An Act to validate registration and authentication of certain documents by the Tehsildars Bandipora and Kupwara.
Be it enacted by the Jammu and Kashmir State Legislature in the Nineteenth Year of the Republic of India as follows:-
- Short title.- This Act may be called the Jammu and Kashmir Registration of Deeds (Validating) Act, 1968.
- Validation of acts of certain officers to act as Sub-Registrars.- Notwithstanding the expiration of Notification SRO-147 dated 26th April, 1965, on 31st March, 1966, all acts performed by Tehsildars Bandipora and Kupwara purporting to act as Sub-Registrars respectively of Bandipora and Kupwara sub-district, formed under the said Notification during the period intervening 1st April, 1966 and 31st March, 1967, both dates inclusive, shall be valid and shall be deemed to have been validly performed on and from the dates of their performance as though the said notification was in force during the said period.
- Validation of the records of documents registered by the officers aforesaid.- In particular and without prejudice to the generality of the acts validated by the foregoing provision -
(a) all documents registered by the Tehsildar aforesaid while purporting to act as Sub-Registrars in the sub-district and during the period aforesaid shall be deemed to have been validly registered on the dates of their registration;
(b) all entries and indexes relating to the documents registered as aforesaid made in the Register Books in the manner provided by Part XI of the Jammu and Kashmir Registration Act, 1977, shall be deemed to have been validly made;
(c) all copies of such registered documents which have been duly signed and sealed by the said Tehsildars in the manner required by section 57 of the Jammu and Kashmir Registration Act, 1977 shall be admissible for purposes of proving the contents of the original documents.
- Protection for Tehsildars, acting bona fide as Registering Officers.- Notwithstanding anything contained in any law to the contrary, the Tehsildars aforesaid shall not be liable in any suit or proceeding for any claim for damage or otherwise by reason of anything in good faith done or refused by them while purporting to acts as Sub-Registrars as aforesaid.
- Saving.- Nothing contained in this Act shall affect the decision of a Court of competent jurisdiction which has become final before the commencement of the Jammu and Kashmir Registration of Deeds (Validating) Ordinance, 1967.
- Repeal.- The Jammu and Kashmir Registration of Deeds (Validating) Ordinance, 1968, is hereby repealed.
