight years service in the scale of pay of Rs.5,500-175-9,000 or equivalent and having a degree from a recognized University.

Desirable: Preference will be given to persons having experience in legal or judicial work.

Note 1.-Period of deputation including period of deputation in another excadre post held immediately preceding this appointment in the same or other organization or department of the Central Government shall ordinarily not exceed three years

Note 2.-The maximum age limit for appointment on deputation shall be not exceeding 56 years as on the closing date of receipt of applications.
