The Central Boilers Board (Nomination of Members) Rules, 1961

G.S.R. 490, dated the 29th March, 1961. - In exercise of the powers conferred by clause (b) of sub-section (1) of section 28A of the Indian Boilers Act, 1923 (5 of 1923), the Central Government hereby makes the following rules, namely-
1. Short title and commencement.- (1) These rules may be called the Central Boilers (Nomination of Members) Rules, 1961.
(2) They shall come into force at once.
2. Definitions.- In these rules, unless the context otherwise requires,-
(a) "Act" means the Indian Boilers Act, 1923 (5 of 1923);
(b) "Board" means the Central Boilers Board constituted under section 27-A of the Act; and
(c) "member" means a member of the Board.
3. Ex officio members.- The Secretary to the Government of India in the Ministry dealing with the subject of boiler regulations and the Technical Adviser (Boilers) in that Ministry shall be ex officiomembers.
4. Manner of nomination of other members.- Other members, not exceeding thirteen, shall be nominated under clause (a) of sub-section (2) of section 27-A of the Act in the following manner:
(a) one member to be nominated in consultation with the Department of Iron and Steel;
(b) one member to represent the Union territories to be nominated in consultation with the Ministry of Home Affairs;
(c) one member to represent the railway to be nominated in consultation with the Ministry of Home Affairs; 4
(d) two members to represent the coal industry to be nominated in consultation with the Department of Mines and Fuel;
(e) two members to represent the Indian Standards Institution of whom one shall be an expert in metallurgy, to be nominated in consultation with that Institution;
(f) two members to represent the boiler manufacturing industry who shall be experts in castings, pressings, forging, radiology, we attachments or joints to be nominated in consultation with that Industry;
(g) one member to represent the users of boilers who shall be an expert in the erection, operation or maintenance of high pressure boilers to be nominated in consultation with the Ministry of Irrigation and Power;
(h) not more than three members to represent any other interests which in the opinion of the Central Government, ought to be represented on the Board to be nominated in consultation with the interests concerned.
5. Chairman of the Board.- The Secretary to the Government of India in the Ministry dealing with the subject of boiler regulations shall be the Chairman of the Board.
6. Term of office of members.- The term of office of members referred to in rule 4 shall be three years.
