Received the assent of the Governor of Haryana on the 3rd March, 1997 and was published in the Haryana Gazette, (Extraordinary), Legislative Supplement, Part I, dated March 12, 1997/Phalguna 21, 1918.

An Act to amend the Registration Act, 1908, in its application to the State of Haryana.

Be it enacted by the Legislature of the State of Haryana in the Forty-seventh Year of the Republic of India as follows :-

  1. Short title.- This Act may be called the Registration (Haryana Amendment) Act, 1996.

Statement of Objects and Reasons - It has been observed that some persons in Haryana State, with a view to avoiding payment of higher rate or to avoid payment of stamp Duty, get their sale deeds registered at Delhi, by under-valuation of properties situated in Haryana, as the rates of Stamp Duty in Delhi are lower as compared to the rates prevailing in Haryana. In order, therefore, to check payment of lower rates of Stamp Duty at Delhi and to stop the under-valuation of properties situated in Haryana, at the time of registration, with the approval of the Government of India, Ordinance No. 6 of 1996 was issued on 21st September, 1996 deleting sub-section (2) of Section 30 and Section 67 of the Registration Act, 1908 in its application to the State of Haryana as the State Legislature was not in session. Hence, the registration (Haryana Amendment) Bill, 1996 with a view to replace the Ordinance.

  1. Amendment of Section 30 of Central Act 16 of 1908.- Sub-section (2) of Section 30 of the Registration Act, 1908 (hereinafter referred to as the principal Act), shall be omitted.
  2. Omission of Section 67 of Central Act 16 of 1908.- Section 67 of the principal Act shall be omitted.
  3. Repeal.- The Registration (Haryana Amendment) Ordinance, 1996 (Haryana Ordinance No. 6 of 1996), is hereby repealed.
