An Act to extend [the Andhra Pradesh Revenue Enquiries Act, 1893], to certain areas in the State of Andhra Pradesh and further to amend it in its application to that State.
Be it enacted by the Legislature of the State of Andhra Pradesh in the Ninth Year of the Republic of India as follows:
- Short title, extent and commencement:- (1) This Act may be called [the Andhra Pradesh Revenue Enquiries (Extension and Amendment) Act, 1958.]
(2) It extends to the whole of the State of Andhra Pradesh.
(3) This section shall come into force at once and the remaining provisions shall come into force on such date [as the Government may, by notification in the Andhra Pradesh Gazette, appoint].
- Definitions:- In this Act—
(a) 'Andhra area' means the territories of the State of Andhra Pradesh which immediately before the 1st November, 1956 were comprised in the State of Andhra ;
(b) 'Government' means the State Government ;
(c) 'transferred territories' means the territories specified in sub-section (1) of Section 3 of the States Re-organisation Act, 1956 (Central Act 37 of 1956).
- Extension of [Act V of 1893]to transferred territories:- [The Andhra Pradesh Revenue Enquiries Act, 1893 (Act V of 1893)] as in force at the commencement of this Act in the Andhra area (hereinafter referred to as the principal Act), as amended by Sections 4,5,6,7 and 8 is hereby extended to, and shall be in force in the Transferred Act, 1893.
4-8. [Amendments made by Sections 4-8 have been carried out in the Andhra Pradesh Revenue Enquiries Act, 1893].
- Power to remove difficulty:- If any difficulty arises in giving effect to the provisions of this Act or of the principal Act as extended by this Act, in their application to the transferred territories, the Government may, by order, make such provisions or give such directions, not inconsistent with the purposes of this Act or of the principal Act as extended by this Act, as appear to them to be necessary or expedient for removing the difficulty.
- Repeal:- (1) The Conferring of Powers for Summoning Witnesses Act (Hyderabad Act I of 1314 F.) is hereby repealed.
(2) Upon such repeal, the provisions of [the Andhra Pradesh General Clauses Act, 1891 (Act I of 1891), shall apply ; and for the removal of doubts it is hereby declared that any proceeding commenced under the said Act and pending at the commencement of this Act before any officer or as if Court, shall be disposed of in accordance with the provisions of the said Act had continued in force and this Act had not been passed.]
