No. 4749-4CI-73/17114. - The following bye-laws made by the Chief Administrator, Faridabad Complex Administration, Faridabad, in the Gurgaon district, in exercise of the powers conferred by Sections 188 and 199 of Punjab Municipal Act, 1911, read with Section 56 of the Faridabad Complex (Regulation and Development) Act, 1971 having been confirmed by the Governor of Haryana under Section 201 of the Punjab Municipal Act, 1911, are published for general information and shall come into force within limits of Faridabad Complex after thirty days from the date of publication of this notification in the Official Gazette :-

  1. In these by-laws -

(a) The words "Administration", "Chief Administrator" and Faridabad Complex shall have the same meaning as assigned to them under Section 2 of the Faridabad Complex (Regulation and Development) Act, 1971.

(b) "The Zonal Taxation Officer" means any officer of the Faridabad Complex Administration, who has been so appointed and shall also include any officer, who has been empowered to act as such by the Chief Administrator.

  1. (a) No owner of a bicycle or tricycle shall keep a bicycle or tricycle for private use or for hire or offer a bicycle or tricycle of which he is the owner to ply in that area subject to the authority of the Administration except under a licence granted in this behalf by the Licensing Officer.

(b) The Zonal Taxation Officer shall be the Licensing Officer for the purpose of these bye-laws.

  1. (a) A licence mentioned in bye-law 2 shall be granted on application of the owner thereof subject to the specific in bye-law 4 and shall be issued in form 'A' appended to these bye-laws by the Licensing Officer after the applicant has paid the tax of three rupees per annum and no licence shall continue to be in force after the 31st March, next following the date of issue.

(b) Every person to whom a licence is granted shall on or before the date on which the period of licence expires make a fresh application in the manner provided in clause (a) attaching the original licence therewith.

  1. The owner of the bicycle or tricycle shall be responsible to -

(a) Keep his bicycle or tricycle in order fitted with a bell and proper brakes, cat eye on front and rear.

(b) Keep to the left when passing vehicle or animal coming from the opposite direction.

(c) Keep to the right when passing vehicle or animal going in the same direction himself but should not ride abreast.

(d) Cause to be affixed the serial number or the metal plate supplied by the Administration on conspicuous place on the licensed bicycle or tricycle.

(e) Not to be rash in driving his bicycle or tricycle and observe all rules of the road and all regulations for the control of traffic which may be issued from time to time.

(f) Fix a bright light in front and cat eyes both in front and rear of the bicycle and tricycle.

  1. For a breach of any of the above-mentioned conditions the licence may be suspended or revoked by order in writing of the licensing officer in addition to the penalty provided in bye-law 11.
  2. The licensing officer shall deliver or cause to be delivered to the licensee a metal plate showing the licence number of the bicycle or tricycle. The cost of the plate shall be borne by the licensee.
  3. When a licensed bicycle or tricycle is transferred by sale or otherwise to another person he, the transferor, shall be responsible to report the facts of such transfers, to the Licensing Officer in writing for the substitutions of the transferee in his place which shall be made free of charge in case such report is received in the office of the Faridabad Complex Administration within fifteen days from the date of transfer.
  4. The original licensee shall until such transfer is reported and such name is substituted in the licence continue to be treated as the owner of the bicycle or tricycle and he shall be liable for all the penalties prescribed for the breach of these bye-laws.
  5. The Zonal Taxation Officer or any officer authorised in this behalf by the Chief Administrator may enquire the name and address of the person who is in possession of the bicycle or tricycle and that person shall correctly furnish the information asked for.
  6. A register in form 'B' appended to these by-laws shall be maintained for entering applications of the owners of the bicycle or tricycle and the licenses issued.
  7. Prosecution for any breach of these bye-laws shall be instituted by the Zonal Taxation Officer to the Faridabad Complex Administration or any other person who may be authorised by the Administration in this behalf.
  8. Any person who commits a breach of these bye-laws shall, on conviction by a Magistrate, be punishable with fine which may extend to two hundred rupees and when the breach is a continuing breach with a further fine which may extend to ten rupees for every day after the first during which the breach continues.
