Export Manifest (Aircraft) Regulations, 1976.

G.S.R. 1548, dated 23rd October, 1976. - In exercise of the powers conferred by Section 157 read with Section 41 of the Customs Act. 1962 (52 of 1962), Central Board of Excise and Customs hereby makes the following Regulations, namely :

  1. Short title and commencement.- (1) These Regulations may be called Export Manifest (Aircraft) Regulations, 1976.

(2) They shall come into force on such [date] as the Central Board of the Excise and Customs may, by notification in the official Gazette, appoint.

  1. Definition.- In these Regulations, "form" means a form appended to these Regulations.
  2. Export manifest.- (1) Every export manifest shall -

(a) be delivered in duplicate;

(b) cover all the goods carried in the aircraft;

(c) consist of-

(i) a general declaration, in Form I,

(ii) a passenger manifest, in Form II,

(iii) a cargo manifest, in Form III,

(iv) a list of private property in the possession of the Captain of aircraft and other members of the crew, in Form IV.

(2) The export manifest for all goods shipped and transhipped and endorsed by the person--in-charge of the aircraft as to the quantities shipped and transhipped shall be delivered to the proper officer of customs at the airport, before the departure of the aircraft.

  1. Cargo manifest.- (1) The cargo manifest referred to in sub-clause (iii) of Clause (c) of Reg. 3, shall be delivered in separate [sheets]in respect of the following categories of cargo, namely :

(a) cargo shipped;

(b) cargo transhipped;

(c) goods lying in the aircraft but not landed or transhipped (same bottom cargo);

(d) cargo in respect of which drawback has been claimed.

(2) (a) Notwithstanding anything contained in sub-regulation (1), the cargo declaration in respect -

(i) arms;

(ii) ammunition;

(iii) explosives;

(iv) narcotics;

(v) dangerous drugs; or

(vi) gold.

irrespective of whether for shipment, for transhipment or for being carried as same bottom cargo, shall be furnished in separate sheets and shall be set out in the order of the ports of loading.

(b) If an aircraft does not carry any of the cargoes referred to in Clause (a) a nil declaration shall be furnished.

[5. Passenger manifest. - [(1) (a) The pre check-in passenger manifest shall be delivered twelve hours before the departure of the flight.

(b) The final passenger manifest shall be delivered fifteen minutes before leaving or taking off from the port of embarkation in India.

(2) The manifests shall be transmitted electronically to the Indian Customs in flat file format or in United Nations/ Electronic Data Interchange for Administration, Commerce and Transport Passenger List Advance Passenger Information (UN/EDIFACT PAXLST API) message format as per Annexure.]

(3) Where the manifest cannot be delivered electronically due to some unavoidable reason, the same may be delivered as acceptable to the concerned [Principal Commissioner of Customs or]Commissioner of Customs in accordance with the conditions prescribed in the procedure.

(4) In case of any amendment to the manifest, the same shall be transmitted to the Indian Customs as soon as such amendments are made and before the departore of the flight.]

(ii) File structure Details: One file structure will contain a complete manifest for Pax/Crew of a particular flight. Separate file for Crew and PAX for each flight needs to be sent.

#The passport number is not mandatory for some countries viz. currently for Nepal and Bhutan and in those cases 'O'(other) value to be mentioned in the document type and Unique Document number be provided.

  • Each data element should be separated by '|' (pipe line) in the record (Total 53 no. of '|' should be there in each record)
  • In case of value not available for a specific data element, null value (not space) should be given.
  • Each record for PAX should be in a single line, no line separator is required.
