The Navy (Enrolment) Regulations, 1965

S.R.O. 359, dated the 13th October, 1965. - In exercise of the powers conferred by section 184 of the Navy Act, 1957 (62 of 1957), the Central Government hereby makes the following regulations, namely :
- Short title.- These regulations may be called "The Navy (Enrolment) Regulations, 1965".
- Definitions.- In these regulations, unless the context otherwise, requires,
(a) "Act" means the Navy Act, 1957;
(b) "section" means a section of the Act;
(c) "Appendix" means the Appendix set forth in these regulations;
(d) "prescribed form" means an appropriate form in an Appendix applicable to the relevant regulation;
(e) "Seaman" has the same meaning as in clause (20) of Section 3.
- Form.- (1) The Enrolment Form (I.N.-441) set forth in the Appendix with such variations, as the circumstances of each case may require, shall be used for the purpose of enrolment in the Indian Navy, and if used, shall be sufficient; but a deviation from such form shall not by reason only of such deviation, render invalid any enrolment or any proceedings under these regulations.
(2) Th directions in the notes to, and the instructions in, the enrolment form shall be duly complied with in all cases to which they relate but any omission to comply with any such directions in the notes or instructions shall not merely by reason of such omission, render any act or thing invalid.
- Enrolling Officers.- The following persons shall be the enrolling officers for the purpose of section 11:
(a) All Area Recruiting Officers, Deputy Area Recruiting Officers and Recruiting Officers of the Regular Army, the Indian Navy or of the Air Force who may be appointed as such.
(b) The Captain, Naval Barracks or any other Naval authority as may be decided upon by the Chief of the Naval Staff from time to time.
(c) Any Assistant Recruiting Officer, Recruiting Assistant or any person who may be appointed as an enrolling officer by the Adjutant General of the Army or by the Chief of the Naval Staff.
- Procedure before enrolling officer.- Upon the appearance before an enrolling officer of any person desirous of being enrolled, the enrolling officer shall read and explain to him or cause to be read and explained to him in his presence, the conditions of the service for which he is to be enrolled; and shall put to him the questions set forth in the prescribed form of enrolment, and shall, after having cautioned him that if he makes a false answer to any such question he will be liable to punishment under the Act, record or cause to be recorded his answer to each such question.
- Mode of enrolment.- If, after complying with the provisions of regulation 5 the enrolling officer is satisfied that the person desirous of being enrolled fully understands the questions put to him and consents to the conditions of service, and if such officer perceives no impediment, he shall sign and shall also cause such person to sign the enrolment paper, and such person shall thereupon be deemed to be enrolled.
- Transfer from one branch of the Indian Navy to another.- Where the Central Government by any general or special order published in the official gazette so directs, any seaman enrolled under these regulations may, notwithstanding anything to the contrary contained in the conditions of service for which he is enrolled, be transferred to any branch by order of the Chief of the Naval Staff.

Form Of Enrolment
The prescribed periods for which persons shall be enrolled are stated in the appropriate orders of the Government of India and save as is hereinafter provided, no person shall by reason of an error of his enrolment paper or otherwise, be entitled to be retained in service or be compelled to serve for a period longer than that for which he should have been enrolled, though he may do so voluntarily, provided his services are required in the sanctioned establishment.
NOTE. - At the time of enrolment any alterations or corrections in this Form are invariably to be initialled by the Enrolling Officer.

*On expiry of this period, men may be re-enrolled for a further period of service to enable them to complete time for minimum pension. They could also be granted further extension for completing time for maximum pension, and even to serve up to the age of superannuation. All re-enrolment would, however, be subject to the willingness of men to continue to serve, their utility and the requirements of the Service.
**In all cases where ex-sailors apply for re-enrolment into the Navy the matter is to be referred in detail to the Captain, Naval Barracks (Drafting Office), Bombay, who will issue necessary instruction for enrolment. The applicant is to be informed of this of this and no further action is to be taken by enrolling authorities until such instructions are received.
