Jammu and Kashmir Octroi (Repeal) Act, 1987

An Act to repeal the laws relating to imposition and collection of Octroi in the State.

Be it enacted by the Jammu and Kashmir State Legislature in the Thirty-eight Year of the Republic of India as follows :-

  1. Short title.- This Act may be called the Jammu and Kashmir Octroi (Repeal) Act, 1987.
  2. Repeal and savings.- (1) As from the date of commencement of this Act,-

(a) the Jammu and Kashmir Octroi Act, Samvat 1958 ; and

(b) such of the provisions of the

(i) Jammu and Kashmir Municipal Act, Samvat 2008 ; and

(ii) Jammu and Kashmir Town Area Act, Samvat 2011 ; and

(iii) Jammu and Kashmir Village Panchayat Act, 1958 ;

so far these relate to imposition or collection of Octroi or Dharat, shall stand repealed.

(2) Not withstanding the repeat by sub-section (1), section 6 of the General Clauses Act, Samvat 1977 shall apply in relation to the repeal of any of the laws referred to in sub-section (1) as if the law so repealed had been an enactment within the meaning of section 6 of that Act.
