Punjab Bhang Import, Export, Transport and Possession Orders, 1955

No. G.S.R. 156/P.A.I/14/S.58/62. - The following Orders, as amended upto the 1st January, 1962, are republished below for general information :-

  1. The expression "import" and the expression "export" in these orders shall have the meanings respectively assigned to them in the Punjab Excise Act, 1914.
  2. Nothing in these orders shall apply to bhangimported, exported and transported for private consumption and not for sale, in any quantity not exceeding that prescribed in the Punjab Intoxicants, License and Sale Orders as the maximum quantity which may be sold by retail.
  3. With reference to section 18 of the Punjab Excise Act, 1914 no Bhangshall be exported or transported except under a pass issued in accordance with these rules for such export and transport.
  4. Except as provided in Order 2 preceding, import of Bhangis prohibited except under a pass granted in this behalf by the Financial Commissioner.
  5. Export of Bhang.Bhangmay be exported from any [place] in Punjab to any place in India subject to the following condition:-

(a) The exporter must obtain a permit from an authorised Excise Officer of the [Union Territory or State] of destination authorising him to remove Bhang from Punjab into such [Union Territory or State].

(b) The exporter must obtain a pass to cover the export.

(c) The exporter must have paid such duty as may be from time to time be imposed on the export of Bhang under section 31 of the Punjab Excise Act (1 of 1914) unless the Bhang is exported in bond.

(d) The exporter must produce the Bhang to be exported at the office of the Excise and Taxation Officer or any other Officer authorised for the purpose of weighment and calculation of duty.

(e) The Bhang must be exported in quantities of not less than [thirty seven kilograms] at any time.

  1. Transport of Bhang.- Except as provided in Order 2 preceding any person holding a licence for the wholesale or retail vend of Bhangin Punjab may transportBhang from any place in Punjab into a District in which he holds a licence subject to the following condition:-

(a) The transporter must obtain from the Collector concerned a permit to transport Bhang to the District in which he is licensed to sell Bhang.

(b) The transporter must obtain from the Collector concerned a pass authorising the transport of Bhang described therein, a specified route to the vend premises of a specified person licensed to sell Bhang wholesale or retail in Punjab.

(c) The transporter must produce the Bhang to be transported at the office of the Excise and Taxation Officer or any other Officer authorised in the District from which the Bhang is to be transported for the purpose of weighment and calculation of duty.

(d) The transporter must have paid such duty as may from time to time to imposed on the transport of Bhang under section 31 of the Punjab Excise Act (1 of 1914).

(e) The Bhang must be transported in quantities of not less than thirty seven kilograms) at a time.

  1. Bhangmay be transported by a person licensed to sell Bhang wholesale or retail in Punjab from one place of bond to another in the same District in quantities greater than (two hundred and thirty-three grams subject always to the conditions of the transport license), without a transport pass and without payment of transport duty.
  2. The import, export and transport of Bhangon account of Government may be carried out without restriction; provided that in the case of transit by post the import, export and transport shall be subject to the following restrictions :-

(a) Only the parcel post may be used.

(b) The parcel shall be accompanied by a declaration stating the name and designation of the consignee and consignor the contents of the parcel in detail and the indent number and date covering the transaction.

(c) The consignee shall show distinctly in his account books the name and designation of the consignor and the quantity of drugs sent to him from time to time by post.

  1. Possession of Bhang.- Save as provided in rule 8 above, the import, export or transport of Bhang, into from or within Punjab is permitted only by means other than that of the post.
  2. A person licensed to sell Bhangwholesale or retail in Punjab may possessBhang in any quantity.
